Ungrateful Flyers

The headline in USA Today gave me a sinking feeling: “US Airways Gives Passengers On Flight $5000.00 Each -- Passengers Wonder, Is it Enough?”

Is it enough?

Is anything ever enough anymore?

It is absolutely, positively inconceivable that anyone aboard the miraculous US Airways Airbus whose pilot made a safe water landing after birds were sucked into the engines would expect US Airways to fork over a ton of money to them.

This was one great story: a pilot makes a split-second decision to ditch into the frigid waters of the Hudson River, a decision that saved everyone on board from certain death.

But it didn’t take long for the vultures to swarm, the heads to spin with visions of big dollar signs, and the pure greed to hijack this otherwise-wonderful tale.

One disgruntled flier who got a bloody nose and some bruises says it’s still too early to decide just how emotionally distressed he is as a result of the incident.

“I just want to be made whole,” he sniffed to a reporter.

Already US Airways has written checks for $5000.00 apiece to each and every passenger to cover any and all “immediate needs” they may have from having lost their luggage and other belongings.

I’m a frequent flier who often travels with a laptop, nice headphones, even some partial radio equipment and I know that $5000.00 would more than cover anything I might lose on an airplane.

Furthermore, the airline has promised that their insurance carrier will cover any and all losses of property that exceed $5000.00.

Not good enough, some of these miserable people are saying.

Kreindler and Kreindler, a New York-based law firm that specializes in aviation accidents, reports that “several” of the passengers on the flight have already contacted the firm.

I wonder how long it took those folks to stop thanking God for His decision to spare their lives from what should have been a fiery, horrible end before they Googled the best law firm to sue the pants off US Airways?

I might be a lone voice in the wilderness on this, but I don’t think US Airways owes any of these people one red cent.

If a natural disaster like a flock of birds or a bolt of lightning causes a plane’s engines to fail, you know what should be expected? That the pilot will keep his or her wits about them and do their best to save each and every soul on board.

That’s precisely what Captain “Sully” Sullenberger and the rest of his crew did. They managed to bring a crippled plane safely into a river where everybody got out, safe and sound.

And now, people are grumbling that five grand just isn’t cutting it.

If big, fat settlements result from these greedy passengers or we see a slew of lawsuits filed, this should become the model for tort reform in America.

We simply have to reign in the piggish people and money-hungry lawyers who chase every ambulance they see and expect companies and individuals to pay for everything that goes wrong.

Even hinting about a lawsuit in this story smacks of a shakedown. People are savvy enough to know that simply a threat of litigation is tantamount to a nice, hefty check.

Really, this must stop.

By all accounts, US Airways has handled this entire accident with graciousness and compassion and class.

Anyone aboard US Airways Flight #1549 who considers suing the airline or strong-arming it for more money should be ashamed of themselves.

And worried, too.

Karma can be a bad thing. After all, many of those people might want to take their ill-gotten gains and jet off to some exotic destination to celebrate. And if a flock of birds hits their plane again, maybe they won’t be so lucky.

I'm no lawyer (thank God) but...
Isn't there something called "Force Majeure" that would cover US Air for occurrences like birds flying into the engines?

Waiting for the Regulation
You know that some New York senator or congressman will get the bright idea to regulate all airlines to develop and install bird catchers over their jet intakes over this. I'd bet my house on it.

Why on earth
would anybody not figure up their lost time, medical and material losses and turn it in and avoid these scam lawyers like the plague. If I was the airline company I would take them all to jury and all I would do is save my letters, expenditures and document all efforts to help these people. That way they don't pay one single lawyer. I think juries will deny them one red cent after such a miracle they're alive.

Bizarre
Don't let this go to a jury trial, the members of which would laugh these loons out of the courtroom. Allow a judge to decide NOT to let this go to a jury. And in all the appeals--up to an including the last one to the U.S. Supreme Court--let all judges say a resounding "NO!"

US Air
While I don't believe they owe these people money, they ought to be forced to fork over money to the people who they endangered by allowing 6 Muslim clerics to board another flight -- before they were forced to kick them off -- and for taking in the Muslim families that another airline kicked off for security reasons.

Probably a good bet...never mind that they would later find out that the government-mandated bird catchers disrupt the air flow, resulting in stalled engines.

Anyway, even though US Airways is not on my list of favorite airlines, I think they're being more than reasonable.

Heck, for $5000, I'd say go ahead and crash-land my plane!

