Do you feel the leaked information from a global warming alarmist organization is meaningful?

For the fourth time in six cases, the Supreme Court of the United States has reversed a decision for which Judge Sonia Sotomayor voted on the 2nd Circuit Court of Appeals. If this nominee were a white male, would this not raise questions about whether he should be elevated to a court that has found his previous decisions wrong two-thirds of the times when those decisions have been reviewed?

Is no one supposed to ask questions about qualifications, simply because this nominee is Hispanic and a woman? Have we become that mindless?

Qualifications are not simply a question of how long you have been doing something, but how well you have done it. Judge Sotomayor has certainly been on the federal bench long enough, but is being reversed four out of six times a sign of a job well done?

Would longevity be equated with qualifications anywhere else? Some sergeants have been in the army longer than some generals but nobody thinks that is a reason to make those sergeants generals.

Performance matters. And Judge Sotomayor's performance provides no reason for putting her on the Supreme Court.

Longevity is not the only false argument for putting Sonia Sotomayor on the Supreme Court. Another is the argument that "elections have consequences," so that the fact that Barack Obama won last year's elections means that his choice for the Supreme Court should be confirmed. This is a political talking point rather than a serious argument.

Of course elections have consequences. But Senators were also elected, and the Constitution of the United States gives them both the right and the duty to say "yes" or "no" to any president's judicial nominees.

It is painfully appropriate that the case which finally took the Sotomayor nomination beyond the realm of personal biography is one where the key question is how far this country is going to go on the question of racial representation versus individual qualifications.

Within living memory, there was a time when someone who was black could not get certain jobs, regardless of how high that individual's qualifications might be. It outraged the conscience of a nation and aroused people of various races and social backgrounds to rise up against it, sometimes at the risk of their lives.

Many, if not most, thought that they were fighting for equal treatment for all. But, today, too many people seem to think it is just a question of whose ox is gored-- or for whom one has "empathy," which amounts to the same thing in practice.

Too much that Sonia Sotomayor has said and done over the years places her squarely in the camp of those supporting a racial spoils system instead of equal treatment for all. The organizations she has belonged to, as well as the statements she has made repeatedly -- not just an isolated slip of the tongue taken "out of context"-- as well as her dismissing the white firefighters' case that the Supreme Court heard and heeded, all point in the same direction.

Clever people say that none of this matters because Republican Senators don't have enough votes to stop this nominee from being confirmed. But that assumes that every Democrat will vote for her, regardless of what the public thinks. It also assumes that alerting the public doesn't matter, now or for the future.

The standards for judging the nomination of Sonia Sotomayor are not the standards of either the criminal law or the civil law. That is, nothing has to be proven against her "beyond a reasonable doubt" or even by "a preponderance of the evidence."

Judge Sotomayor is not in any jeopardy that would entitle her to the benefit of the doubt. It is 300 million Americans and their posterity who are entitled to the benefit of the doubt when the enormous power of determining what their rights are is put into anyone's hands as a Supreme Court justice for life.

The New Haven firefighters got their rights, despite Judge Sotomayor, because of a one-vote majority in the Supreme Court, where one vote counts big time. Making Sonia Sotomayor that one vote is a big gamble with the rights of all Americans.

A very well thought out opinion with which I strongly agree. It is hoped that those who will be involved in approving or disapproving her will read this thought arresting opinion.

keep up the fight!
"Clever people say that none of this matters because Republican Senators don't have enough votes to stop this nominee... But that assumes that every Democrat will vote for her... It also assumes that alerting the public doesn't matter, now or for the future."

Well-put. There is ample reason to continue to fight this nominee all the way to the end.

Mindless????
"Have we become that mindless?"
==============================================

Well, we took a man whose sole accomplishment in life is to have beat two smokes like Hillary and John McCain in an election among millions of American too stupid to pay attention for more than 3-4 months every 3-4 years.

I am not impressed. Sure he won, but c'mon now these are two liberal flakes that could not beat a man with known radical roots and an absolute boatload of unsavory associates that was in a self described drug induced haze all through HS. A "man" that has never had a real job in his life- a "man" that cannot think of much good to say about our great land. A "man" that lets foreign dictators rip us to shreds right in front of him and then gets up and agrees with him. An absolute coward with a communist wife and deep communist roots----- and we made him President.

Yes, our collective minds are gone. The feckless GOP stood by for decades as the public school brainwashing took root and made this all possible. The brain dead of society are on display here nightly in the form of Hal Doofas, Mario the self proclaimed patriot, Rudolph, zapdoonothing but beach about Bush, left Angle, chloe, Lilly, Will, wrightswrong, Porta John and all of the other brain dead goobers that have their hands out waiting for the benevolent govt. to grease their palms with some govt. cheese. It's free!!!!!

You losers are a pathetic lot.

P.S., my apologies to all of you useless trolls that I left out. You are just as filthy and disgusting as all the others that got mentioned above. XOXOXOXO

Sotomayor's judicial opinions
are her resume. The following is one example,

Center for Reproductive Law and Policy v. Bush, 304 F.3d 183 (2d Cir. 2002

“Sotomayor held that the plaintiffs did have standing with regard to their equal protection claim, but she ultimately held that the claim failed under rational basis review because the government “is free to favor the anti-abortion position over the pro-choice position” with public funds.”

This is how your tax dollars would be used? It seems to favor one group over another.

Sotomayor
"Have we become that mindless?"

Sadly, yes we have.

@Libertus Correction
It isn't Pappas vs DeStefano, it's Pappas vs Guglianni.

@Libertus
Of the top of my head:

Pappas vs DeStefano
Maloney v. Cuomo

By the way
Libertus means liberty in Latin and not to be associated with liberal thought or philosophy. Imposters like Robert need to return to school and try to pass their classes on the % scale instead of sliding by on the curve.

Valid concerns about Sotomayor
have surfaced. It is interesting that those of us who don't want her on the court are not answered with reasons why she should serve, but rather with weak rebuttals to our skepticism about her professional abilities. Most of us can recite 3 or more reasons to disqualifiy this candidate. Perhaps her supporters could peruse those other 300 cases and show us 4 that shows that she respects the Constitution. LOL tick....tick....tick

CORRECT UNFAIRNESS, BY BEING UNFAIR ??

Judge Sotomayor should not be on the Supreme Court as long as she feels two wrongs-----make a right !! Shall we eliminate favoritism by replacing it with favoritism ???

Want to STOP Sotomayor?
It is as easy as 1 ... 2 ... 3!

1) Make Obama show his long form Birth Certificate.

2) Make Obama show ALL of college application and transcript records.

3) Make Obama show ALL of his passport records including the passport that he used to travel to Pakistan when it was illegal for Americans to do so.

When DUMB-BOMBA the fake POTUS and mass murderer of innocent children both in and out of the womb refuses to do so ...

Then kick him out of office.

No Obama ... No Sotomayor.

Easy as 1 ... 2 ... 3!

Where's the Birth certificate?

Response to nametabs on TD2008
Possibly "TD" means the visa classification (technically correct term is actually TD-1***) dependent of a TN-1 worker barred (with good reason, given his/her posts) from working in US--ergo having much free time.

Translated by Canadians (on immigration fora--where holders of this visa type shill much about it) as "total disaster".

***there is also a TD-2, dependent of a (Mexican citizen) TN-2 worker--but most Canadians (and ex-Canadians such as myself) generally mean the TD-1.

please run a correction
dr. sowell erroneously cited an amicus brief in the didden case as coming from a decision by the SCOTUS. the SCOTUS denied cert on the didden case. this is lazy reporting which leaves readers with a patently false impression and should be corrected.

A - Sheer Hypocrisy
I agree with you that the % reversal isn't alone enough to disqualify Sotomayor from the Supreme Court.

That said, though, are you reading the WHY these cases were reversed? They seem to me to cut straight to the heart of what a Justice should be.

Failing to follow "Due Process". Are you saying that doesn't matter? And are you really for advocating a racial spoils system? How will that help the country? When will the U.S. truly become post racial if our very laws say that can't be the case.

This is a sad note on Obama's legacy. He was elected by a significant number of people of all races, included whites, because they felt he was confirmation that American had finally left it's ugly history behind. Then he appoints a person to the bench who clearly doesn't believe that as a show of "just kidding". Shameful.

Sotomayor is Puerto Rican

Sheer Hypocrisy
So you are telling me that 3 cases reversed, from over 300 cases authored constitute a majority of her cases? You need to get help on math.

I'm omitting the Ricci vs DeStefano since the "60% reversal rate on Judge Sotomayor" myth is on the majority opinions she authored, not all the cases she's reviewed. You don't call a double a home run in the middle of the game.

By your standard, Justice Alito must resign, since he was reversed 4 times in his 15 years as a Judge. Even one of them was 9-0! And Chief Justice Roberts must also resign since he was also reversed a couple of times in his 4 year tenure, one of them AFTER he assumed his position as Chief Justice.

Please, don't come with hypocrisy, half truths and just plain smear. You serve your country very low by them.

The Law
Proud Liberal -
You're right. We don't need seasoned lawyers and judges to interpret the Constitution. I have no legal training but I'm intelligent enough to study the Constituion and apply its principles. That's what conservatism is!
Now liberals 'interpret' the Constitution and use their 'life experiences, gender, race' to apply the 'law'. You might think this requires diverse lawyers and judges, but I don't think so!

sotomayor
The Didden v Port Chester statement is way off. The Supreme Court denied cert ( review ) and the statement Sowell quotes ("evident denial of the most elementary forms of procedural due process") comes from an amicus brief filed on appellant's behalf- real sloppy and misleading

Bork Sotomayor?
Are you sure you want to? She is pretty ugly. Well, there is always the paper-bag-over-the-head option. Enjoy!

