At least in a military commission, all the evidence obtained from KSM through waterboarding wouldn't be excluded.

Note, however, that even with his latest waffling on the issue of KSM's trial, Holder nevertheless continues to insist that a civil trial would be the best option.  What does that tell you about our Attorney General's judgment?