It's a good thing that you have reminded people of this. A lot of people never think about it. And you are right. The airline owes these moochers nothing.

Anytime someone boards an airplane, they are taking a certain risk, and they know this. Things can go wrong that have absolutly nothing to do with the accountability of the airline.

Shame on all of them.

Silliness
The passenger to whom the quote "I just want to be made whole" is attributed is my personal favorite. Could he explain why he is not "whole" after a successful crah landing which left him alive and physically safe?

USSA - Loser Culture
America has turned into the most litigating culture in universal history.
Lawyers, parasites, have caused the demise of our economy and culture.
Today the highest cost segment of doing business in America is the legal one. This inhibits business more than frivolous regulations (also mostly lawyer based) and even the highest corporate taxes in the industrialized world.
We desperately need tort reform and term limits for congress.

This whole thing just leaves me speechless.

By the grace of God, and a crew that "simply did the jobs they were trained to do" the worst that really happened to these passengers was that they got WET!

Instead of whining and calling lawyers, they should be on their knees praying, and thanking God they're still alive!


Ungrateful Flyers
If anyone files a lawsuit, I pray that they don't receive one single penny. There was no negligence here; instead, due to an act of nature, a plane lost its' engine power, and an incredibly skilled pilot brought the doomed airplane to a safe landing in the Hudson River. Dear God - what a miracle that is! Let every passenger bask in their second chance at life instead....

Acts of God
This incident is a perfect example where there was no human means of prevention. The environmentalists complain when noise canons are used at airports so airports, especially those near water, are susceptible to this problem. One more time we get to see lawyers & greedy narcissists in action. Where will this end?

USSA - Loser Culture
Egon, I think YOU hit the nail on the head with "CULTURE"! The problem here is NOT the passengers OR the law firms. Its the "Sue thy neighbor" culture we have cultivated in America. My opinion is that this all lies with the judges ability to simply throw out frivilous suits and I am NOT saying this airline situation is frivilous but in general, there are 100s of 1000s of rediculous suits that have no business in a court that get rewarded MILLIONs$$$. This must stop.

"Flyers" ???
I don't know why Townhall chose to use the variant word "Flyers" in the title, unfortunately maligning Gallagher's hometown Philadelphia hockey team instead of the "fliers" that were aboard the ill-fated flight.

No good deed goes unpunished
I know now that some of the lowest life forms on the planet were aboard that flight and now the absolute lowest forms are representing them. I bet all involved are liberal, progressive, socialist or marxist. The clients involved in this lawsuit are not human. I pray that none of these protozoans make a penny. I also would like to see the airline counter-sue for harassment. I would gladly serve on that jury. How do you sue a flock of geese?

After Jesus miraculously cured all ten--only ONE even came back and thanked him!
This is not a new attitude; simply the way many people live their lives: With their hands out for anything free, and wondering what the world has done for them LATELY...
This was a bonafide MIRACLE--and $5000 should have covered ANYthing that was lost! I wonder how many of those ungrateful wretches thought to even thank or say a quick prayer for the pilot--who did something that NOone else in history has ever done--in order to SAVE their ungrateful butts??
For that matter--how many had bought flight insurance? Maybe that policy should suffice? AND if you didn't--then tough luck.
As was said elsewhere--there was NO negligence involved here--and pilot error CERTAINLY didn't occur.
I think these people should never be allowed to fly again--if they sue...

Ungratfull is right
The people on the flight should be thinking GOD that they all made it out alive instead of wondering just how much they can take the airline for.

Poeple and thier law suites is one of reasons things in this country have gotten out of controll price wise. The comsumer does not realize that when they sue a company that they have to get the money from someone and whereelse are they going to get it. That is right we the people pay for it everyday at the checkout counter.

Withholding judgement
I shall wait until the NTSB final report before making any judgment in this particular case. Did birds really disable both engines? Last I heard, only one of the two engines had conspicuous evidence of organic material (bird remains) in the engine core.

However, I do agree with the majority of of posts here, that we, the people, have developed a sue-thy-neighbor mentality. Tort reform is required, but we won't see that with the current administration.


Amazing
I don't know why it surprises me when I read stories like this, but it still does. I guess I'm holding out hope that people would realize that their lives are the greatest reward out of this extraordinary ordeal. The lawyers taking these cases should be ashamed of themselves. If you look at it objectively, it is these passengers that owe the pilot a huge debt that they could not possibly repay.

You're not alone...

