Manufacturing a Crime

In December, I was asked to file a second report on an automobile accident that took place back in September, during a visit to Los Angeles. A truck slammed into my car from behind while I was stopped at a traffic light.

As I sat down to write a new report, I tried to recall the details, beginning with where the accident took place, which I remembered as having been on Wilshire Boulevard.

Fortunately, I had saved a copy of my first report on this same accident, which showed that it took place on Santa Monica Boulevard, not Wilshire, which was the street up ahead.

What if I had not saved a copy of that first report, and had written down and signed a report saying that the accident took place on Wilshire Boulevard, when everyone else involved said it was on Santa Monica Boulevard? If this was a statement made under oath, I could have been prosecuted for perjury.

All this made me think back to a more important case where memories differed and a man's life was ruined because of a perjury conviction. Moreover, it was about something that was no more crucial than the name of the street where an accident took place.

That man was Lewis ("Scooter") Libby, assistant to Vice-President Dick Cheney. He testified under oath that he had not leaked to reporters the information that Valerie Plame worked for the CIA, but had in fact learned about it himself from reporters, including Tim Russert.

Unfortunately for Scooter Libby, there was testimony from Tim Russert that he himself did not know that Valerie Plame worked for the CIA at the time of his conversation with Libby. Perhaps even more damaging, the White House's own press secretary, Ari Fleischer, said that Libby mentioned to him that Ms. Plame worked for the CIA. This was a few days before Libby talked with Russert.

It seems clear that Libby had his facts wrong.

But in more than 8 months between the various conversations at issue and Scooter Libby's testimony before a grand jury, those facts assumed a far greater importance than they had at the time, when there was no reason for them to be particularly memorable.

While it is a crime to reveal the identity of an undercover CIA agent, Valerie Plame was no longer an undercover agent, her identity having already been revealed long before this whole episode. She was now just someone with a desk job at CIA headquarters in Virginia when this furor broke out.

The only reason her name appeared in the media was that her husband, former ambassador Joseph Wilson, had attacked the Bush administration for going to war in Iraq. Wilson had gone to the African nation of Niger to check out suspicions that Saddam Hussein was seeking uranium from there, in order to create weapons of mass destruction. He concluded that this was not so.

Wilson became an instant hero to critics of the Iraq war in the mainstream media. The impression was widespread that the Bush administration-- specifically Vice-President Dick Cheney-- had sent him to Niger and then rejected his report.

This was news to officials of the Bush administration, who scrambled to find out who this man was and who sent him to Niger. Among those scrambling to find out was Scooter Libby.

What Libby and others discovered was that Wilson had been sent by the CIA, on the recommendation of his wife, Valerie Plame. When this was revealed in a column by Robert Novak on July 14, 2003, a clamor went up that a CIA agent had been "outed" in retaliation for her husband's criticism of the administration.

In reality, Robert Novak got his information from Richard Armitage, not Scooter Libby. Moreover, Novak was a critic of the Bush administration's decision to go to war in Iraq, so he was very unlikely to be part of a plot to retaliate against Wilson.

Neither Novak nor Armitage nor anybody else was prosecuted for revealing Valerie Plame's name, for it was no crime. But Scooter Libby was prosecuted big time for getting his facts wrong.

As someone who has any number of times had his memory corrected by consulting old records or old letters, I don't think a man's life should be ruined for that, when there was no crime to investigate in the first place.

Surely President Bush can pardon this man before leaving office.

If Bush does nothing else before he leaves (including stop giving our country over to the government), he needs to pardon Libby. This was such a sham! We'll see how many prosecutions Mr Fitzgerald comes up with in the Blago fiasco. I am betting NO ONE, even for having a forgetful memory.

I absolutely cannot imagine why you would not grant pardons to these three political pawns. These men are not criminals, but rather they are men who paid part of the price of the hatred aimed at you in one way or another.

