Virginia Responds to Supreme Court Decision Against Expediting ObamaCare Lawsuit

Virginia Attorney General Ken Cuccinelli issued a statement today responding to the Supreme Court's decision not to bypass lower courts and take up the state's lawsuit ObamaCare immediately. The statement cited spending and cost as the main reason for Virginia's request that the case be expedited:

“We asked the United States Supreme Court for expedited review of our lawsuit because Virginia and other states are already spending huge sums to implement their portions of the health care act, businesses are already making decisions about whether to cut or keep employee health plans, and citizens are in limbo until the Supreme Court rules.  Asking the court to expedite our lawsuit was about removing this crippling and costly uncertainty as quickly as possible."

The press release points out that expedition under Rule 11 would have been an exception to the Supreme Court's usual proceedings and called the decision "not surprising."

The case will proceed May 10th in the Fourth Circuit Court.
