Sotomayor: "Empathy" in Action

It is one of the signs of our times that so many in the media are focusing on the life story of Judge Sonia Sotomayor, President Obama's nominee for the Supreme Court of the United States.

You might think that this was some kind of popularity contest, instead of a weighty decision about someone whose impact on the fundamental law of the nation will extend for decades after Barack Obama has come and gone.

Much is being made of the fact that Sonia Sotomayor had to struggle to rise in the world. But stop and think.

If you were going to have open heart surgery, would you want to be operated on by a surgeon who was chosen because he had to struggle to get where he is or by the best surgeon you could find-- even if he was born with a silver spoon in his mouth and had every advantage that money and social position could offer?

If it were you who was going to be lying on that operating table with his heart cut open, you wouldn't give a tinker's damn about somebody's struggle or somebody else's privileges.

The Supreme Court of the United States is in effect operating on the heart of our nation-- the Constitution and the statutes and government policies that all of us must live under.

Barack Obama's repeated claim that a Supreme Court justice should have "empathy" with various groups has raised red flags that we ignore at our peril-- and at the peril of our children and grandchildren.

"Empathy" for particular groups can be reconciled with "equal justice under law"-- the motto over the entrance to the Supreme Court-- only with smooth words. But not in reality. President Obama used those smooth words in introducing Judge Sotomayor but words do not change realities.

Nothing demonstrates the fatal dangers from judicial "empathy" more than Judge Sotomayor's decision in a 2008 case involving firemen who took an exam for promotion. After the racial mix of those who passed that test turned out to be predominantly white, with only a few blacks and Hispanics, the results were thrown out.

When this action by the local civil service authorities was taken to court and eventually reached the 2nd Circuit Court of Appeals, Judge Sotomayor did not give the case even the courtesy of a spelling out of the issues. She backed those who threw out the test results. Apparently she didn't have "empathy" with those predominantly white males who had been cheated out of promotions they had earned.

Fellow 2nd Circuit Court judge Jose Cabranes commented on the short shrift given to the serious issues in this case. It so happens that he too is Hispanic, but apparently he does not decide legal issues on the basis of "empathy" or lack thereof.

This was not an isolated matter for Judge Sotomayor. Speaking at the University of California at Berkeley in 2001, she said that the ethnicity and sex of a judge "may and will make a difference in our judging."

Moreover, this was not something she lamented. On the contrary, she added, "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

No doubt the political spinmasters will try to spin this to mean something innocent. But the cold fact is that this is a poisonous doctrine for any judge, much less a justice of the Supreme Court.

That kind of empathy would for all practical purposes repeal the 14th Amendment to the Constitution of the United States, which guarantees "equal protection of the laws" to all Americans.

What would the political spinmasters say if some white man said that a white male would more often reach a better conclusion than a Hispanic female?

For those who believe in the rule of law, Barack Obama used the words "rule of law" in introducing his nominee. For those who take his words as gospel, even when his own actions are directly the opposite of his words, that may be enough to let him put this dangerous woman on the Supreme Court.

Even if her confirmation cannot be stopped, it is important for Senators to warn of the dangers, which will only get worse if such nominations sail through the Senate smoothly.

Before the mid-20th century, all this country offered was white man after white man after white man. No women. No hispanics. No african-americans. Just a long, dull, unending, non-diverse stream of white men.

There is nothing wrong with redressing this injustice by focussing on a few women. Only uptight sanctimonious conservatives would kick up a fuss. And god forbid the women be "empathetic" AND a constitutional expert AT THE SAME TIME. Oh, horror. Empathetic constitutional experts?

You know, Thomas Sowell. If we had had more empathetic judges back in the day, then maybe your grandparents might not have had to go to the "Colored Drinking Fountain" or sit at the back of the bus for so long. Empathetic judges might have speeded up the equality.


Sad Commentary
Judicial Activism reigns on high. Our Republican party needs to get our ducks in a row. We are asleep at the wheel. It has barely been 100 days and look how far we have gone.

A Judicial Activist In Sheep's Clothing

This is really not about race as much as it is about ideology. Barack Obama was a community organizer and Sonja Sotomayor is a judicial activist. Both believe there exists a need for positive rights Constitutional rights. They each approach politics and the law, respectively, with a belief that there should be "wealth redistribution" (Obama) and "empathetic policy making" (Sotomayor).