Our government is nothing more than a pack of wild dogs and vultures waiting to pounce on the slightest hint of wrongdoing. Scooter Libby was probably convicted, sentenced and his career ruined for "mis-remembering." How in the hell can a government function in such an atmosphere?

Everyone currently in Washington most likely has something on everyone else. With this level of paranoia in charge of the best interests of the nation, it is time for all of them to go. I volunteer a Senator from my own state, Harry Reid.

I've had a theory that the reason we saw such

The democrats have a problem, and they themselves are it. As they lead by treachery the nation follows. There will come a day, if it is not already here when you will not know who you can trust. What happens to their power when the minority refuse to work for the majority? Will they mandate that everyone work 20 hrs a week to support those who will not work? Mr. Sowell has pointed out the misuse of power to politically sabotage a President. Why should we think they would do less to you and I.

Patrick Fitzgerald KNEW THE DAY HE WAS HIRED THAT NO CRIME HAD BEEN COMMITTED so, to justify his pathetic existence, he set up a perjury trap. That's what he does. Already he wants more time to indict somebody in the Blago case. My guess is no one will ever be indicted, or if they are it will be for someone caught in the he said, she said perjury traps that Mr. Fitzgerald is so enamored with.

Libby's (and Ramos and Compean, too) biggest problem is that Bush lacks the political and moral courage to do the right thing and issue them unconditional pardons.

You should see the dems work NJ- the "Soprano State" at a variety of levels. One example of probably thousands is the "free curriculum" I am forced to take every couple of years to use with my students. Its always unusable junk coughed up by the same handful of people, and its distrubuted as "a treat" (at taxpayer expense) for us and our students. Then it gets reported as receiving "100% usage" by various alternative education programs! Of course, this means it needs to continue to be funded. Because it is so wonderful, it can also be sold on the private market as a product widely implemented... Such devious scummy moves are altogether too common here in solid blue Jersey.

The perjury was a crime manufactured by the investigative process, since the person who actually identified Ms. Plame was already known. One wonders if this is prosecutorial misconduct.

Having testified in court many, many times I know how this can happen. The correct thing to do is to take notes, use the notes for testimony, and whenever you aren't absolutely certain, say "I have no independent memory of the details of that conversation".

And who told you what Bush cares about, or the country, at this point in time?

plame was covered by the act despite republican attempts to say otherwise.

the republican appointed head of the cia, under oath, said she was.

Give me a break. give us all a break. How about this for an absolute fact that everybody now knows. The "leak" to Novak that was being investigated was by Richard Armitage. He told Fitzgerald in their very first interview, right at the start of the investigation, that he was the person that had told Novak. Fitzgerald told him not to tell anybody and threatened him with prosecution and a lengthy prison term if he told anybody. Similar threats were made to Novak. Fitzgerald decided that his mission was not to find whether a crime had been committed and prosecute the perps, but instead to prosecute and convict members of the Bush Administration of whatever he could. The purpose of his office is to ALLOW unfettered prosecution of members of the executive IF THEY ARE GUILTY. Instead he went after the administration as a target the way a special task force might target a mob family where their general guilt is assumed and you simply want to convict as many high ranking members as possible for whatever crimes you can make a case on. The fact that all he could get a conviction on is the conviction of Libby for supposedly getting the date wrong on when he had certain conversations (LEGAL CONVERSATIONS) indicates the Bush administration must be the most squeeky clean in history. As far as Plame, who exited the highway everyday at the CIA NEXT RIGHT exit went down the "most watched mile of road in the world" and parked in her parking place marked with her name beinga "secret agent" is laughable, but guess who has the authority to unclassify any information??? Come on.... Hint.... lives in a big white house.....

Please explain how Valerie Plame was covered under the act in question. Since when is Virginia a foreign country? Who are these undercover CIA agents spying on in Virginia? Are Robert E. Lee and Stonewall planning rebellion again? Wouldn't that be the province of the FBI?

And how come no one ever comments on that bit of nepotism in the CIA of all places? What is it, a take-your-husband-to-work kinda place?

