Upon listening to “America the Beautiful,” President Obama’s most recently confirmed District Court judge’s first thought was not of spacious skies or amber waves of grain.

The judge couldn’t quite appreciate the beauty described in the song because of his cynicism towards America.

“Sometimes I cannot help but feel that there…too many inequalities that prevent far too many Americans from enjoying the beauty extolled in that anthem,” said Edward Chen at the Hastings Public Interest Graduation in 2005. Chen was just confirmed by the Senate Judiciary Committe as a District Judge in Northern California after a strict party-line vote; if installed, he’ll be the first Asian-Pacific-American judge in that district.

Chen’s thoughts after 9/11 and after the Virginia Tech shootings were in a similar vein.

“[O]ne has to wonder whether the seemingly irresistible forces of racism, nativism and scapegoating which have recurred so often in our history can be effectively restrained,” he said, after giving his regards to the 9/11 victims. After learning that the Virginia Tech shooter was Asian, his immediate feeling “that any of us could soon be . . . subject of a racial backlash, victimized by a hate crime.”

For sixteen years, Chen worked as a staff attorney for the American Civil Liberties Union of Northern California, working on affirmative action, the death penalty, and discrimination cases, among other issues. He was the second nomination of the day that had ties to the ACLU, leading Rep. Sen. Jeff Sessions (R-Ala.), ranking member on the Senate Judiciary Committee, to comment, “I think we’re seeing a common DNA run through the Obama nominees, and that’s the ACLU chromosome.”

In his committee questionnaire, Chen said he likes the law because it allows him to influence justice, saying that he finds it “most rewarding” when he contributes to “the development of the law via published opinion, especially if it comports with my view of justice.”

“Mr. Chen by all indications is an able individual and a man of integrity,” said Sessions. But “important issues are raised by the nomination in both his writings and public comments as a magistrate judge [that] suggest that Judge Chen believes judges should interpret the law according to their own personal preferences.”

In a letter to the New York Times, Chen said that laws which are only in English represent “false, xenophobic assumptions;” in an earlier letter, he had characterized a preference for English language in the classroom and elsewhere as “anti-immigrant and xenophobic in character.”

"Senators diverted $2.6 billion in funds in a defense spending bill to pet projects largely at the expense of accounts that pay for fuel, ammunition and training for U.S. troops, including those fighting wars in Iraq and Afghanistan, according to an analysis.

"Among the 778 such projects, known as earmarks, packed into the bill: $25 million for a new World War II museum at the University of New Orleans and $20 million to launch an educational institute named after the late Sen. Edward M. Kennedy, Massachusetts Democrat.

"While earmarks are hardly new in Washington, 'in 30 years on Capitol Hill, I never saw Congress mangle the defense budget as badly as this year,' said Winslow Wheeler, a former Senate staffer who worked on defense funding and oversight for both Republicans and Democrats. He is now a senior fellow at the Center for Defense Information, an independent research organization.

"Sen. Tom Coburn, Oklahoma Republican, called the transfer of funds from Pentagon operations and maintenance 'a disgrace.'

"'The Senate is putting favorable headlines back home above our men and women fighting on the front lines,' he said in a statement."

OK He does and is addressing challenges in the military. Nitpick away at earmarks but know all serve a DoD purpose in some manner. Are troops suffering from shortages of any kind? The truth is the DoD budget is bloated and should be trimmed but let's see what happens shall we. Did I hear complaints about DoD budget earmarks in the past?

We can't even debate the questions anymore. Who do we debate them with? Our children? The young? They can't get their mind around reading a book. "Where's the pictures?" The worst of it is that I am in that crowd that saw it grow but just couldn't be bothered to do anything about it.

There are so many stories in the Bible that show us exactly what happens when a people become lazy about their God. The liberals have not been lazy toward their Lucifarian dictates but we Christians have sat back and said "Oh,well." I for one will either go to the voting booth or go to my gun rake but what ever I choose it will not be from my couch shouting at stupid blogs or stupid TV.

One is led to wonder how he views classrooms in Japan, Korea or China - or even how he feels about laws written only in Japanese, Chinese (which is a real nightmare considering the dichotomy between Mandarin and Cantonese) or Korean?

where the MOST of the "minorities" are! Here in SC--the 13% of Blacks are actually 33%; the 15% of Mexicans are actually 35%--and the White "Majority" is actually the poor, downtrodden minority!
I see blatent racism every time I go into a store, an eating establishment, a gas station.
And it's literally ALL coming from the "minorities"!
I'm VERY tired of having people assume (and often claim outright!) that I "owes" them ANYTHING! I've paid my taxes, I've paid my dues--and I'd put my actual dollar-for-dollar contribution toward the "poor" by way of contributions and taxes up against ANY of the worst of the offenders I see every day!
If every State actually only accepted into their boundries the actual percentage of Minorities that are existant Nationwide, you would see a LOT less Racism from anybody! Racism is bred from the confidence contained in being unidentifiable in a crowd.
Take that out of the mix--and what we would get is the actual ability to excell--rather than the quest for equal results for everyone without effort.

