A Court of Super-Legislators

My Townhall column discusses the reason that Supreme Court confirmation hearings in the post-Bork era have devolved into political food fights -- and why the Democrats began the practice of treating potential justices like politicians.  It's because they see judges as super-legislators, which means that (contrary to previous understandings about judicial impartiality) their own personal and political views matter very, very much.