The Libby conviction is a joke -- this coming from someone who'd normally laugh at seeing some 50-something preppy named 'Scooter' dragged off to jail under any circumstances. And Novak knew all along but kept quiet to protect his 'sources'! Right. Exactly the kind of guy you'd like to find yourself in a foxhole with.

We'll see if all the Dem outrage over the 'outing' of a CIA agent translates into respect during the next four years under Panetta.

My regard for W will go down several pegs if he doesn't pardon Libby & the border agents.

Bush needs to clean up his mess
before he goes. Pardon Ramos, Compean, Libby, the Abu Graib guards and anyone else who was rulled down by his administration's policies.

Bush should pardon Scooter Libby
I pray that Compean, Ramos,Libby and all the like will be pardoned. It can't hurt Bush politically and would right some injustices of the legal system.

The fact is that Richard Armitage himself admitted that he leaked Plame's identity. This makes anything Libby did a moot point, regardless of who testified against him. Even if Plame was still considered "covert," (which is highly unlikely), she was not outed by Libby; she was outed by Armitage, a man who is no friend of the Administration. They could find no wrongdoing by anyone under Bush, so they trumped up a procedural crimed against Libby and ran with it. The press ate it up as they knew would happen, and most Americans probably don't know the difference.

Memory expert Loftus agrees on Libby
An opinion piece in the WSJ, "If Memory Serves", 09 Jan 2007, says somewhat the same thing about Libby's memory. One of the writers, Elizabeth Loftus, is an author of books about memory (e.g., "Witness for the Defense",) and has been called as an expert witness on memory in a number of court cases. Ms. Loftus's testimony helped to dismiss a number of "false memory" suits.

On the surface...
...it seems obvious that Libby, Ramos, & Compean should be pardoned. Why then, is Bush, and his administration, dragging their feet on this issue? Is there more to this than we know?

Lost credibility
That is what President Bush will have among a lot of former supporters if he does not pardon this man, who's only sin was daring to work for the Bush administration.
The target of these people was Dick Cheney even more than George Bush. I only hope and pray that President Bush is not too bull headed to right this wrong. If he fails to, President Obama may do so to bring conservatives to his side.

Mr.Sowell, its time to admit the obvious about Scooter. He was the stovepipe between Judith Miller of the Times and Cheney.
That's what he was lying about,passing on cooked up intell from Cheney to pass on to Miller for front page Times stories and their support. Hey, Cheney couldn't do it directly and Scoots was his chief of staff.
It took a presdential pardon to keep him out of prison. Also,look at Iran-Contra pardons, the Republicans just never learn. Scooter and the others should be in jail for at least 20 years breaking rocks in the hot Florida sun!

Fitzgerald and Libby
There's one more step back on the Libby witch hunt. The details are in several posts (that I don't have at my fingertips now), but Fitzgerald was beaten in a court case by a savvy defense attorney a few years before Plamegate. It was high profile at the time, and big stakes on winning it as a federal prosecutor. But, the defense attorney won, and went on to a cushy federal job. That defense attorney was... (wait for it...) Scooter Libby! And now (with apologies to Paul Harvey), we know, the rest of the story....

You should be a fiction writer for some Hollywood production. You don't make any sense, but it is an intriguing story nonetheless. Oh, and pass along whatever it is you're smoking.

A few more facts: Part 1
First of all, "Scooter" Libby was not pardoned by Bush. His sentence was commuted, which means he still has a felony conviction on his record, but that he was released from prison by the commutation.

Next, it gets even worse, and is even more obvious that the whole "Plame was outed" was nothing more than a political witchhunt.

First of all, as has already been pointed out, Fitzgerald has admitted that he knew, on the very same day he was hired, that no crime was committed because Plame was not then, nor has been for years prior, and undercover CIA anything. Also note that he admitted that knew within a week that were there a crime committed, it would have been Armitage who committed it (Armitage admitted he was Novak's source). So the question remains why did he continue to "investigate" what he knew wasn't a crime, and were it a crime, he already knew who would have committed it? There is only ONE answer: that he wasn't interested in any crime, but instead was playing a game of political gotcha.