Boob
Yoshi you are a boob. The problem with Soto mayor is that she is a self professed racist. There is NOTHING in Judge Alito's history that even suggests the same. She is unqualified to sit on the bench. Racist pig. But she is of the correct political bent so we'll give her a pass.

Dear Mr. Thinks So Well
I wish we could clone you, but that wouldn't be ethical or moral so I just wish more people had your brains and integrity. And I wish they, like you, had cleared away the politically correct cobwebs. You speak the truth and have an innate common sense. Thank you for being there for all of us who want what is best for our country and in turn, for ourselves, for our loved ones and for other Americans. If Sotomayor is appointed it won't be because people such as yourself didn't carry the lantern of truth through the village crying out, Hear Ye. Hear Ye!

"If you are still around. The last person I went over this with finally agreed that teaching someone to program computers might be better than teaching them - especially inner city people - to fish." Tell me about it-- I live in the desert. The metaphor does nicely define the difference between the liberal idea If you are still around. The last person I went over this with finally agreed that teaching someone to program computers might be better than teaching them - especially inner city people - to fish." I live in the desert-- tell me about it.

It is a nice metaphor for the liberal and the conservative ideas of compassion. An even better metaphor for the liberal's idea of compassion is in the movie "Fried Green Tomatoes". The women are riding in a boxcar filled with food and pass through a homeless camp. They begin throwing the crates of food out of the boxcar. Liberal compassion-- they feel good, they're actively doing something, it's temporary and won't change anything, and it all comes out of someone else's pocket.

Anything that encourages the creation of real, private sector, productive jobs is compassionate. Anything that discourages this, like high taxes, is cruel, even if you do use it to throw boxes of someone else's food at the poor.

Liberal morons
A proud Liberal calls Dr. Sowell an Uncle Tom because hes conservative. Dr sowell has common sense something the Liberals cannot understand because they dont have any. My bumper sticker says Liberals are so openminded their brains have all fallen out. Dr Sowell meerely points out that Sodamier has been reversed many times for very poor judgment, this does not qualify her for the supreme court. She remains a very flawed individual and she should not be allowed to serve on the Supreme court as a matter of fact, judging by her reversal record she should be disbarred instead.

Sowell wrote a book like this column
The vision of the anointed essentially discovered that people will act on their beliefs. What Sowell never realized for his book is that all people act on their beliefs, liberals - which he termed the anointed - do so but also conservatives - which he seemed never to realize. Sowell doesn't like the beliefs of the anointed. So what?

His column here, today, is similar. He doesn't like Sotomayor because he doesn't like her beliefs. So what?

Robert
If you are still around. The last person I went over this with finally agreed that teaching someone to program computers might be better than teaching them - especially inner city people - to fish.

If you're a disadvantaged inner city person you may have to go a long way outside the city to catch a fish, have to transfer buses several times, hitch a ride, etc. That's the short exposition.

At bottom, though, it's a too facile, too smug proposition.

Racism Alive and well in America

Camus aka Shorts aka Willy Lopez will probably be holding a 'Racist Party'.

"You and most of the rest of the TH"S are lily white , sad bitter old people , way past being relevant" Camus aka Shorts

"My vision is simple , for one year only , we will bring old Jim crow laws back to apply to you (white people) , just for one year" Camus aka Shorts

Camus and Liberius2009 are proof positive that racism is alive and well in America.

Speaking of the common sense laws passed by Oklahoma, a couple of days ago, I sent an email to Senator James Inhofe, R. Oklahoma. I asked him if he had considered running for president. I told him if he did to keep me on his mailing list because I would campaign for him and vote for him.

I became familiar with him when I was wondering about the chance the Senate would pass Cap & Trade now that it has cleared the House. In a Google search, Senator Inhofe had an article stating he did not think it would fly in the Senate, and that he would do all in his power to stop it.

He also spoke of other politically correct legislation that he opposed and it was obvious he was not afraid of the Main Stream Media, or anyone else.

Everything I read made him out to be a very gutsy legislator with leadership qualities. Not many of those left in the GOP. Read some of the things he has said regarding the most recent lame brained issues of the left. It appears this guy is the real McCoy, a true conservative and a good communicator.

We should all email him to encourage him to run for POTUS. God knows we need some good candidates and there aren’t very many.

Liberius2009 aka Charles from PA

Have I told you lately, that Racists are despicable and vile?

Less Than One Term!
Dr. Sowell has hit another bull's eye with this piece. He eloquently explained why Sotomayor is unfit for the Supreme Court. As usual, his arguments are erudite and focused.

I would carry his argument one step farther. I would argue that her nomination disqualifies Obama to be President, and may be grounds for impeachment. Sotomayor's history clearly shows does not believe in equal treatment before the law. As Dr. Sowell noted, "Too much that Sonia Sotomayor has said and done over the years places her squarely in the camp of those supporting a racial spoils system instead of equal treatment for all. The organizations she has belonged to, as well as the statements she has made repeatedly -- not just an isolated slip of the tongue taken "out of context"-- as well as her dismissing the white firefighters' case that the Supreme Court heard and heeded, all point in the same direction."

There's no doubt that Obama knew of Sotomayor's anti-Constitutional philosophy. Indeed, that's precisely why he wants her on the Court. By nominating a judge he knew would violate her oath to enforce equal treatment before the law, Obama violated his own oath of office to faithfully uphold and defend the Constitution. I doubt any legal scholar would deny Congress has the power to bring impeachment in this circumstance.

Once voters have had enough of Obama (the polls are definitely moving in that direction), their congressmen will understand their own reelections depend on getting rid of him. They will be forced to muster the courage to throw the imposter out of office. I hope Dr. Sowell will address this in a future column.

My new bumper sticker: Less Than One Term!

Proud Liberal et al

You may class my thinking however you wish.

You would have a hard time convincing my wife, daughters, friends both Religious or Political and the Computer programmers and Scientist I have worked with over the years that I am not an independent thinker.

I have personally learned several things about those who do not use facts, logic and reason to make decisions and guide their actions. I use the term Liberal because I have learned that anyone who considers themselves Liberal only recognize 'Collections of Individuals' not Individualism.
1) Refusal to accept personal responsibility.
2) Think always in terms of 'Collectivism' rather than Individualism.
3) Never measure their solutions for progress or success or lack of success.
4) Never think about possible 'Collateral Damage' to their solutions.
5) Never plan ahead for possible errors in their solutions.
6) Repeat the same solutions over and over, even though have failed throughout history every time tried.
7) Reduce every failed solution to a lack of money and the failed solution will work if funds are increased,
8) More interested in making History, rather than learning from History.
9) Loves Humanity but despise those who makeup Humanity.
10) Always focus on 'Process rather than Progress'.
11) Always trying to save others with the implied attitude they need no improvement personally.
12) They do not want the same rights and protections for every American Citizen; they want 'Special Right' for certain 'Collectives'.
13) They see America as oppressive rather than freedom giving.
14) Anyone who is successful accomplished that success by oppressing others.
15) There should be equal outcomes disregarding individual choices and actions.
16) Against the idea of inalienable rights and defenders of alienable rights granted by fiat of Government (only if they are in power).

These are just some of my thoughts about the 'Collective of Liberals'.

Proud Liberal
"I also remember, in round terms, when Rush started to redefine what had hitherto been liberal terms, like "compassion." It may have been Rush who first said that compassion was teaching someone how to fish." What makes you think compassion is a liberal term? I've never heard that Rush quote before, because I seldom listen to him, but I think it's excellent. If you give people fish, you enslave them. If you teach them to fish, you liberate them. Which is more compassionate and which will be more likely to ensure a good supply of fish?

The Pot Calling The Kettle Black?
If Conservatives have a problem with one or two of Sonia Sotomayor’s comments on how being a Latina woman affect her views on the world or the fact that a relative few of her decisions have been reversed in front of the high court, perhaps they ought to seek Justice Samuel Alto’s resignation at the same time. During his confirmation hearings before the Senate Judiciary Committee he made several statements as to how being the son of Italian immigrants affected his worldview. Here is just one of many: “When I get a case about discrimination, I have to think about people in my own family who suffered discrimination because of their ethnic background or because of religion or because of gender. And I do take that into account.” Regarding Alito, like Sotomayor, he too had cases that he had voted in favor of, overturned upon review by the Supreme Court.

While the Right continues to bellow about Sotomayor’s supposed bent on being likely to side with those who claim to have been discriminated against, the SCOTUS Blog has provided statistics that would lead one to believe otherwise. In 96 cases that came before her regarding discrimination she ruled in favor of the defendants just 10 times, ruling that discrimination was not operative in 78 cases with the remaining 8 cases not being substantially affected by discriminatory motives.

Barack Obama has skillfully painted the G.O.P. into a corner on this one knowing full well that the party needs to expand its appeal among minorities if it is ever to hope to become politically competitive in the long run. It is insightful that there has been little in the way of heated opposition to Sotomayor’s nomination from Republicans on Capitol Hill with most of the noise emanating from the hard right talk shows and columnists rather than from those who actually have to stand for election.

As Usual, LON
threw the baby out with the bath water.