One needs to understand the ACLU. It was formed in the 1920s, and the Scopes trial back in 1925 was an ACLU promoted stunt. But the facts surrounding actual events are virtually unknown because of Hollywood's purposeful rewritten history. People know the "Inherit The Wind" version of history, not the historical events. Learning actual truth (as opposed to Hollywood's propaganda) typically provides a dramatically different judgment. The ACLU, in my mind, is as bad as ACORN ... those who see things through their lens are unfit of my trust.

America has a population of about 315 million, yet less than 3 million "prisoners" in our prisons, prisoners who have access to TV, recreation, voluntary jobs, law libraries, free legal counsel, due process and appeal rights, medical and psychiatric treatment, etc. I'm not saying life in a prison is easy street, but these were all things denied to "free" Russian citizens.

Less than 1% of Americans are in prisons, and all of them had the right of a jury trial.

How many Russians were in prison? What was the per capita rate? We don't know, because the Russians aren't telling. For 20 years after WWII, we didn't even know how many people lived in the Soviet Union because the Russians kept it a secret. This we do know: Stalin bragged about murdering 20 million Russians in his purges in the 1930's (well, they're dead, I guess we can't count them as "prisoners"-- of course their "crime" was mere opposition to Joe). We also know another 10-60 million (depending on the source) were killed in WWII, and that statisticians claimed that at least 10% of the population died during the war. So using the conservative number of 10 million, the USSR had a population of 100 million or so in 1940. Given the birth & death rates of eastern Europe, the population would not have increased to above 200 million by 1970, when Alexander Solzenitsen reported that 10 million Russians languished in Siberian gulags.

So, America has less than 1% in prison, and Russia had at least 5% but Hal tells us we have a higher per capita prison population than Russia (for Hal's numbers to equal ours, the USSR would have had to have over 1 billion people in 1970, a number they still have not yet attained).

Think, people, think. And don't let a lying liberal bluff you.

You are lying with math LOL. We all know Stalin was bad and killed a lot of people BUT in modern Russia there were fewer folks in prison. My point, valid, is that our judges are not weak of lenient. Locking up innocent people is far worse than letting guilty people go free.

That is his opinion. In Europe, indeed world-wide, kids learn their native languages and often two or more others. My cousin in the Netherlands lives near the German border, so he speaks Dutch, English and German, all fluently.

Yes. My old unit has repeatedly had to cancel or deny certain training events due to lack of training funds. They keep doing the same old unrealistic training because better training costs money... and contrary to your opinion, that money is not always to be had.

I do not beleieve you are in the military or you would be making no statement supporting an organization that is out to kill your brothers and sisters on the battlefield. They are opposed to Gitmo, where do you think those idiots are going to go if the ACLU gets thier way? Even worse they want to remove crosses from memorials to our fallen brethren, and remove the ability for chaplains to pray. They also supported people picketing at funerals for our soldiers. If you are in the military you need to have more pride and support for those who are in harms way.

One of the strengths of America as a nation has been its homogeneous population and the ability for mobility over a large area without the strictures of language and legal barriers. The assimilation of ethnic groups into the environment is one of the biggest reasons for our success, both economically and culturally. While speaking another language and learning about other cultures is a fine thing, but our nation has grown, in part, because of the "sameness" of our environment.
The "culturally elites", both here and in Europe, who look down there noses at Americans, can afford to do so, since they either are working 30 hour weeks (France), 40 week years (Germany), or are trust fund babies (American NE). Thise who have made this country great don't really worry about it all that much....

I haven't read many of SSG R's posts. However, the fact that he has a different impression of the ACLU than you do is certainly not an indication that he does not serve in the military.

Although I find conservatism to be fairly prominent among servicemembers, the military is not a conservative preserve. I know of professional, honorable, patriotic personnel who voted for President Obama, support the current abortion-for-convenience policy, think gov health care is a grand idea, etc. Pick any 'liberal' position and I will find you at least one outstanding soldier who agrees with it.

I may think them wrong on one or all points, but that doesn't automatically mean that they don't serve the nation well. This fact may not appeal to everybody, but it is true.

Please recall that the military does not belong to the conservatives, or to the liberals ... it belongs to America.

Scott, you are so typical of a yahoo..."USA, USA". One can actually comment upon a failing of one's nation without being a traitor. I happen to think we are better off the more we know and understand others' languages and cultures. We tend to be very, very provincial--we go to France, for example, and are upset when they don't speak English. Few if any French people would even consider coming to the states without knowing at least rudimentary English.