A few more facts: Part 2
The next thing you must consider is the testimony of Andrea Mitchell. Andrea Mitchell, a reporter involved in the case, initially gave testimony that actually confirmed Libby's initial testimony. When she realized that her testimony confirmed, not contradicted, his testimony, she returned to the grand jury, admitted that she was lying in her initial testimony (she claimed she was trying to get Libby convicted of perjury) then reversed her testimony. In short, Andrea Mitchell admitted that she was intentionally guilty of perjury, yet because she had no connections to the Bush administration, Fitzgerald decided not to prosecute.

Finally, Fiztgerald only decided to prosecute Libby only after Libby returned to the grand jury with his notes from the day. Libby claimed he found his notes of the conversation at question, and realized that his initial testimony was innaccurate, so he returned, voluntarily, to ammend his testimony. Instead of accepting ammended testimony, the hired political gun shouted "GOTCHA!" and then used Libby's admission that he was "guilty" of perjury.

The only thing Bush did wrong here is not completely pardoning Libby (as I said, he wasn't pardoned, Libby's sentence was commuted).

Excellent answer. I greatly fear that Bush may have painted himself into a corner by not wanting to "taint" his non-compromising image. If Libby was found "guilty" I'll bet Bush cannot bring himself to circumvent the wheels of justice.

Who is running the show...
I do not know who is running the show at the Justice Department in relation to the Presidential Pardons. But from my point of view it seems that those that should receive pardons, are not; and those that should not, are. Question: WHY?

Libby, Ramos and Compean should have been the top of the pardons list...as none of them committed crimes, but were prosecuted and sentenced for these non-crimes--the real crime was the prosecution of Ramos and Compean by Johnny Sutton.

Please enlighten me. Tell me who was prosecuted for outing Valerie. Who was put in jail for committing the crime of outing a CIA Agent.
From what I know, NO ONE! You know why? Because it was found she was not a covert agent, thus was never OUTED! In other words, no crime was committed that anyone could be prosecuted for, but they found a reason to prosecute Libby for perjury, NOT OUTING A CIA OPERATIVE!

Big mistake

President Bush's biggest mistake was not shucking all the Clinton appointees on the first day. Look what we have now--a bunch of Clinton retreads--running the next administration. Collusion? I just want all the Clintons--Kennedys--and their ilk GONE!! (Obamas too if he doesn't surprise me.)

Bush's Priorities
If Bush (he is STILL PRESIDENT!)pardons Libby, who has already not had to serve a day in jail, and leaves Ramos and Compean in jail, his "legacy" (about which he is so concerned will be final.

He bequeathed to the Obama-Left a lawless precedent, celebrating those who broke the law and abandoning those who enforce it.

Rahm Emmanuel can lie with impunity just like Libby did. Heckuva job, Georgie!

And ten million illegals will have the vote. You think they're going to vote for Sarah Palin?

This Pardon is Mandatory
If Libby is not pardoned before President Bush leaves office, the failure to do so would be a serious and major injustice. In addition the two Texas border guards, Ramos and Compeon, should also be pardoned.

Speaking of illegal behaviors
I have a question for anyone willing to answer:

If I set up a target to practice using my new 22, and the target happens to have Obama's picture blown up and pasted to it, will I be arrested/convicted of "attempted assasination" of a president elect?

I need to know because I have a 10 year old that still needs me, but I also need a viable target for practice (sight is a little on the high side). I don't want to be taken off to the pokey for having some fun.

I hope the guy does fantastic work. I do not agree with his ideas on how to spur the economy ("the government has to bail us out of this" is crap and a tell tale sign of immaturity), but he's still my president elect.