The headline read: "Equality on Trial"

Sowell's theses include:
"Too much that Sonia Sotomayor has said and done over the years places her squarely in the camp of those supporting a racial spoils system instead of equal treatment for all."
and:
"But, today, too many people seem to think it is just a question of whose ox is gored-- or for whom one has "empathy," which amounts to the same thing in practice."

Lon rebuts with, to paraphrase "Yeah, but Alito sucked too" Brilliant, dude. Right up there with Ms. Maddow.

Poor Loony_PA:

"As usual Sowell doesn't seem to feel the need to know what he is talking about in order to pretend expertise."

Actually, Dr. Sowell has forgotten MORE than Loony of PA will ever hope to know!

Loony is clueless... "The Supreme Court does not hear most cases decided by the lower courts. It just hears ones in which a certain number of justices think that there might be a need to reverse the lower court's decision."

Really now?!?!? Ha Ha Ha

Profblog from WA

I relate to your story about Japan.

I lived in Cairo Egypt for a while - you did better than me on communicating but I at least learned enough Arabic to order food and receive some directions.

Hardest word I finally learned how to say was 'Raisin' - no matter how I described that I wanted raisins, the locals always thought I wanted some kind of 'Animal Food'.

I finally broke down and asked one of my English speaking computer programming students and she gave me the word phonetically spelled 'Zabeeb'.

Retired Geek
That's just personal memory on my part. I also remember, in round terms, when Rush started to redefine what had hitherto been liberal terms, like "compassion." It may have been Rush who first said that compassion was teaching someone how to fish. I also remember that it was in this latter era that conservatives began talking about the fact that liberals made decisions with their emotions while conservatives used their rational powers to make decision.

Needless to say, conservatives, to the man and woman, gobbled up these new battle cries the very next day after they were originated, have stored them in their arsenals and trot them out dog and pony show fashion, with much self praise.

And you think you think for yourselves.

As usual
As usual Sowell doesn't seem to feel the need to know what he is talking about in order to pretend expertise.

To answer his first question, Alito had a higher reversal rate. He is a white male. It was not a serious issue in his nomination. So no a white male would not have had this problem.

The Supreme Court does not hear most cases decided by the lower courts. It just hears ones in which a certain number of justices think that there might be a need to reverse the lower court's decision. So reversal rates tend to be high. Nothing interesting about the fact that Sowell mistakenly presents as important.

Since I posted this in the a.m.:
I'll add it again:

The first Hispanic SC assoc. justice was Benjamin Nathan Cardozo who was born in New York City in 1870, a descendant of Spanish
Sephardic Jews who came to the Colonies
before the American Revolution.

After Cardozo graduated with top honors from Columbia College and Columbia Law School, he, in 1913, as a Democrat, was elected to the New York Supreme Court, which was a trial not an appellate court; he was then assigned to the Court of Appeals and, in 1926, became its chief justice.

In 1932, Herbery Hoover appointed him to the US Sup. Ct. where he served for 6 years.

One of the earlier sources of *political correctness* is Dinesh D'Souza's Illiberal Education, 1991.

Some references look to Animal Farm, 1949, but the novel does not use the term, altho' those animals who are more equal than other animals obviously practice PC.

Regardless, Sotomayor is neither intellectually nor legally competent to sit on today's SC. And now that she is not the *first* Hispanic/Latina/Mexicano/yadda, she doesn't matter except,

if King Elect O really aspires to be dictator/king, he needs to have a SC the opposite of Honduras that just threw out a tyrant who planned to take over the country. Maybe Sotomojo is the first plank in O's attempt to eliminate the 22nd amend.

Bork Sotomayor.
Teapartypatriots.org--find a place to take back the streets on the 4th.

Dear Proud Liberal
Having just spent 2 years in Tokyo, I can attest that you can live there and not really speak Japanese. Out of respect for their country, I struggled to learn some of their language. I yearned to be able to speak with many people and hear their stories. I ended up being able to survive, order food, exchange pleasantries, ask for directions. If I left urban centers, I was mostly lost. Are you suggesting that they all should accomodate me and change their country's language? Will not happen. Why don't you travel and find some head hunters in Indonesia and speak English while they have you for dinner. Sticking your head in the sand to this reality may make sense in this country ("If you want to live there, learn their language") but it makes no sense anywhere else. We are just in a little space of time where it's expedient for other countries' citizens to learn English. Speak Spanish all you want, but, "no hay un buen trabajo para usted, comprende?"

Turn about fair play ...
... bork her.

My view on Freedom of Speech

The more powerful Liberalism becomes, the less it will tolerate 'Individual Rights'.

The first 'Line of Defense' against the 'Totalitarian Dream' of Barack Obama and his Liberal followers, is 'Freedom of Speech'.

'Politically Correct Speech' was designed by Liberals to narrow thought and 'Scope' of 'Free Speech'.

'Hate Speech' was designed by Liberals to 'Silence' any criticism of 'Special Rights' for some, while eliminating 'Rights' for others.

'The Fairness Doctrine' was designed by Liberals to 'Eliminate' any and all Speech that would question the 'Rise' of the Liberal Totalitarian government.

Sotomayor lacks credential and track
record to be Supreme court judge, unless we now have affirmative action in the supreme court.
A judge rules on the law not on their personal "emotions" including those that have been programmed in the person through their development. To expect "empathy" from a judge is to expect "prejudice." Liberals are so shallow, impulsive and violent, in their thinking and behavior, they insist on their ways no matter what they destroy on their way. Like a spoil child demanding their way.
Because they have gotten "their way" too often in the courts, liberals conveniently ignore the most basic principle of Judicial Integrity, it's very foundation, no PREJUDICISM, which of course includes favoring one over the other, whether is poor over rich, rich over poor, white over black, black over white. This is a basic principle that only a leftist liberal chooses to ignore, for their convenience.
Sotomayor comments about her superiority over "white males," is obvious evidence of her lack of the "inner gift" to be a JUST, judge.

Affirmative Action or Affavorite Action has always been a form of discrimination and it is long over due to be erased from the law. The democrats know that they would lose the majority of black voters if they removed it, so for the votes, they continue to support this discrimination. Such HYPOCRISY.

It is the Hoover Institution, so what.
The refered web site is "progressive," which means progressing towards communism, full of leftist liberal bias and pretending to be creative= Unreliable source for Truth.

Sotomayor is not qualified to be a judge much less Supreme court judge, she never would have gotten this far without "affavorite action."

Dems are RACIST!
Take it from this black Republican at http://www.theblacksphere.net. Dems don't want the secret getting out! GREAT read!

The term 'Politically Correct' is a relatively new term - the concept of 'Politically Correct Speech' has been around for centuries.

'Digital Communication' is a relatively new term but, digital communications has also been around for centuries, using drumbeats and striking hollow logs to transmit messages further than the human voice.

Digital Communications were in active use before the Civil War, when Samuel Morse developed the 'Morse Code' and Telegraphy digitally transmitted by electricity over long distances were digital transmissions.

A Column in a British newspaper
A column in a British newspaper discussed 'Politically Correct' speech. The following was written by a female Journalist along with some comments by her readers. None of the following was written by me.

A story based on the Three Little Pigs fairy tale has been turned down by a government agency's awards panel as the subject matter could offend Muslims.

How pigheaded can you get? I see they also covered Animal Farm, but what about Wilbur the Pig in Charlotte's Web? Mrs. Piggle-Wiggle? And Piglet from Winnie the Pooh?

Should Miss Piggy be stoned to death for (a) being a pig, (b) pursuing an interspecies relationship with a frog, (c) not wearing a burqa, or (d) all three?

How about the little piggies on our children's feet who went to market, had roast beef, and went wee-wee-wee etc? Should we turn them into, say, puppies? (Sorry, Pupovich.)

Does this mean I should no longer wear my hair in pigtails?

That you can no longer go to an all-you-can-eat buffet to "pig out"?

You can't give piggyback rides? Or have them?

If I can't speak Pig-Latin, then how am I supposed to verbally transmit classified information in front of the kids?

If my house isn't a pigsty, then what is it?

The Beatles' White Album includes a song called "Piggies." All copies of that album should be destroyed. Maybe it can be reissued without that song.

Finally, how are they supposed to end Looney Tunes cartoons without Porky Pig sputtering, "Buhdeeba-buhdeeba-duh-that's all, folks!"

Ah, PigglyWiggly. We still have one in my home town. They're doing a storebrand generic line of soft drinks now. Their knockoff of Dr Pepper is a knockoff of Mr Pibb, which they call "Mr. Pig."

Liberius 2009
That is very interesting, can you elaborate a little more on the importance of this, and what it means and could mean to the jewish voters.

Proud Liberal - PC
At the U of O in 89/90 the term P.C. was already in full swing. The man leading the on-campus gay rights group used it in discussing why the Army and other services should not be able to recruit on campus like various companies because they were not P.C.

P.C. is a term the left uses to stop discussion with those people who don't agree with their political objectives and therefore are not P.C. If your opinions are NOT correct, then you must be wrong, according to the left. Simply saying someone else' opinion is wrong has the distinct odor of censorship. i.e. "I am correct and you are not. Therefore, you don't need to be listened to because you are wrong."

Sorry, but I don't believe you are "correct" on this issue.

Proud Liberal

Your comment about PC speech only shows your ignorance - my statement is not meant as a pejorative but a statement of fact.

George Orwell's 1984 was published in 1949 and was replete with the concept of speech meant for various things rather than just the words spoken

I have only thought about your statement for a few seconds, but Karl Marx, Lenin are other examples of redefining certain words or phrases considered improper.