US Airways, by hiring "Sully", a qualified pilot to fly thier plane, saved those peoples lives. They should be thankful. Unfortunately, not many people today remember to be THANKFUL for anything.

Filthy Words...
Gratitude, personal responsibility: these have become filthy words in our culture. These ideas may not be dead; but they should be on the endangered species list.

"Made whole"? Make yourself whole. Take responsibiity for your own passage through this experience. No money, no other person can make you whole.

Heroes take challenges like this and turn it into the stuff of wisdom. This is the type of life adventure that creates leaders; if you look at it as an adventure. This process of finding the positive in any disaster starts with gratitude.

LOSERS with a big L
I'm all for customer service but this is outrageous. Other than replacement of lost property, these people deserve nothing! The problem here is that the people who need to read this column won't. The people who would never do something like this are conservatives who actually READ and have a brain.

Watch out for flocks of vultures
And now U S Airways will be flying into flocks of vultures. Sure, these lawyers want to "help" the poor, distressed passengers -- for a mere fee of 40 -60 percent of any settlement. And be assured that the fee will be taken off the top before the living "victim" sees an single penny.
Pitiful. The only cure for these outrageous lawsuits is a system in which the loser pays. That would keep the vultures from swarming.

Why be surprised?
Former Texas Senator Phil Gramm is definitely no "saint" when it comes to his role in the current "Wall Street Crisis" - but one thing that he was 100% right about...This country HAS become filled with ungrateful whiners and complainers! Way too many people see themselves as "victims" of some kind - and it seems like almost EVERYONE has their hand out for the "freebies" that they have come to think they have a "right" to.

But, having worked for a major US airline many years ago (based at LGA) and being married to a commercial, then corp. pilot, I can tell you that the airlines do their best to hire the best, and all the pilots go through rigorous training and FAA testing on a regular and frequent basis.

What "Sully" said was true:

"It was circumstances that put this experienced crew of that plane on that particular day, we were simply doing the jobs we were trained to do."

BTW, my husband is now an attorney... and his only comment was, "Should one of those passengers come into my office with thoughts of suing US Air... I'd throw them out on their butt."

Pathetic
Aren't we just a Nation of pathetic, whining babies? And it should be no surprise that some predatory law firms are there to cash in. There was a time when lawyers were not permitted to advertise, this all changed in the late 70's, it was a HUGE mistake. I hope there is a brand new circle in Hell just for those greedy pricks. No surprise that this nation is headed down the tubes. I hope these characters are all wearing their little bicycle helmet's as they go! Shakespeare was right.

Airline Passengers
If anyone should benefit from oodles of money it should be the Pilot and crew of the downed airplane. When I travel I have nowhere near $5000. worth of property with me, and I am a "typical" occasional flyer. $5,000. per passenger -- $10,000 per couple -- $15,000 for family of three and on and on -- -- this is disgusting. The guy who wants "to be whole again" -- I think he has bigger problems. Next time these passengers fly -- get flight insurance. This country is in dire need of tort reform. I hope there is a judge who refuses to take these cases.

To the guy with a bloody nose I say, if he wishes to sue I will be more than happy to come over every day and punch him in the nose just to prove to him that he is still alive and that´s payment enough. To all the passengers, get a life!

How anybody can think it was the fault of the airline is beyond me. I marvel that Captain Sullenberger was able to maneuver a powerless airplane past the city and land it where it did no damage to anyone. What is a bloody nose or a broken bone when they are compared to the tremendous loss of life there would have been had he been unable to land in the water?

The airline has already done more than it is obligated to do in giving each passenger $5000.

Unbelievable Tort System
The passengers should be thanking God for their lives and looking for ways to make their lives useful to others since they were saved with minimal injuries. This mentality of trying to find a pot of gold every time something happens is absurd and as was stated in the article, VERY BAD KARMA. We reap what we sow and greed has caught up with us in a very glaring way with the current economy. I believe that a person who brings a lawsuit should pay all court expenses as well as the expenses of the defendant if they lose. Also no lawyer should be allowed a percentage of proceeds but only charge a fee for services rendered which will be paid by the plaintiff win or lose. That would cut out a lot of unwinnable, frivolous lawsuits and would make companies more likely to not cut checks for nuisance suits.