It matters not the compelling life story of either. What is at play is Obama choosing a person that reflects his political ideology.

Where both should be impartial, they are, rather, activist. Law means nothing. If you are a secured creditor, Obama will abrogate your contract. If you are a white fireman and finished in the #1 place, you will not get the promotion because the fair thing to do is to give it to the black coworker, who failed.

Obama, who is supposed to be the President of the UNITED States, continuously, choses winners and losers on "fairness." Sotomayor will make judicial decisions based on "fairness."

Both check their impartiality at the door.

Yes, Sotomayor could have been a wealthy Martian, with the same ideological belief system, and she would have had a "compelling life history." We would still just have a woman of color with Barack Obama's ideology.

Call or write to your senators
and implore that they take their job of examining the judicial nominees seriously. Lord knows the Democrats did when Justices Roberts and Alito, and don't forget Clarence Thomas, were being questioned. And never forget what they did to Robert Bork. I don't think the Republicans need to be as rude as the Democrats were, but they can be just as serious about doing their job.

You do know that Sotomayor was not the first Hispanic to be nominated for the Supreme Court, don't you? George Bush nominated an Hispanic several years ago. He never made it to "first base" with the Democrats in the Senate. They are determined to be the only party which attracts minorities. They don't care what they have to do to members of minority groups that "stray" over to the Republican Party. And, of course, the co-operative MSM lets them get away with it all.

While Cheney is a vocal supporter of gay marriage (his only Libertarian position and based on the sexuality of his daughter), Powell drafted "Don't Ask, Don't Tell."

While Cheney is pro-life, Powell is pro-choice even though the African-American has an extraordinarily high abortion rate.

While Cheney believes in lower taxes so that you can have economic freedom, Powell believes that people "want to pay much higher taxes" so that they can get some benefits from the plantation master.

Interestingly, he made that statement on the Sunday before California, just said "No."

While Cheney has been consistent, Powell has been an opportunist.

Powell voted for Carter, then voted for Reagan (for whom he worked), voted for Bush I (worked), voted for Dole (left political life), voted for Bush II (worked), and then voted for Obama.

Well, eventually, the stories that the women brought to the show increasing became more and more gruesome. Now, if we can just find a poor, handicapped, black, lesbian, Viet Nam vet turned protestor, we'll have the next nominee to replace the next justice. Afirmative action in action
This nomination is an egregious affront to every civilized notion of 'justice'. This is fascist justice: the opinion matters more than the law. 'Feelings' outweigh the written word - identity politics pervades objectivity. The importance of getting to where you want to go trumps the nuisance of any legal constraints.

This nomination is an abomination perpetrated on this nation by the Obamanation. The tax/spending protest aspects of the coming July 4th rally should converted to a general calling to question of the current usurper's legitimacy to hold office i.e. to produce the birth documentation to prove citizenship.

Great article, again, by Dr. Sowell. There should be but one standard - if you can make it, fine, welcome to the competition. If not, thank you, have a nice day. This woman is a racist (should be very comfortable in the company of puppet-president Barry and his VERY racist wife). Congress must scrutinize her nomination with the same zeal they would a white, bald, retired military male being considered for the same position. No more free passes!

While no Supreme Court nominee needs to directly answer any questions about specific issues that may come up before the court... there are questions that SHOULD be asked.

Neomi Rao's commentary in the Wall Street Journal puts it the best. Here's one of her questions.

"Do you believe that judges should use "empathy" to decide cases? If so, what's the difference between empathy and judicial activism?"

Ms. Rao writes further, "The president has emphasized empathy as a paramount judicial quality. Polls show, however, that American's want moderate judges who follow the law, NOT their hearts." (caps mine)

Then Ms. Rao drives home her point. "Chief Justice John Roberts said in his confirmation hearings that judges should act like umpires - calling the plays, NOT making them. Mr. Obama has suggested he wants a home-run hitter." (caps mine)

Folks, either we're a nation of laws... or "equal protection under the law" becomes a farce.

And no-one's safety will be protected.

Cognitive Dissonance, as usual
Many "liberal" commentators and politicians have castigated Republicans and conservatives for focusing on Obama's desire for an empathetic justice on the Supreme Court. After all, Obama also mentioned rule-of-law in the same statement.