Emerson, you're really not correct. Many immigrant groups (Germans and Scandanavians in the mid west, Russians and others in east coast cities) were very insulated in their cultures. They sent their kids to school to learn English, yet didn't give up the native language. We are better for it. Many of those towns in the early 20th century had parts of town where English was not spoken.

Your view of Europe is amusing. They work hard there, and 'trust fund babies'? What the F? How many of those do you seriously believe there are?

My family emigrated here from Europe around the turn of the 20th Century. They maintained their native foods and cultures, and often languages. As I said, that is a good thing.

You are right about the good that emigrants gave to this country. But all the emigrants, and there extended family, talked about becoming American. They were proud of their ethnic heritage, but wanted to be American. The diversity that libs always talk about, is not inclusive, but segregation. IE; Black mss America, black, Hispanic ect dorms. The list goes on and on. The issue I see today is that the emigrants don’t want to be American, They want to be Mexican American, Asian American, and so on. A house divided will fall. As for Europe, their values are way diffrent then American values. I don't want Europes values to rule here. If I wanted Europes values, I would move there.

you're historically wrong. Read "Beyond the Melting Pot". Immigrants have often installed themselves in enclaves that spoke the native language and had little to do with the mainstream population. Look at the Amish, towns in Wisconsin, and such. And how we treated minority immigrants (Chinese, Blacks who came here as slaves) was hardly inclusive, including incarcerating native born Japanese Americans in internment camps during WW2.

You need to look at history, read the letters, books, and other wrightings. You are right about the Japanese, But I believe it was the most librial Pres we had ever had, up till LBJ, at the time. Had majoritys in both houses. Also incarcerated Italians, and Germans. Many with good reason, such as treason. Who wrote the “beyond the melting pot”? I have read many books. Not everyone views the ACLU in the same light as you -- as being 'out to kill your fellow service people'. That might be from ignorance -- perhaps not everyone is familiar with cases that prove the ACLU to be anti-military.

Frankly, I pretty much agree with you on the ACLU. It seems to me that the organization often cherry-picks its causes, and that 'elastic' commitment to principle is, in my eyes, pretty disgusting and hypocritical.

However, I don't see that one can make an ironclad qualitative judgement about somebody based purely on their feeling about the ACLU.

Again I disagree. I don't think the best watchdogs are law or precedents. It's the awareness of the American people. I think the majority of people are fair minded individual. You don't.

Also, philosophically law is destined to destroy itself through precedents and become more unfair over time. Precedents=complexity=more costs=inequity. As law becomes more complex it favors the people with the most money. People who can afford the best attorneys and the most amount of them will tend to win a case. Look at DUI charges, murder charges etc for examples. Combine this with the emasculation of the jury system and you have a system that favors the powerful.

Simplifying law and re-empowering the jury system is the only solution to fairness. It is imperfect, but the alternative is what we are getting which is destructive, parasitic, and completely unfair.

But this is the real fight of conservativism vs liberalism. We believe individual, family, community are the best deciders and have the best ability to pass judgment. You believe government, especially federal government, is the best solution. My guess is a hybrid of the two (we have it is called a constitution) is the solution.

It's scary for control freaks and people who look down on the commonman, but a powerful informed jury system with an educated populous is the solution. Not more laws.

I think our definitions of judicial activism are different. Obeying the constitution isn't bad. There is an equal rights amendment that says slavery was bad. Also the foundation of the constitution are pretty clear on equality.

Look at the constitution about the Supreme Court. The Supreme Court actually had little to no power. The could rule over state's trade rights. They had little or no power over state governments and I am pretty sure they would have been hung if they tried at that time.

As for Brown vs Board. It is a perfect example of law not working. People need to stand up for it and take ownership.

Look at the education system now. Can you honestly say its much better now than pre Board of education. I am not certain I can see the difference.

Laws without the people's consent are worse than baseless because they give the illusion of success. The Equal Rights Bill didn't solve racism. It was society as a whole becoming more education on discrimination. Talk to any teenager and compare them with an older person and you will see the real solution.

Again movements takes time. I think the gay rights movement will progress despite itself (it makes the black movement look intelligent). Yes, I think the leaders of both movements have not only hurt the causes, but hurt their own people in the process.

My guess is homosexuals won't get marriage, but they will get civil unions which I think most of the country is for.

Again, people aren't perfect, but the draconically forcing them to do something isn't the solution. Spend more time on education and less time on bullying others.

It is regretable but not surprising that Judge Chen sees himself as an Asian-Pacific person who happens to be an American by a confluence of circumstances probably beyond his control as an individual person.
