Bombshell documents released by FBI Director Kash Patel and FBI Deputy Director Dan Bongino reveal that former Special Counsel Jack Smith was tracking the private communication of eight Republican senators, including Sens. Lindsey Graham (SC), Marsha Blackburn (TN), Josh Hawley (MO), and Tommy Tuberville (AL) Ron Johnson (WI), Cynthia Lummis (WY), Bill Hagerty (TN), Dan Sullivan (AK), and one U.S. Representative, Mike Kelly (PA). He tracked the Republicans’ phone calls as part of his January 6 investigation (“Arctic Frost”).

The FBI notified the lawmakers immediately of what had transpired. And Bongino released a statement: “Under our leadership, the FBI will never again be used as a political weapon against the American people.”

So not only was the Deep State going after President Trump, but it was going after conservative members of Congress. Such a shocking revelation should be the top headline on every mainstream media outlet. It should also put Congress on high alert that a special counsel was going after them.

ACLJ Chief Counsel Jay Sekulow reacted to the news:

This is an outrage. I want everybody to put this into context. Could you imagine if it were a different situation and the DOJ under President Trump was spying on six Democratic Senators? What would the reaction be? . . . Why in the world did Jack Smith try to get the phone records of a co-equal branch of government – Senators and a Member of the House of Representatives – for what purpose? Now he targets this around the January 6 time because he was concerned that maybe these Senators were ones who were going to vote not to certify. Let’s assume that was true just for the sake of argument. You know what the answer to that is? So what? You’re the Special Counsel. You’re not the governor of the elections. And a sitting U.S. Senator can vote any way they want. They’re elected, and if you don’t like the way they vote, you vote for somebody else. But this action by Jack Smith just typifies what was going on with the weaponization of the DOJ.

CONGRESS DOJ

Apparently, Smith obtained a warrant from a judge to obtain the private cell phone data of lawmakers. The court must have decided that the Fourth Amendment didn’t apply to these Members of Congress. Did the judge really think that there was probable cause that they had engaged in a crime?

And let’s not forget the timeline of these events. The Biden administration didn’t launch Arctic Frost until April 2022. Smith collected these phone records in 2023. That’s right: just before the 2024 election season. Obviously, Smith and the Biden DOJ were engaging in election interference.

And our taxpayer dollars paid for this investigation, for what? Just to find out who eight duly elected senators and one U.S. representative were talking to on the phone. Such a sham investigation should never happen in America – and the Biden DOJ should have had greater respect for the rule of law.

Sen. Bill Hagerty, one of Smith’s targets, joined the Sekulow broadcast to share his perspective:

Initially, I was shocked and then heartbroken. I mean, if you think about it, if political operatives at the FBI are allowed to do this to me – I’m a sitting U.S. Senator. I was the U.S. Ambassador to Japan. If they can do this to me, they can do it to you. They can do it to the American people. If they’re so bold as to think that they could get away with doing this, having an Executive branch law enforcement agency reach over into the Legislative branch and go after sitting Senators who have oversight responsibilities for them, it is just beyond the pale, and it makes you ask yourself: What else have they gotten away with? If they’re that bold, what else did they try to do? We’re just getting to the tip of the iceberg here with this revelation, and we need to get to the bottom of it as quickly as possible. I want to see people prosecuted to the fullest extent of the law. . . to dissuade others from doing this in the future, but also . . . to restore confidence in institutions like the FBI.

The ACLJ has filed nearly 20 lawsuits against the Biden Deep State. We plan to file a new Freedom of Information Act (FOIA) request regarding this new revelation of DOJ corruption. We must prevent future targeting of American citizens. We will keep you updated on future developments.