The problem is that the two concepts are mutually exclusive. If a judge allows his feelings for or against a particular person or group to affect how the law is applied, then the law has become capricious and Justice becomes a gamble depending on how the judge FEELS about groups or individuals.

Sotomayor is already on record as allowing her feelings and biases to affect her rulings. She is unqualified on that basis.

What happened in Ricci
happens in every federal court in the land on a daily basis. Appellate judges don't even read the opinions "they" deliver, as a general rule, to say nothing of actually reading the briefs or holding oral argument. Michael McConnell of the Tenth Circuit (who is quitting in a pique because he has no chance to get on SCOTUS) was so busy teaching classes and giving lectures that he scarcely bothered with his day job. I can point to a decision wherein "he" made a mistake so basic that a first-year law student at Regent would have been reprimanded for it.

And it's even worse at the district court level.

The only question is, whose ox gets gored.

We need to have a serious conversation about the quality of services our nation's courts provide.

Justice should be blind, it is depicted that way in statues and we have always been taught that fairy tale, my lawyer friends however, all say if your looking for justice, you won't find it in a courthouse.

So, if they believe that, are we to further screw up the system with people like this nominee, who thinks too highly of herself as does bambi, and who will rule not by the tenets of the law, but by how empathetic she is to the plight of one of the litigants?

Just think, the libs push for hate crimes legislation all the time, if we get judges who think like she does, it's not long off until judges will be devining what's in your head and punishing you accordingly...

Question for Sotomayor
I wish one republican would have the guts to ask Sotomayor one question during confirmation:

Ms. Sotomayor, how would you rule on a case where an individual is required to follow the rule of law and prove he is a U.S. citizen and therefore qualified to be POTUS?

Of course the republicans are all cowards and are afraid to force the issue, and Sotomayor would fish tail around the answer. Why? If the current POTUS is a fraud, then so are all his appointments.

(Shorts, your endorsement of La Raza proves you are racist, and therefore a hypocrite. Also, why do you speak spanish and disgrace your ancestors by speaking the language of their conquerers? Have you know pride? Don't bother answering because the answer is only relevant to you.)

The Constitution is Not a Suggestion,
Obama and his crowd behave as if they were rulers elevated by a secular version of the divine right of kings and that the people are to do his will rather than he do the people’s will.

If the Constitution does not mean exactly what it says, according to the plain meaning of the words at the time they were written, then there is no point to having a written constitution at all.

Seriously -- why have any written laws at all if "justice" is to be based on "empathy" and the "richness" of each, individual judge's life history?

Conservatives not Repugs can run this country properly because they believe in the Constitution and share the beliefs of the Founding Fathers. It isn't about the almighty buck. It is about incentives. It is about the free market in which the whole country prospers. The redistribution of wealth is a tried and failed economic system, over and over again.

If you believe in socialism please tell us why you believe it is better. Tell us why it is brilliant to hand all of our hard earned dollars over to the government. Obama ignored the Constitution when he ran for president as a foreigner.

Obama shreds the Constitution by abrogating legal contracts in the auto industry.

Obama seizes control of the banks and insurance companies, forcing many to take funds they do not want so he has "strings" to pull.

Obama circumvents the law by appointing "czars" to regulate industries according to his whim.

Obama is now appointing "jurists" who subvert the law rather than uphold it.

but I have many Puerto Rican friends because by brother married a beautiful Puerto Rican woman and my husband worked there for a time. I must say the friends and family I have from Puerto Rico are extremely driven. They are outgoing and have major personal and hospitality skills they are serious about careers at an early age. If this judge was raised by a Puerto Rican woman she was bound to be successful no matter what kind of poverty she was raised in. It always comes down to the parents. So why isn't Puerto Rico a successful island? It is a welfare state. They believe in government handouts. The United States government handouts. There is a great deal of racism on the island. They are horrible drivers because they do not believe the rules of the road are meant for them personally. My brother calls it passive aggression. THey just change lanes whenever they feel like it and you just get out of the way.

There are supposed to be three branches of government that check and balance each other. Things have evolved to the point of the Judiciary, appointed, not chosen by the people, holding more power than our elected officials. They answer to no one and cannot be removed except by impeachment.