Plato began arguments that centered on the concept of acceptable and unacceptable speech.

I have no idea where in the World you arrived at the notion, that this was a creation of modern day American Conservatives.

Sloppy Research
I see that townhall has not yet run a correction to Dr. Sowell's inaccurate assertion that the Supreme Court "openly rebuked the unanimous three-judge panel that included Judge Sotomayor" in the Didden v. Village of Port Chester case. See: :

http://theusconstitution.org/blog.history/?p=955

And speaking of inaccuracies, the biographical line following Dr. Sowell's essay identifies him as "a senior fellow at the Hoover Institute." That should be "Hoover Institution."

45 caliber continuing
It is my understanding that the language of the majority says that Ricci was discriminated against because he is white. That shouldn't have anything to do with the court's decision, which should be based on established precedent. The court has no right to consider whether or not the precedent is bad law or not, they are obligated to render decisions on the law, not on their own political bias about whether the law is good or bad.

And who are you calling lazy? Donald Rumsfeld did this country a great service when he articulated the "knowns" and the "known unknowns" and the "unknown unknowns." Conservatives should take his lecture to heart and use it to recognize when they are talking out of their hats. I submit you have no knowledge, personal or borrowed, about whether Sotomayor is lazy or not, so you should quit passing yourself off as possessing knowledge that you do not have.

I Programmed a Test

I programmed a test that was used in 17 Universities World wide.

The test was a 'Spatial Relationship Test'.

The object of the test was to determine who would potentially best suited to be a Fighter Pilot.

The test revolved around picking geometric objects out of clusters of geometric objects and the speed and accuracy of the choice.

Hundreds of different images of Airplanes from various Countries were also flashed on a screen and the Enter key on the computer keyboard was the 'Kill Key', these were randomly mixed in with the Geometric object tests.

The candidates selected by this test, had an extremely high rate of success in graduating from Fighter flight schools.

The test knew absolutely nothing about the candidates gender or race etc.

Randomly drawn numbers before the test, identified who the candidates were after the test results were posted.

Was this a biased test?

Yes it was biased, biased towards any candidate who had exceptionally quick reaction times and superior hand eye coordination.

FWIW, I wrote the software and I scored miserably.

Selecting those candidates by using quotas or affirmative action, would have resulted in many deaths of pilots and innocent people.

A serious question
Setting aside all of the touchy-feely arguments for a moment, someone please explain to me (and this is a serious question, no sarcasm intended) -

How can a test of one's knowledge of the science of firefighting be racially biased?

Serious replies only, please.

45 caliber
You are the victim of conservative propaganda. So, let me take a short discussion about how that comes about. The term PC hasn't been part of the popular language for very long now. At some point during, I think, the last 20 years someone in a think tank or perhaps Grover Norquist himself, got this bright idea about claiming that certain opinion or beliefs were "politically correct," and put out the whole theory for conservative consumption. Conservatives gobbled the theory up and every conservative now has that as part of his artillery. It is, 45, a conversation stopper.

Hey libs--
I have read on several occasions that sotomayor is a member of la raza (racist group). So I will say that of me being of Skandinavian and Russian ancestry, that any Viking would make better decisions that a latina woman.

B.N. Svara

Proud Liberal
Nobody except the people who devised it and took it have seen the test, apparently. However, the company that devised it limited the questions to those that specifically referred to firefighting. Furthermore, the firefighter's union defined the parameters of the test.

Many liberals, not including yourself, simply assume that the test is biased, whether by design or not. I assume that it is not.

Proud Liberal Question?

What elements of any test would you consider to be racially biased?

Proud Liberal...
Martin Luther king, Jr. was a registered Republican.

GW

Proud liberal ?????????
Skin color only matters, if you want it to matter, Martin Luther King was talking about something much deeper than you can comprehend obviously, and it seem as though YOU want it to Matter, Most of us conseratives do not think as you wish them to think, but I can tell you this, you think like a racist would think. the democratic party talks about this sh-t to pretend to care, only in order to gain power If you had no race to hang your hat on, there would be NO democratic party. FACT!!!!!

Robert
What makes you think I have a clue about whether the test was biased, etc.? I've never seen the test.

I submit to you that most conservatives on this thread are as ignorant as I was about this before I started reading about it, and that most of us, liberal and conservative alike, are passing along arguments from our favorite columnists - except some of us are pretending that we really know.

You are the first person I've seen talk about that second law, about trying to make the test unbiased.

Proud Lib - Reply to Robert
Where on earth did you get the idea that the conservative members of the Supreme Court felt sorry for Ricci? In fact, this is the first time I've even heard he was dislexic. Further, there were more than him in this challenge. They based their decision on the law that was written to make things EQUAL between all. It was obvious that the ones who failed the test didn't bother to study for it - so by penalizing the ones who did study, it certainly wan't equal.

Sotomayor didn't give a conservative decision - she did a lazy one. The conservative decision was made by the Supreme Court. A liberal decision would be to insist that the PC rules be followed. She did neither. Too many bad judges do just that.

As a Supreme Court Justice she cannot be lazy. She must know what she is doing and must at least know how to find out what the law she is ruling on really is. She must be willing to look at it and willing to study the uses of that law since she will almost always be ruling on laws and not on cases. So far, from what I've seen and heard, she fails at all of this. Your arguments are meaningless tripe.

Attorneys Rate Sotomayor As Abusive

Not only is Soto a full blown racist, she's abusive to boot!

Just what we need on the SCOTUS

Proud Liberal
No laws were changed. The interpretation of the was disagreed upon.

You are reaching.

chaka zulu's heroes
You have a lot in common with Anatole France. For example, were you aware his brain was only 2/3 the normal human size? Really. See Ross, Philip E., "Half-Brained Schemes," Scientific American (2006). :o)

I'd like to see the precious witticisms you'd come up with if you were on the receiving end of "inequality before the law," e.g., slavery, genocide, etc. You're welcome to go to the Muslim world and try it out by attempting to build a church or synagogue, or preaching atheism. They'll gladly dish out all the inequality you could wish for.

Proud Liberal
You did an excellent job of defending the decision. Unfortunately for your argument, the Supreme Court did not agree. You state that the lower decision was strictly in accord with the law-- this is only partially correct. The law said that if a test produced disparate results, it must be considered racist. On the other hand, another law said that if the test was devised to be obviously non-biased, the test results must be accepted. There were two laws that were in contradiction. One law or the other had to be broken.

Do you think that the test was unfair or the test results biased? That would be an even harder point to defend.

As a Mechanical Engineer
I deal with companies, with contractors, with employers and employees, and so on daily. I even talk with the janitor.

When someone comes up for promotion, the first thing I must look for is someone who can do the job - and do it well. Congress is a good example of what happens when you promote someone to a level he isn't qualified to handle. Everything fails. The higher a person goes in an organization, even a volunteer one, the better he/she has to be.

As a result, when I must find someone for a job sex, race, orientation, and anything else that does not contribute to the ability to do that job goes out the window. It is meaningless. Only the qualifications for that position are important. If I intend to get the best person to handle that, I cannot select someone just because he fits some PC reasoning.

Nor would you like for me to pick a person for that reason. For instance, would you want someone who knows nothing of how to design a car engine, design the one for the car you buy? Of course not! You would want it designed by the best person who can do the job. By the same token, do you want a person selected because of his race or sex be the one to defend you in court from a murder charge? Again, you wouldn't care what he was as long as he was the best at getting you cleared of the charge.

So don't expect me to agree that race or sex or any other non-essential thing is required for things like Supreme Court Justices.

Sotomayor's Grade Depends On Persuasion
Sonia scored a "D" if you are Liberal but
she scored an "F" if you are Conservative.
Either way, forget about BO's SCOTUS pick.

Liberals a Question?

Is there a better way to stop discrimination, than to stop discriminating?

Robert
I defended it for you yesterday, but here goes. First, I did read this line of argument someplace, but I think it makes sense.

First, again: Conservatives always say that emotion and empathy shouldn't have any place in rendering an opinion; that a judge should render and opinion based solely on the law.

Yet, the first argument from the lips of those who wanted to overturn Sotomayor's panel was based on empathy and emotion, to wit: Ricci has dyslexia, he worked really hard to learn to pass the test and hired someone to tutor him, he is white and also he is really, really a nice guy. And this was basically the argument of the five conservatives on the supreme court: they felt sorry for Ricci.

On the law side of things, the article I saw said that Sotomayor's panel did the CONSERVATIVE thing by not overturning the one original judge's ruling. Apparently, and I saw this in a different article, the Sotomayor panel relied on stare decis, i.e., settled law and precedent in regard to (what is it?) chapter VII of some civil rights legislation.

These authors pointed out that the majority conservative members actually CHANGED THE LAW (which some people, I can't remember who call JUDICIAL ACTIVISM).

Robert, I hope this works for you.

Proud Liberal:
You wrote: "If someone, for instance, wants to speak Spanish while living and working in America, the ideal is that we accept that and don't insist that someone learn or speak English."

You are partly right. I don't care what language he wants to speak to work here - but someone will have to be able to talk with him sooner or later. They must be able to tell him what they want or what to do. If he speaks ONLY Spanish, then someone who knows that language must be the one to tell him.