Sowell's Proposal to Pardon Libby
While I agree that Mr. Libby should be pardoned, let's not so quickly forgive sworn testimony regarding a subject he really wasn't sure about. As an attorney, I tell my clients that when the uncertainty alarm is ringing in their head, however faintly, respond with "I'm not sure". It's a pretty simple concept and may have saved Mr Libby the conviction and Mr Bush the trouble of what would be a very unpopular pardon. BTW, pardon Scott Bloch too!

Mr Libby was tried just to satisfy the liberal left and put stars on Mr Fitzergeralds chest! It was a sham for him to even bring it to the grand jury. He kept the case going cause it kept the paychecks coming. Care what he did to Mr Libby or his family...have to have a heart to care! Fitzergerald doesn't have one anymore then the left that wanted blood!

Everyone knows that the prosecutor knew who leaked the Valerie story, but yet proceeded to make a name for himself...which I've already forgotten...15 mins of fame!! I agree with Dr. Sowell that President Bush should pardon Mr. Libby, but there are others that he should pardon as well...

Not the least of which are agents Ramos and Compean as well as Stephanie Mohr, a former Prince Georges County, MD Police Officer, all of whom were wrongly prosecuted by people looking to make a political statement.

How can we expect law enforcement officers to do their jobs when we cut them off at the knees at the first chance?

I agree entirely with you Dr. Sowell. I have been wondering when President Bush will pardon Libby. He was slaughtered by the left wing liberal establishment and press (as was Governor Palin and President Bush during his 8 years if office). All they (the liberals)talk about is fairness, equality under the law and being open minded; and they are the farthest thing from it on this, and countless other issues. They practice "selective" fairness.

Manufacturing a Crime
All Libby had to do while under oath was to pull a "Clinton". "I do not recall", I do not remember", and he would have been fine. What a travesty of justice that the prosecuter had already known of the person, Armatage, who had leaked Plame's name prior to ever questioning Libby.

Scooter Libby's Memory Failure
Scotter Libby should have kept a detailed diary of everyone he talked to and a summary of what was discussed. It is often said: " A sharp pencil for a dull mind".

Trying to remember important legal facts "off the top of your head" has now been proven to be a very risky proposition for politicans and especially, their staffs.

I hope you can see that President Bush could care less for those who sacrificed their careers or lives for him. I am sure President Bush is glad Scooter Libby served his administration well, but in politics, everyone is expendible. Shall I add this most certainly includes the president himself and the Vice President, as well.

President Franklin Delano Roosevelt once said: " There is no indispensable man". True then, true now.

Obama admits to aggressive illegal drug use over twenty years ago and the media keeps it a secret from most Americans. Yet most Americans know that the spouse - of the Running mate - of the Republican Nominee had a DUI over twenty years ago.
And if "The One" walks down your sidewalk and you have the audacity to ask him a simple question, within 24 hours every less than perfect aspect of your personal life will be unveiled to the world.

I couldn't agree more with your assessment of the "Scooter Libby Case". They missed the mark when they didn't dig more deeply into Wilson's roll in the whole affair. Goes back to the liberal media refusing to look at anything contrary to their viewpoint.

Manufacturing a Crime
Apparently, Dr Sowell and I have the same perspective on this "incident". Hence my extreme confusion when I hear or read articles by the MSM blatantly stating that "Scooter" Libby was convicted of revealing the identity of a CIA agent. I have never -- ever heard or read anything from the MSM that does not state this as anything other than a fact. I have never heard or read anything indicating that it was Armitage that told Novak about Plame. In fact, the name "Armitage", is rarely, (and to the best of my knowledge-- NEVR) mentioned. Nor, have I ever heard or read that Plame was no longer a "CIA operative" and therefore, her identity was not secret. Add to that the ongoing lawsuit against the current administration and-- well, I'm truly "mystified". How can some one of Dr Sowell's stature (and I, of much, much less stature)be so completely wrong?

When is it a crime?
It's only a crime when the Republicans do it. And while he's pardoning Libby, perhaps the president can find it in his heart to pardon the two Border Patrol agents, Compion and Ramos.