Whose rules do we play by?
When a judge decides a case upon anything but the evidence and the rule (law) in question, he makes it impossible to live according to the law - and the law becomes void. At the appellate level, the role of the court is only to confirm whether the law and process were applied correctly - not redetermine the outcome of the original trial. For that, they can either vacate the original ruling or remand the case back to the originating court.

As stated in a previous posting, Judges are to act as referees, ensuring the law and process are fairly applied to both parties in a case, showing preference to neither. Judges do not judge the law itself. Only juries are empowered to judge the law in a case, since they represent the people who enacted the law. The Law is not a creation of the courts and is outside the authority of the courts - it is a creation of the people and they have sole authority over it. The was controversy of judicial revue in Marbury vs. Madison is still with us. The remedy for bad law is the people acting to rescind or modify the law. They decide the justice of the law's outcomes, not judges.

Governing by Feelings
Barack Obama is quickly dismantling everything that made this country great in the first place, the very reasons our Founders left their homeland to come here in the first place. This country is not supposed to be like others. It is supposed to be about freedom first and rugged individualism. Obama sees things completely differently. At his core, he has no respect for true freedom, capitalism or the American way of life. He and his wife are embarrassed about what this country represents. Whose rules do we play by? (part 2)
For those who think a judges "empathies" are valid criterion for judging the outcome of a case, why is it only valid for liberal judges? Any "conservative" judge who holds opinions favoring law enforcement over perpetrators or who is perceived to have connections to business interests is considered unqualified. But why are those "empathies" any less valid than the liberal's? Each party in a suit has a right to be heard and their claims to be considered - otherwise why bother with the court. Summary judgments would be sufficient, faster, and much less expensive.

"Empathy" in any direction cannot be a partner to the rule of law because it mocks the law. It's outcome is no different than if the judge is bribed by one party. We cannot rely on the ruling as a standard for conduct - which is the purpose of the law - because the ruling is not based on the law. We should be just as offended by the judge who believes that "social justice" is the measure by which a case is judged, as we are by the judge who has been "bought" by some local powerful business or politician and is beholden to rule according tho their master's wishes. Both judges produce unjust outcomes.

Would the left be just as willing to accept a conservative judge whose "empathies" run to ruling just on the law, or constitutionality of an act solely on the original intent of the Constitution's framers? They've already proved that they won't. "Strict Constructionist" is even a pejorative to many of them. The one-sidedness of their acceptance belies the injustice of the concept and affirms that their preferred justices cannot be just.

Being a judge is, to make a sports metaphor, like being a baseball umpire. You call balls and strikes and decide whether someone is safe or out based on the existing rules. You don't call a strike a ball because you think the batter is disadvantaged. You don't call a base runner out when he was safe because you think he steals too many bases and it is not fair.
You can also consider it like a boxing referee. Both boxers follow the same rules. you can't let one boxer throw illegal punches because of his race, or because he has a shorter reach. Equal justice under the law. If you lefties want a judge who will make up their own rules and become defacto legislators, then you better hope that judge is always on your side, because he could just as unfairly rule against you on a whim.
I don't give a rats hind end what race or sex a judge is and I don't care if they were born rich or poor. I expect them to judge based on the Constitution and the rule of law. PERIOD

Two Responses
Lots of Americans have similar life stories, though perhaps not to such extremes. Millions of Americans every generation rise well above the circumstances they were dealt. It's the American story.

So why some people successfully make that journey for themselves, then turn right around and feel the scales of justice must be tipped or others will never make it, I will never understand.

Proportionality and SCOTUS
Well if the ethnicity and gender of a Supreme Court justice is such an important part of their being able to render "justice" then we apparently need to amend the constitution to ensure that all groups are represented proportionally on the court. In order to do so it may be necessary to increase the number of justices to perhaps 100. Otherwise how could we have the correct number of native Americans or Pacific islanders on the court?

Meritocracy no more
Our society has been edging away from a meritocracy for decades, that is the effect of racial quotas. When you promote based on race or other qualities, rather than on merit, you have effectively descriminated against merit. descrimination by any other name is still ugly.

This nomination is simply a continuation down that cliched slippery slope. There will be more and more, it will get harder and harder for the left to find new victims however and the reasoning will inevitably become more arcane in order to define new social injustices for them to tilt at.

Empathy for some?
If the racial and gender make-up of the Court provides empathy, then only White men, White women, Black men and Hispanic women -- will be given the empathy.