So, tell me. Are you advocating that ONLY multi-lingal people who speak English and Spanish can be supervisors - or customers? What if the person chooses to speak Italian or Chinese? Then you'd need someone who can speak those languages too. What if the Spanish guy meets the Chinese one? Who would translate for them if both insists on speaking only their own languages? Why shouldn't I, who was born and grew up here and taught only English in school, expect that if I need to interact with them that they should be able to speak English rather than me going back to school to learn a dozen (or hundred) other languages? Why should the majority learn another language so a minority group doesn't have to?

The rest of your arguments are just as idiotic. Go back to Huffinton Post where people will agree with you.

Robert

Simple Solution to Government

Racism is a crude form of 'Collectivism' that ascribes moral, social or political significance to the internal body chemistry of an individual.

Racism demands that a man should be judged not by his own judgment, actions and decisions but by a 'Collective' of his ancestors or others in his 'Collective', whatever that might be.

Man is distinguished from all other life by his ability to use facts, logic and reason to make decisions and determine what action he should take.

Should every American Citizen have the same rights and protections under the US Constitution and Bill of Rights - no more - no less?

The obvious answer is yes - the Liberal answer is NO.

Liberals maintain that certain 'Collectives' should have 'Special Rights' to make them equal - that is racism and inequality in its purest form

Racism and inequality will only be defeated, when all are equal and preferences and special rights are set aside.

Simple Solution: Every American Citizen have the same rights and protections under the US Constitution and Bill of Rights - no more - no less.

Sotomayor Gets "F" on Supreme Court Test
Rather than "D", as previously reported, Sotomayor only scored 33.3 out of 100, which makes her ineligible for any position, anywhere in the world. Sorry for the previous mistake.

Obama the Coward

"Pam Sutherland ... of ... Illinois Planned Parenthood ... told ABC News, "We worked with him specifically on his strategy. The Republicans were in control of the Illinois Senate at the time. They loved to hold votes on 'partial birth' and 'born alive.' They put these bills out all the time because they wanted to pigeonhole Democrats. ..."

"Let me interpret. We, Planned Parenthood, told him what to say, and how to say it, so we could continue to kill infants; babies, just a few inches from birth, and those completely out of the womb that we missed! Our "colored minister" was well prepared by Planned Parenthood.

Partial Birth abortion -- which I will not describe here -- but know that 80% of Americans don't want this barbaric act practiced in this country – Barack Obama voted to keep legal!

The Born Alive Victims Act is a law to protect a child that was born alive after a botched abortion; a law that would require that the child would receive medical assistance.

Barack Obama voted against it! Yes. Barack Obama, with an "engaging personality" is being used by the leading abortion provider in the United States to promote and execute infanticide of predominately minority babies!"

Sotomayor Gets "D" on Supreme Court Test
Grading for Sonia's ability to be a Supreme Court justice should largely be based on her ability to pass the SCOTUS test. The facts are she only received a grade of 66.6 out of 100 which is a miserable grade for such an important position. Sorry, Sonia, but you just would not cut it as a U.S. Supreme; however, take heart, 66 is a Satisfactory grade in Saudi Arabia, according to Wikipedia.

"If someone, for instance, wants to speak Spanish while living and working in America, the ideal is that we accept that and don't insist that someone learn or speak English." Sure thing. Let 'em. But if they're going to work for my brothers' construction companies, they have to speak English, French, or German because my brothers only speak English, French, or German. And you know what you call an English speaking Mexican construction worker? Boss.

My family had to learn English to make it in America as anything except grunt labor. So should everyone else.

Proud Lib
Stop digging. You are what you are son. Trouble is, you have no idea what those of us with our eyes open can plainly see about you.

No matter what kind of logic you use, at the end of the day you are still trying to defend someone who is comfortable, even proud, to make the 'latina' and 'policy' statements.

Those kind of statements have no place in the SCOTUS or in a post civil rights society.

So again, stop digging. Start listening. There still may be hope for you. Then again....

As for folks speaking Spanish.(Where the hell did that come from?) You have that all wrong too. I don't care. People only have to speak English if they want me to understand them and vis versa.

And for the third time this post, put the shovel down.

We Need a Statesman instead of a Punk

When the only tool one has is a hammer, all problems begins to look like a nail.

Every success Barack Obama has 'Achieved', every problem Barack Obama has 'Solved', every 'Need' Barack Obama has met, has been accomplished with a 'Toothy Smile' and his 'Ability' with words.

Why would any thinking person believe, that Barack Obama will approach the 'Problems' facing America and the world in any other manner?

Barack Obama is clearly not a 'critical Thinker', nor does he take 'Actions' based on facts, logic and reason.

Any human faced with emergency situations, will instinctively resort to what has worked for them in the past or the basics that has so far made them successful.

An example, when a boxer is hurt in the ring, they will immediately go back to the basics of boxing and depend on their many hours of repetitive training to 'Weather the Storm'.

Barack Obama has NO personal values that were forged in the 'Crucible' of a traditional or functional family, but rather methods to try and find a way or the means of survival in dysfunction.

America has become a Nation of 'Dysfunctional Families' and Barack Obama's struggles are appealing to the many millions of Americans who have suffered through or are in the same dysfunction.

The words 'Hope and Change', are really the 'Mein Kampf' or 'My Struggle' of Barack Obama to find a purpose and meaning, in and for his life.

Proud Lib
"Skin color does matter."

Does it? If I'm interviewing people for a job. Should the color of their skin make any difference? If I'm considering who to promote, should the color of their skin make any difference? The answer in both case is, of course, no. They should be judged on their qualifications. Yet, you seem to think otherwise.

If equality is your goal, you have to be prepared to accept it when you get it.

Proud Liberal
Just for fun, defend Sotomayor's decision in the Ricci case. Bet you can't.

ANNE
You are so right, like 100% right. if Obama were to come out and say the sky is green then by God the Demonuts would say that's right the sky is green, and then they would want to change the word, blue to green with an amendment and a new policy stateing that we no longer can use the word blue because it's green.

Eugene
Skin color does matter. I'm white, but when I see someone with a dark skin I can see that dark skin and I know they have a dark skin color. I think conservatives ask us to pretend that there are no visible differences in people. That is certainly disrespectful of individuals. This is like meeting Michael Jordan and pretending that he's no better at basketball than anyone else you might pick off a street corner.

Martin Luther King may have made a statement about judging people by the content of their character rather than by the color of their skin, but I think he did a disservice to his people, who have had a different experience in America than white people.

I think we need to acknowledge the differences between people. Ideally we might get to the point - and I'm sure many conservatives are already there - that those differences are accepted and won't be judged as right or wrong or better or worse. If someone, for instance, wants to speak Spanish while living and working in America, the ideal is that we accept that and don't insist that someone learn or speak English.

So, do you have someone else in mind who has any chance of being nominated? Do you imagine that some coalition of your beloved Republicans and a few moderate Democrats will stonewall until the President caves in and gives you Miguel Estrada or Alberto Gonzalez?

Professor Sowell has now written eight columns about this, and most of you are still cheering wildly. For what? A Supreme Court reduced by attrition to four or five justices until your goddess Sarah Palin can put four or five new reactionaries on the Court all at once?

Are you nutty enough to think your countrymen would go along with that?

We've had affirmative action for forty years now. When does it end? I was in civil service for thirteen years and watched every promotion I went for, was on the top of the list for, had the best scores for, and had great work evaluations for go to a less qualified Black applicant. It was ironic to see jobs going to the daughter of a Black dentist when my father was just a merchant seaman. The main result of AA has been to create a sense of bitter resentment in white people who would otherwise by enthusiastically in favor of color-blind job hiring and promotion. It also makes us all question the validity of ANY Black person who is hired and promoted. Can this person really do the job, or is he just a quota figure? AA has been the worst thing that happened to the Black community, creating justified resentment and a sense of injustice where none existed.

Eugene
I think I may be repeating myself from the other day, but the point is still good: Think about how the Constitution might have been written if in addition to all the white men who did write it if women, common men and racial and ethnic (and for all I know religious) minorities had been part of the process of writing a constitution for the United States.
That's one point for a conservative to consider.

Secondly, Dennis Prager - who I do think is an idiot, by the way - but Dennis goes on and on about how different men and women are; which, if Prager were as logical as he thinks he is, would argue that any woman on the supreme court would bring a difference to the court.

Thirdly, the five conservative members of the court are always referred to as conservative. Now, being a conservative is not the same thing as being neutral or being a cipher. Conservatism is a philosophy which has bias. It's a ridiculous idea to say that a judge merely processes the applicable law. If what conservatives say is true about the roll of judges we wouldn't need anyone with years of legal background; we could train someone fresh from junior college in about six months to process the law.

Liberius 2009
Liberius 2009, what do they have in common Obama, Rahm Emanual, Axelrod, Soros, Alinsky, Barney, Is it that they are all GAY? Is it that they have No Birth Certificates?, Is it that they all wealthy liar's, I give up!!!!!!!

On trial - Equality before the Law
Thomas Sowell reminds us of a time when a person could not get certain jobs because of race, gender , class standing, ethnicity, regardless of how well educated and qualified. This was because the system was rigged in favor of white middle class males. His solution is “equality before the law” without additional help (e.g. affirmative action) for minority groups. His suggestion would still rig the system against minority groups. What is the value of “equality before the law?” The 19th century literary figure Anatole France stated, “Equality before the law, in all its majesty, forbids both the rich and poor from sleeping under the bridge, begging in the street, or stealing bread.” Chaka Z.

Ugly Solomayor not 1st Spn SC judge
Benjamin Nathan Cardozo, a descendant of Spanish Sephardic Jews, was appointed by Herbert Hoover in 1932.

