Biden-Harris Will Give Millions to States That Adopt 'Red Flag' Laws

The Biden-Harris Administration announced it would give millions of dollars to states that agree to adopt gun confiscation laws. 

On Thursday, President Joe Biden and Vice President Kamala Harris unveiled “Additional actions to reduce gun violence and save lives” by rewarding states $135 million in funding if they implement red flag laws under the Byrne State Crisis Intervention Program (SCIP). 

The Department of Justice is announcing over $135 million in formula awards to 48 states under the Byrne State Crisis Intervention Program (Byrne SCIP), which provides funding for the implementation of extreme risk protection order, or “red flag”, programs, state crisis intervention court proceedings, and related programs/initiatives. The implementation of state red flag laws is supported by the National Extreme Risk Protection Resource Center.

Red flag laws violate American’s right to the Second Amendment by giving authorities the power to enter a person’s home and confiscate their firearms.

The White House claimed that such anti-Second Amendment laws work to curb gun violence. However, several states which adopted red flag laws show little to no improvement in the state’s gun violence. 

Despite California adopting red flag laws and being one of the most heavily gun-controlled U.S. states, the FBI still “designated 48 shootings as “active shooter incidents” in 2023. The state also had the highest number of “active shooter incidents” in 2021. 

In addition, after the Parkland High School shooting, Florida implemented red flag laws. However, the state still saw mass shootings, with one incident killing five people in 2019. 

Then-San Francisco's district attorney Harris warned legal gun owners that authorities could "walk into" their homes and confiscate their legally owned firearms. 

“Just because you legally possess a gun in the sanctity of your locked home doesn't mean that we're not going to walk into that home and check to see if you're being responsible and safe in the way you conduct your affairs,” Harris said in 2007. 

Harris has consistently advocated for gun confiscation, magazine bans, unconstitutional national red flag laws, mandatory storage, and the belief that there is no individual right to gun ownership.

The Harris-Walz campaign is championing a “buy back” program, which would give gun owners no choice but to hand over their legally owned firearms to the government.