I guess the Asians, Native Americans, Middle-Easterners, Black women, Hispanic men and all the rest -- will just have to suck-it-up.

Imagine if the NFL selected referees on the same basis as Sotomayor's "experiences". We could have a referee who grew-up a Saints fan, understands the disappointment of Saints fans and does his best to help "level the playing field" for the Saints.

Discrimination
Today discrimination still exist, although it is now in the form of payback time. The private sector has a need for talented minorities, and gives them a preference when hiring. Affirmative action, on the other hand, gives preference to the less talented, who have trouble competing with those who have not been given preferential treatment. Thus, when it comes time for promotional exams, those who have been given preferential treatment do not do as well. As the Peter principle demonstrates, some rise to their level of incompetence sooner than others for numerous reasons. That is why boxing and amateur wrestling have weight classes, and why no one gets a break during the National Spelling Bee.

Justice
Being a practitioner in the court system, there is almost always a winner and a loser, except when everybody loses. Justice for the winner is an abominable outrage to the loser.

What Does This Say about Obama?
Just the fact that Obama thought her well-qualified to sit on the Court suggests to me that she isn't. Who cares where she attended school or her race, gender, etc...? It is her judicial philosophy that should concern all of us. Her colleagues have criticized her for her lack of objectivity. Oh, sure, now there's a great quality in a justice!

You need to read up on Sowell's history. He had just as difficult, if not more so, than Sotomayor, and being in his 70s he has had to face separate facilities like drinking founatins, back of the bus, etc. However, he does not use that as an excuse to make nice. The purpose of the SCOTUS is not to feel empathy but to interpret the laws of our land correctly. It doesn't matter if there had been no women, blacks, hispanics in the SC, even to this day so long as the best qualified individual is on the court. That is Sowell's point. If I am under the knife I want the best surgeon, regardless of his/her upbringing, not the first [insert favorite minority combination] to ever perform surgery. That's just plain stupid.

Her past rulings and statements make her position very clear. Equality is stomping on the rights of people she hates, like white males. Upholding our laws and Constitution only get in the way of her desire to push her racist/sexist agenda. Obama is systematically tearing down our country with each person he appoints to office.

One thing I've always found amusing...
One thing I've always found amusing is that those who are most apt to accuse others of racism are universally the most racist people out there.

Racism is LITTERALLY codified in the OFFICIAL Democratic Party Platform statement. That is a FACT, NOT an opinion. And yet, in an act that would have made Orwell himself blush, it is the Democrats who accuse others of racism.

To a Democrat, equality = racism, while granting preference based on skin color ISN'T racism.

One of the more blatent examples happened a couple of months ago. On Sundays, here in Boston, on the 96.9 FM talk radio station, a race-baiting bigot named Jimmy Myers has a show. Unsurprisingly he's black. Every week he has a guest on -- a race-baiting black woman whose name I can't remember. When discussing race relations (they are one-trick ponies...there has yet to be a single nanosecond of that show that wasn't "crackers are ebil and blacks are God's children") the woman stated (and this is a verbatim quote), "We don't want a colorblind society. We don't want a meritocracy. Because everyone is a victim!" Unsurprisingly, Myers VEHEMENTLY agreed.

Sotomayor is a person of empathy who will in her "higher moral wisdom" makes sure that her feelings count for more than what is written in the law. All outcomes must sqare with her sense of morality or she will simply rewrite the law to make sure that her personal sense of justice prevails.

This is not justice but is personal preference writ large.

The biggest reason a VAT has been avoided here in the United States is NOT because they aren't effictive taxes. In fact, a VAT is considered to be the most efficient tax sceme in existence. Instead, the biggest problem with them is that once they are in place, it is far too easy to raise them through the roof without much notice. You can see this in Europe, where many nations have started out with a VAT of just 4% or 5%, and PROMISED that it wouldn't rise...only to have it raised to 30% two years later.

Obama knows this, and he doesn't think of the impact on our economy. All he cares about is what power he can buy with those massive revenues. Obama is a fascist, plain and simple, and the ONLY thing he cares about is power.

Email or write to all of them and urge them not to just roll over on this nomination. Sotomayor deserves at least the same level of scrutiny that Robert Bork and Clarence Thomas, among others, received, especially from Joe Biden, when he was on the Committee.