Cardozo was born in New York City in 1870, attended Columbia, was a Sup. Ct. Justice in New York State, a member of the district appellant court, and then became as associate justice on the US Sup. Ct. and served 6 years.

Maybe because he wasn't appointed by a Dimowit the libs. have taken away his heritage which extends back to Spanish explorers before the N. Am. cont. was settled by the English and N. Europeans.

Ergo, there is now NO REASON for Sotomayor at all.

Addendum: Title VII prohibits workplace discrimination and harassment of then blacks and women and WHITES, and also protects people by their religion and national origins, but not (thank heavens) sexual *orientation* (that always sounds to me like people who are not sure where the sun rises or sets).

Who could construe the Ricci decision to be opposed to Title VII, when Ricci is actually protecting workplace non-discrimination. White people (and TWO HIDPANICS included in Ricci) are also specifically protected from maltreatment under Title VII. ???

Sotomayor's mama is so ugly when she calls their bulldog to come in, he has to back into the house.

Right on, Dr.Sowell
Ms.Sotomayor's qualifications for appointment to the Supreme Court of the United States, thru the viewpoint of the party now in power, seems to begin and end with the fact that she is an Hispanic female who will predictably and undeviatingly vote the left-wing party agenda, come what may. From the Obama administration's standpoint, it's a 'win-win' situation: gain 'brownie points' with the Hispanic voting bloc, and seat someone who will 'rubberstamp' whatever leftwing program that rolls off the assembly line. This nominee's 'reversal rate' by 'cooler heads' above her in the judicial process is atrocious. If she is elevated to the Supreme Court there will be NO human agency to reign her in!

In Re mistermilo
I used to live in Calhoun, Georgia a few years ago an can attest to what mistermilo says. Georgians are some of the nicest people you would care to meet. They love this country and support the Constitution.

The drift of stupidity
Leaders who lean toward socialism aren't smart they are simply able to capture the misguided voters pipe dreams. They don't lead , they cajole and pander. They require a mandate because they think majorities trump truth. IF the nation doesn't get fed up in the four years of Obamaism it won't be long before comrade is the greeting of the day.

I beg to differ with you when you say Obama is not a salesman. He sold the American people a bill of goods during his campaign, when he told us that we needed a new breed of government. Most all the people he has appointed worked under the Clinton administration. He sold the American people a bill of goods when he told us there would be no gun control. Try buying ammunition. There will be a bill voted on next week that limits the amount of ammunition you can buy, to 50 rounds at a time. That's a deal he and Diane Feinstein made, while he paid her a visit in California. You'll have to be fingerprinted for that and sign your name and address. It will also be against the law to share your ammunition with family or friends, and if you're caught doing that, you can be arrested. But he sold Americans on no gun control. He sold the American people on a National Health Care project that will cost the American taxpayer over a trillion dollars. 40 million people are now uninsured. When all is said and done, only 4 million more will be insured. At that cost, I'd say he did a pretty good job of selling. If that's not enough, the people that buy into this are going to be taxed for this health care as taxable income. And there are still people that think he's the Second Coming! If that isn't salesmanship, I'd like to know what it is!

Thank you for your post. I have been trying to get the same point across myself. Obama is not a simpleton, nor is he a puppet; he is one of the architects of the socialist takeover going on. Underestimating Obama would be a terrible mistake.

Rather than...
... the first Hispanic woman on the Supreme Court, I'd prefer the first African-American woman: Janice Rogers Brown.

Folks re:killer
I am a transplanted yankee. My job took me to the south and I stayed when I retired. I feel compelled by the absolute inanity of the blogger named Killer to post a few facts here.

He does not represent most Georgians. He has fewer brain cells. The folks I have met here in the past 14 years, by and large, are the friendliest I have met in years. I am an older man and every day I see the warmth and good intentions of people here that used to exist in MA,NY and NJ, (all previous residences for me), up until about the 90s.

I live in Cobb County-- a mostly conservative county. My Representative has an outstanding voting record on conservative issues. So too, do most Georgia elected officials. I am sad to say that our black elected officials vote on all issues in favor of illegal immigrants and their causes at the extreme expense of our young black citizens who have an extremely high unemployment rate largely due to the aforementioned aliens.

Killer -- to you I say "au contraire" and. no, that is not Spanish for how I want my steak cooked.

Jay wrong on all counts
So who's silent? Title VII (at least as the Dims interpret it) is unconstitutional because it obviously violates the equal protection and due process guarantees in the Constitution. That's not "judicial activism," it's properly applying the Constitution and upholding individual rights recognized therein. Try reading the Fifth and Fourteenth Amendments. No statute (such as Title VII) can amend the Constitution. When there is a conflict, the Constitution controls.

Judicial activism occurs when judges declare their personal policy preferences (e.g., abortion, eminent domain, gun control, "affirmative action," i.e., racism) to be Constitutionally mandated even though they are either nowhere mentioned in the Constitution or even expressly outlawed by the Constitution.

Hurricane Hussein
The winds of change are blowing with gale force. With a comedian's vote now making up a clean 60, I have confidence that the damage about to be done in the next 1.5 years will culminate in one of two senarios.
A. A clean sweep of the bums from the House and Senate, rendering the lame POTUS into an even lamer duck.
B. Civil war when the fairness doctrine attempts to limit dissent, the newly created "brown shirt" force begins to clash with real patriots still in uniform and those who "retired."
Meanwhile, the world watches to see if the U.S. will crumble like the Berlin Wall did. The vultures are circling. Would other countries come to Obama's "aid" to reinstate him like the despot is about to be reinstated in Honduras? Truly amazing times.

Baron...
I agree. Let me add that if need be, this Congress would willingly fall on their own collective swords to protect Obama if need be.

I think with the Porkulous and Cap and Tax some of them already have.

COLEMAN vs FRANKENSTEIN
Coleman was a moderate Republican in a liberal welfare state (Minnesota)whose voters are for the most part, the progeny of brain washed remnants of the FDR, WPA, CCC, era whose own generation X progressives were educated for the most part by MTV. It is a surprise to me that Coleman survived as long as he did. In a normal election year the repubs would not have wasted their time trying to bail water for him but then this was not a normal election year and they did not want to lose the power to exercise the ability to "Filibuster" without that ability being broken by a vote of cloture, requiring 60 votes. It is a joke that a state which elected Jesse Ventura for a governor would now want their interests represented by a bankrupt comedian better known as Stuart Smalley on SNL. Normally I could care less how idiotic the Minnesotans want to appear to the rest of the country but when they begin to let their political "claptrap" poison the rest of the Republic, it is time for the conservatives to clean house and that includes closet moderates like McCain and the seven republican dupes that voted with the Liberal majority to impose the largest tax on the American people in the history of this country; "Cap and Trade"
What a stench.
XPRESS

To all my conservative brothers
Be careful talking about Obama being a puppet, I suggest that, congress is his cover, he will be able to blame congress for the first two yrs in office,(saying congress was pushing all this crap). In the 2010 election the republicans will make BIG gains in the house and senate. Then in the 2012 election he will again Blame congress for not being able to get things done. So I suggest that we understand that Obama IS the Marxist that we think he IS, Obama IS the one calling the shots, Obama IS the one that is the racist we think he IS, Obama IS the Muslim we think he IS, Obama does think America IS evil, Obama's goal IS to destroy the Constitution, Obama IS narcissistic, Obama IS Acorn , Obama does think that all social program should go to Blacks and IS the one pushing this, Obama IS dyeing his hair, Obama IS a girly MAN, Obama IS the con-man we think he IS..........

Well it seems that Proud L got the memo.
To bash Alito and find other straw dogs to deflect the fact the Sister Sonya is not only a racist but also confirmed on video what we have know for years. That lib judges do believe it is their duty to make policy from the bench. Not follow the constitution.

Hey Proud lib. Try as you might, you can't undo what we already know. At this moment Sister Sonya may in fact be walking on water while Alito is out cheating on his wife.

That still wouldn't make her qualified.

Unless of your course you believe the SCOTUS is a place for a racist who ignores the constitution.

If that's the case, how proud are you now?

Twelve pound pork shoulder (bone in) and two full racks of baby backs going through the dry rub and into the smoker Friday morning at 8 AM.

I'll mop it with the mop sauce (5 parts water, 3 parts pork stock,1/2 part vinegar, and 1 park BBQ sauce) every hour on the hour for 8-10 hours.

I'll put my home-made sauce on the ribs and brown over direct heat at the last minute.

Only after the shoulder rests for about an hour to cool will I hand pull the meat.

I only sauce the pulled pork at presentation to the diner.

Big pot of BBQ beans (with a cup or two of the pulled pork added), a pot of Brunswicks Stew (made with the pulled pork and the smoked chicken), and a little potato salad.

I plan to combine the above with copious qauntities of ice-cold beer while my guests and I watch a couple of guys who visited Alabama last week set off exposives.

Geez, what a country!

HA ah ha ha!!!! I love it!! Thanks for the giggle.

Alito is at least 0-4 with Supremes
And was roundly taken to task by that retired woman judge. Won't somebody tell Sowell that Alito is 0-4? Or are we trying to protect Sowell's feelings?

Also his logic, as usual, is highly suspect. Cases which go to the supreme court and are heard by the supreme court are those in which one side feels there is a constitutional problem; thus cases which go to the supreme court as a select group.

It's like that doctor who was once investigated because so many of his patients died. It was found out that he was so good a doctor that he was regarded as the last resort by people who were regarded as terminal.

