Yes, There Is an Invasion on Our Southern Border

"No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay." - Article 1, Section 10, Clause 3 US Constitution

There are two definitions of the word invasion. The first is "an instance of invading a country or region with an armed force.” That is happening in Ukraine. The second definition of an invasion is "an incursion of a large number of people or things into a place of sphere of activity." That is happening here in America. It seems unbelievable that so many are asking for legal opinions and articulations of something so very simple. 

Above are the two very clear articulations on the issue from our Constitution, our rule of law. What those two sections tell us is that the Biden administration is derelict of its constitutional duty; this is clearly enumerated as to what they must "guarantee" to each state in the union. As well, the states are given an enumerated power when the federal government fails to execute theirs on the matter of invasion...so we also have governors who bear the responsibility of protecting the border. In the State of Texas, Article 4, Section 7 of the state constitution articulates that as Commander-in-Chief of Texas military forces, the Governor has the duty to "repel invasions."

These failures by elected officials and bureaucrats are the reasons why several border counties in Texas declared an invasion. As expected, the progressive socialist leftists, who embrace an open borders policy, asserted this was just a political stunt. And the Governor of Texas issued a weak executive order which failed to support those counties and declare an invasion, but rather bolstered what has been determined a "catch and release" policy.

Perhaps it is best to put all this into terms that are irrefutable, albeit disconcerting.

It is indisputable that there has been a large incursion into the U.S. Since the Biden administration implemented their open borders policy, there have been nearly 3 million who have illegally entered the United States. Of that number, there have been approximately 800,000 who are designated as "got aways." These are the individuals, often dressed in black and camouflage, who avoid apprehension. 

It is imperative that we realize that the 800,000 illegal immigrants, mostly single military-aged males, represent a number greater than the active-duty strength of our U.S. Army and U.S. Marine Corps combined. Yes, there has been an illegal incursion, invasion, of more individuals into America in the past 18 months than those who currently serve on active duty in our two primary military ground combat services.

Meanwhile, the Biden administration undermines state and national security by punishing 60,000 National Guard members who have not taken “the shot.” Thankfully the founders recognized government’s inability to protect citizens and asserted in the Second Amendment, "A well regulated militia being necessary for the security of a free State, the right of the people to keep and bear arms, shall not be infringed."

To put this in perspective, the Vietnam Veterans Memorial Wall in Washington D.C., has the names of 58,281 Americans who lost their lives in service to this nation during that war. In 2021, America lost 71,238 citizens due to fentanyl. Fentanyl originates in China and finds its way to Mexico where the cartels refine and transport it across our porous border into the United States.

China is supplying a transnational narco-criminal terrorist organization with a substance that is killing Americans. Not only are we dealing with an invasion, we are also confronting an insurgency against a non-state, non-uniformed enemy combatant that is well armed and resourced. 

The constitutional failures of elected officials have enabled a drug, sex, and human trafficking epidemic in America. While there is a recession in America, the narco-criminal terrorists who control the southern border zone are amassing billions of dollars a month thanks to politicians who do not understand plain and simple English.

At the American Constitutional Rights Union, we understand the simplicity of the language and the enumerated duties and responsibilities articulated in the Constitution. We affirm that this is an invasion on our southern border, as do the veterans who are part of our Committee to Support and Defend who are publicly calling out elected officials to step up to support and defend the Constitution of the United States as written.
