Sotomayor ruled that power companies cannot take into account cost-benefit analysis when trying to protect marine life around their plants. CNS News dug up a 2007 decision that was eventually overturned by the Supreme Court.

EPA may consider cost as a factor to a limited degree, but only as to whether the cost of a given technology could be reasonably borne by the industry and not the relation between that technology’s cost and the benefits it achieves.
