Will Health Care Reform become a litmus test for new Supreme Court nominee?

With the announcement that Justice John Paul Stevens will retire from the Supreme Court, one might start to question whether or not the recently passed Health Care legislation will become a litmus test question for whomever the President nominates for the Supreme Court.

As more and more states file suit against the overreaching federal government, questions related to the 10th amendment and the it's affects on health care will surely come up, won't it?