Sowell apparently isn't astute enough to understand the selection issue.

Judith's beatdown on Killer...

Thanks, Dr. Sowell
In one of the cases the Supreme Court upheld, they nevertheless criticized her reasoning. So, one could say she is 1 for 6 at the big bench.

Good points about racism. The solution to racism isn't more racism; the solution to racism is fairness.

Barack Obama's dependence on TOTUS the Teleprompter will begin to cause really serious problems. Pardon my coarseness in this jovial approach I took to illustrate his dependence on TOTUS.
-----------------------

Barack Obama enters his White House restroom.

TOTUS: Approach the Urinal and begin peeing.

TOTUS: Unzip pants.

TOTUS: Shake it.

TOTUS: Zip pants.

White House Secret Service Agent: We have a problem. We need an emergency mop up in the Presidents restroom and some fresh pants and underwear for him.

Who has been 'Messing' with TOTUS?

Repbulican Hypocrites
Republicans are hypocrites. The Conservative Right on the Supreme Court engaged in JUDICIAL ACTIVISM by changing TITLE VII in Ricci. Yet, you hypocrites remain silent.

"Barack Obama does NOT possess the intellect of a Lenin or Marx, but does have’Cunning’ that substitutes for intellect in his case."

I agree with you 100% but have a different idea. I think he is a puppet and the socialist wing of the democratic party is pulling the strings. What you call "cunnning" is double-talk. While he is waiting for his handlers to tell him what to do, he lays on the BS. He needs the mystical teleprompter to tell him what his own positions are. He's a fraud and a slick mouthpiece. Saying alot of nothing while his backers call the shots is his only talent.

Barack Obama a Cunning Narcissist

Barack Obama displays the same characteristics of all Despotic leaders before him, malignant narcissism, total self absorption, lack of empathy for anyone but himself, aggressiveness towards anyone who questions him or opposes his views and a dependence on words rather than real solutions.

Barack Obama does NOT possess the intellect of a Lenin or Marx, but does have’Cunning’ that substitutes for intellect in his case.

Barack Obama has shown a long history in using 'Passive' rather than 'Active' aggression to accomplish his hidden agenda. From Obama's 127 votes of ‘Present’, which reflected his disproval of the issues, he was supposedly voting on, to his refusal to allow the Illinois BAIPA to leave his committee.

Obama has repeatedly shown his bias against ‘Success’ and his intentions of investing in failure.

Obama is personally ashamed of America and spends a great deal of time and energy apologizing for America rather than sing its praises.

Bowing to a King who represents Islam Jihad, was only a sub-conscious reflex of his personal inner feelings, as was the labeling of those who believe in the Bible and personal defense, whom he described as ‘Bitter Clingers’.

Barack Obama knew the implications of the Sotomayor nomination and chose her because 'Fairness' in employment and 'Racial Harmony' is NOT part of his agenda.

Joining a Church that taught and preached 'God Damn America', that taught and preached 'Black Separatism', having his wedding performed there, his children baptized there, choosing that Pastor as his 'Personal Mentor' and 'spiritual guide' and sounding board - belies any attempt with words to conceal his true feelings.

In reality, every action and decision Barack Obama makes is all about Barack Obama, his undisclosed personal agenda and his desire and need to punish those who oppose him or his agenda or even his thoughts.

Sotomayor vs Madison
Compare what Sotomayor said about the second amendment with what James Madison, who was directly involved in the drafting of the Constitution and Bill of Rights, said about the right of citizens to be armed: “Besides the advantage of being armed, which the Americans possess over the people of almost every other nation, the existence of subordinate governments, to which the people are attached,… forms a barrier against the enterprises of (government) ambition…” He further states, “That the people and the States should elect an uninterupted succession of men ready to betray both… To these would be opposed a militia amounting to near half a million of CITIZENS with arms in their hands…” Madison made these remarks in Federalist 46 advocating ratification of our Constitution (and before the later added Bill of Rights). The Constitution provided no enumerated power to restrain this fundamental right. Protecting this right of the CITIZEN was so important that the second amendment was created to make it explicit. Sotomayor views directly conflict with those who wrote the Constitution and first 10 amendments. She is not qualified to serve.

Georgetwin:
I heard when she was younger, she made extra money by getting paid to haunt houses.

the racism of lower expections
One of the biggest problems in education today which also extends to jobs/employment is the racism associated with lower expectations.
There is a not-so-subtil condescension that liberals use when they set a standard of "empathy" rather than keen legal acumen. "She's a Latina. She's not expected to have the same intellectual capabilities. Empathy is good enough."
The message sent is: "You're not good enough but it's not your fault your a ________ (fill in the monority). We'll give you the job anyway"
This was also seen in the Firefighters' SC decision. A fair testing procedure was implemented. Why did not one Black pass it? Did they study? Did they expect the promotions without having to study? Why? Why did they not WANT to be the best? Where is their pride in their profession? It is a profession where the lives of coworkers and the community are at stake!! Has this pride now been stripped from the Black Community?
If this is truly the case, shame on the liberals. Shame. Shame. The true message of the liberals has become "No, you can't so we won't expect it." A waste of potential is the real tragedy. I guess the liberals don't think that real potential exists in minority communities.
I do.

Sotomayor qualifications.
Sotomayor thinks that the experinces of a "latina woman' would give her the ablility to render better decisions than a white "male". I would also say that her not being a spouse or wife and mother narrows her field of experience. As Thomas Sowell says, being wrong on 66.6% of your descisions reviewed by the Supreme Court should cause a moral person to have their nomination withdrawn.

Unoriginal Libs:
I've noticed that the talking points have been distributed to the fellatious followers of The One. Why is it that these weak minded, mental midgets post the SAME info, with no attempt to hide the fact that they are spouting the same, tired, inaccurate info. Only a liberal can justify to themselves WHY they support an open racist. She, from her statements, is under the impression that white folks aren't worth squat. From her statements & her actions in her career, I'm of the opinion that she will get even with the "evil whitey" at all costs. Just like the clown who nominated her.

Empathy and all that other horse
hockey. I just read an article about a man who was declared innocent of killing a woman 17 years ago. (Darned if I can find it now). Anyway, the sperm they recovered from her body was not a DNA match for this man who was incarcerated with the excuse that she could have had consensual sex with someone else. This guy eventually went before a board of high judges (of which Sotomayer was one) and he was not exonerated. Too bad he wasn't Hispanic...Sotomayer might have voted differently. So they finally got evidence that another guy raped and killed her, the DNA matched and he also confessed. This cannot erase the 17 years this fellow spent in prison but there you go...Sotomayer reserves her big heart, mind and body for those who are of her descent. Yet another one of the god Obama chooses that I'd like to strangle.

What troubles me is the fact that the Supreme Court was not unanimous in it's recent decision. We still have four ultra liberals (including Sutter) on the court who believe that racial preference is okay despite the speeches of MLK and our Constitution.
Maybe MLK did'nt matter!! Why do we have streets named after him? Was he really a great man with a valid message?
Can the libs answer the questions?

Face it people the house and senate is full lemmings, whatever the master wants he gets. You will have a few repubs with guts enough to vote against her.I bet that even that so called conservative Orrin Hatch will vote for her.

And as I have to leave
Here’s some toll fodder to nosh on:

No one has mentioned that Sotomayor is ugly.

If she were Rep., by now, the entire feminist press would be hysterical over Sotomayor’s dumpy weight, her dowdy clothes, her Brillo-pad hair, let alone her mug.

I can see if she were a J Lo or Semal Hayek or Eva Menendez, but hey, remember when Katherine Harris was called a raccoon for her makeup during the FL 2000 *recount,* Paula Jones was labeled trailer trash after she accused Bubba of harassment, and Palin was just called a slutty by that esteemed feminist Dave Letterman?

How come no one mentions Sotomayor looks like a mud puddle someone just stepped in?

Oh, because she’s a liberal surrounded by liberal cloaking devices. Hers must come from the Klingons.

Ciao, all

Gosh killer !
Who would have thought that you have 2 cells to rub together in your head. You just dazzle me.

bwahahahahahaha....
Democrat with a conscience? That is rich! Democrats have only feelings!

SFA1973-RGeek-13Bravo-Others
Let me get this straight. Tolerant, Anti-Racism, Diversity Sensitive, Liberals think Rosa Rotorooter should be on SCOTUS despite the fact that her decisions are routinely overturned, that she has made NUMEROUS racist statements and her BIGGEST qualification is SENIOITY?!?!? Then Dr. Sowell says that QUALITY not QUANTITY should be the Deciding Factor in a SCOTUS appointment and RIGHT AWAY 2 Liberal Cowards (TrollDumba$$2008 and Moronio) heap racist slurs on Dr. Sowell!?!?!?! AGAIN we see prime examples of Cherished Liberal Values: Lying, Cheating, Cowardice and Racism.

She Is A Racist And Unqualified

'Nuff said.

The Housing Boom and Bust
was excellent. Everyone should consider it a duty to read it and buy copies to pass around to their numbskull neighbors and friends at 4th of July get-togethers.

Sowrongmayor
Nominations like hers just divides America. Any Democrat with a conscience should reject her nomination

She is not qualified.
She lacks basic understanding of the law. Her feelings come first.

Sotamayor/Alito
The Supreme Court only hears cases that have been disputed in the lower courts. Sam Alito only had two, and Sotamayor had six. Both of Alito's were overturned, according to those posting and double that amount have been overturned that Sotamayor had decided on.

Since the court that Sotamayor rules in was subjected to three times the disputed cases that Alito was speaks well of the Alito court in that they made the correct decisions in the minds of those in the lower courts, since they did not carry their disputes to the higher court.

The whole thing we should be questioning here is whether there are better, more qualified candidates out there for the job. It doesn't matter who the candidate is, someone will find fault with them. Example Robert Bork, a fine jurist and a potentially good Justice of the Supreme court was forced to withdraw because of the blackballing by the senate.

Why any good candidate would consent to having his or her character tarnished by a bunch of incompitent fools in the senate is beyond me, but they keep on doing it, and it seems that the liberals are the ones who don't mind being called scum by the senators. I guess that's because they are scum.

Now 4 of 4?
"Sam Alito had a 100% reversal rate with 4 out of 4 with Appeal Court cases he was involved in presented to the SCOTUS."

You know how you know liberals ALWAYS lie? They can't even get their alleged "facts" straight.

First it was "2 of 2", now it's "4 of 4". By tomorrow it will be "1234431 of 1234431".

sataniclib LIES YET AGAIN!
Tell me, you worthless lying sack of America-hating FILTH, just how could SCOTUS overturn 100% of Alito's decisions when they didn't even hear 5% of those appealed decisions to begin with?

Why is it that liberals hate the truth so much?

American Patriot
Sotomayor is a racist pure and simple. Obama wants someone with "empathy". He picked her.

All the rest of your babble is smoke and mirrors.

In Obama's first book he laughed at a woman of mixed race who said that she doesn't consider herself anything but a person. She is color-blind. He thought she was ridiculou. He never denounced the stance that he believes blacks do not want to assimilate into the white culture.

Read his book "Audacity of Hope" I look forward to your view of Obama after that experience.

Wait until a Sup. Ct. with Sotomayor addresses new Oklahoma laws:

OK passed, 37 to 9, with a few liberals in the mix, an amendment to place the 10 Commandments on the front entrance to the state capitol. The feds in D.C., along with the ACLU, said it would be a mistake. Hey this is a conservative state, based on Christian values.

It recently passed a law in the state to incarcerate all illegal immigrants, and ship them back to where they came from, unless they want to get a green card and become an American citizen. They all scattered.

It passed a law to include DNA samples from any and all illegals to the Oklahoma database, for criminal investigative purposes. Pelosi said it was unconstitutional.

Several weeks ago, OK passed a law, declaring Oklahoma as a Sovereign state, not under the Federal Government directives. That, for your information, makes Oklahoma and Texas the only states to do so.

More states are likely to follow. Louisiana, Alabama, Georgia, both Carolina's, Tennessee, Kentucky, Missouri, Arkansas, West Virginia, just to name a few. Should Mississippi act, so will Florida. Save your confederate bonds, it appears the South is about to rise up once again.

The federal government has made bold steps to take away our guns. Oklahoma passed a law confirming people in this state have the right to bear arms and transport them in their vehicles. I'm sure that was a set back for the Kennedys and Ms Pelosi. Sotomayor is anti Second Amend.

I can't imagine NJ ever passing one such law. So much for my state.

Bork Sotomayor. Bork Killer.

New Software
We bought some new software for our emails. You write what you think and all you have to do is (1X) put in all the democrats and republicans email addresses and this software sends it off on its own...dialing over and over.

There is going to be a blitz from this house leveled at all of them regarding Waxman_Markey and sweet little Sotomayer.

Judith
I can't write but you understood what I said? The only obligation a "Writer" has is to communicate with his/her readers. Your response qualifies me as a "Writer". Thanks! Also, its a Spanish phrase, not French. It was meant as a "Rub"! TO cause "Friction"...Dummy??

Empathy and understanding?
I could care less about empathy and understanding. A supreme court judge is suppose to come to a decision based on facts.

This is why we have Obama as our fearless leader...he has so much empathy and understanding that he just wants to kiss Iran's leader. If you take a good look at his decisions, you'll see that they line his pocket along with the other imbeciles in Washington and, as always, we get screwed.

Liberal Math
An error rate of less than 1%.......per some liberal dork.......
Reversed on 67% of decisions that were appealed to the supreme court.
67% = 1%.......makes sense to a liberal I guess.

I am sure the loons are here, since this article has nothing to do with anything economics or economy or finance....so the moonbats can tapdance around here with nary a need of a shred of evidence.....to support their bark chewing opinions.

At stake here is putting a person on the suprememe court that makes decisions based on womanly, gut instincts that "only a latino" woman can make.........That is bias, and based upon an SC rebuke of:
"an evident denial of the most elementary forms of procedural due process."
tells me that she believes that she knows best.....regardless.

One can only question how many more of her decisions would be overturned had they been appealed to the SC

Hey Killer,
could you start your killing with yourself?
Oh, sorry, how cruel of me. But the trut is often bitter (left unsaid).

Well then, at the very least, kill your absolutely mindless and sheerly stupid talk. Can you a**hole liberals ever comprehend how to properly use language? This is not "complaining", bonehead. This is protesting--protesting injustice, which includes protesting the likes of jerks like you.

Everybody with any brains and any ability to think for themselves knows that Sotomayor is utterly unqualified to be on the Supreme Court, and in fact she should be barred from practicing law at all for the rest of her unnatural life. She's utterly prejudiced, shallow, and incompetent.

I guess that's why you like her so much, brain-killer.

Reversals are in the eye of the beholder
High reversal rates are exactly what you would look for if you want to "change" the Supreme Court. If you happen to think the Supreme Court is wrong two thirds of the time, the nomination makes perfect sense. Most Americans will disagree, but that doesn't seem to matter much to the administration at this point.

Killer
Se La Vi????? Do you mean C'est la vie? You can't even write in English and you're trying to write in French?

Dr. Sowell
You are not a Lawyer! If you were, you would know, that the cases were not reversed on Law but on Procedure. Also, this is a Jurist, who has ruled on thousands of cases. According to the American Bar Association, Judge Sotomajor is in the top 10%. This Judge has an error rate of less than 1%. Welcome to the bench Judge Sotomajor. How many cases had Judge Thomas been reversed on? Too bad all this complaining won't have any affect. Se La Vi....

Once again Dr. Sowell gets it ...
and does a masterful job of explaining it. Everyone who reads Townhall needs to write their Senators and attach this article. They should then tell them their Senate seat is dependent on them voting NO on Judge Sotomayor. She is NOT fit to be a Supreme Court Justice. She does not dispense justice, but rather payback and biased social manipulation. As I have said previously, a judge is like an Umpire in a baseball game. The umpire's job is to call balls and stikes. They do not decide what the strike zone is. A referee in a football game does not decide what clipping is, what constitutes an illegal block in the back, roughing the passer, offsides, etc. They do call a penalty when someone breaks a rule. They do not decide what the rules are. Judge Sotomayor changes the rules by judicial fiat and that is not acceptable in the highest court in the land. Justice is supposed to be blind, but Sotomayor sees things in color. She is biased and that is unacceptable in a court of law.

Mark has a good idea . . .
Mark in Florida has a fantastic idea: give every candidate a number, and leave off the racial ethnicity, and let it be determined solely on qualifications. I don't look for the idea to be adopted, however, for it won't serve the Democrats purpose of tilting everything in their direction.

Bork Sotomayor
Judge Sonia Sotomayor is unfit to serve on the Supreme Court of the United States because she sees herself as a political activist first and a jurist second. In a speech in California in 2001 she disparaged white male judges, saying, "I would hope that a wise Latino woman with the richness of her experiences would more often than not reach a better conclusion (as a judge) than a white male who hasn't lived that life."

In a current case from the New Haven, Connecticut, fire department, Sotomayor has ruled from the appellant court that job applicants' loss of promotion after succeeding on a test designed to be race neutral was "thorough, thoughtful, and well reasoned," because no black applicant had achieved an acceptable score. That seventeen (17) "white" test takers had succeeded, including TWO (2) HISPANICS, the test was thrown out by the officials in New Haven and no promotions granted to anyone. Such activism shows Sotomayor is less interest in minority success than enforcing that success by any means FROM THE BENCH.

On the Second Amendment, Sotomayor is anti-gun as revealed in "the right to possess a gun is clearly not a fundamental right" (US v Sanchez-Villar, 2004). This opinion is exactly opposite of the recent US Court ruling supporting an earlier verdict in Washington,, DC, that affirmed the right to bear arms as fundamental as any rights enumerated in any other amendment in the Bill of Rights.

Sotomayor was only following her own philosophy that appellant courts are where "policy is made", which she claimed at Duke University in 2005.

This Obama nominee, as with many others, is out of step with Main Street America, out of step with Supreme Court rulings, and not qualified on her legal history or personal beliefs to be a Supreme Court justice. That she is of Puerto Rican descent and struggled to make her position in life is immaterial.

No Race on Test
The test was designed by an outside company knowing full well there might be a dispute regarding bias. So the test questions have never been an issue.
Simple solution. Eliminate race identification on the form. When asked to identify themselves just say, AMERICAN CITIZEN. If each candidate was given a number and only a secure source knew the corresponding name how could there be any bias. Everything would be neutral. Why does a race or ethinicity have to be shown?

About qualifications
Dr. Sowell asks, "Would longevity be equated with qualifications anywhere else."
Yes, in the public school system, where pay is based on longevity and not performnance. Look what a smashing success that has produced. But, they have plenty of excuses for it folks. Not enough funding!