Jury Judgements
It would never occur to me to sue a company that miraculously saved my life in a situation that was totally out of their control.
The only reason any of these people are thinking of doing so is that they are greedy and think they can turn this into a money-maker for themselves. Shame on them!
Yes, changing the laws can help, but will it happen, and how long will it take? Another way is for juries to take control. If juries would stop awarding outrageous amounts in cases where it's not warranted, then it will stop being worthwhile for lawyers to pursue anything other than realistic cases. We have to stop waiting for government to solve all our problems. We, as citizens sitting on a jury, have the power to bring these lawsuits under control.

Ignorance goes a long way
You are right those people should just be thankful everyday they still have a chance to live and make wrong mistakes right. How dare they even think that they are worth more than anyone else. If it was not for the pilot, co pilot and flight attendents they would not even be here. As for the ones who are thankful and have not thought of being ungrateful bless you.

How Modern Law Makes Us Powerless

Customer Service,
Its right, from a customer service standpoint, for an airline to compensate customers for their losses after an accident.

Its wrong, from a moral perspective, for whiny, self-centered toddlers in grown-up clothing to obsess about how traumatized they are instead of being grateful to have a life to be getting on with.

Our pioneer and immigrant ancestors, who routinely overcame challenges and setbacks with little more than their personal toughness and a forward-looking spirit, would be deeply ashamed at the weaklings who abound in our current society.

A male person who is busy trying to decide how "emotionally distressed" he is instead of taking practical steps to make sure that any family he is responsible for is cared for if he isn't so lucky next time and otherwise engaged in turning the experience into a stepping stone towards becoming a better person doesn't deserve to be called a "man".

Maybe his mommy can give him a nuk, wrap him in his blankie, and cuddle him up to his teddy while she reads some politically correct, non-traumatizing story to him.

Yes, those passengers will probably have nightmares. They'll probably try to avoid flying when they can. They might even become fanatical goose hunters. But you have to be alive to have the nightmares and you ought to be grateful for that gift.

Airline Passengers
I totally agree with every word Mike Gallagher wrote in his article.
I think it is absolutely disgusting that anyone would be so shameles and greedy enough to sue and not be grateful for their lives being saved.
I wish the grateful passengers would speak out more and voice their objections to these law suits.

Some thoughts...
For all of you who are so sure that a jury would never give any money in a case like this, are you forgetting Stella? Remember the nice old lady who decided to add cream to her coffee while riding as a passenger in a car? She dumped the coffee in her own lap, and then sued McDonalds. A JURY, not an activist judge or a greedy lawyer, but a JURY of normal Americans gave her over 3 million dollars! For dumping coffee in her own lap! If her attorney was getting the average contengency fee of 40-50%, he got about 1.5 million.

Here are some thoughts on how to actually fix the problem:
1- If a party loses a lawsuit after it goes to trial, they should be required to pay the other side's attorney fees. This will reduce the number of frivolous lawsuits, and give innocent parties an incentive to fight frivolous claims, rather than settling in order to avoid expensive legal bills. It will also encourage parties that are obviously in the wrong to settle earlier, so as to avoid paying attorney fees.

2- If an attorney takes a case on a contingency fee basis, the attorney should be responsible for paying whatever percentage he is charging if his client loses. For instance, if an attorney is charging 40%, and his client loses, the attorney should be required to pay 40% of the other side's attorney fees. This will greatly discourage attorney's from taking on frivolous cases.

3- Prohibit the plaintiff from receiving any money from punitive awards. All punitive damages should be used to pay for public defenders. This will reduce the incentive to sue at every whim, because there would be fewer chances to get rich quick.

Mike, I have your back here
I remember a time in America when most people used their hands to work with, unlike now, to hold them out for a hand-out whenever the opportunity arises. The lack of character displayed by so many is sinking this ship far too fast.

UnGrateful
It is people like this that have shoved our Nation into the economic crisis it is in.

"I just want to be made whole"
Well, don't we all!! Here's the thing: he wasn't whole before he got his nose bloodied, and he won't be whole no matter how much money he gets from the airline. He will just be rich, and no better looking. We all want to be whole, but life doesn't work that way. My back hurts every day, but should I try to think back to when I hurt it and sue the employer where I worked at the time? Of course not. Too many americans are expecting a discomfort free life and want to hold someone responsible when for all their discomforts. A lawsuit against U S Airways is, in my opinion, a lawsuit against the pilot, who heriocally saved their lives. But, that apparently was not enough!

What They Are
The passengers who questioned the inadequacy of any payment from the airlines are registered democrats. They show the result of parental abandonment and retarded social development.

This is why liberals sit in their high chairs and pound the serving trays in front of them and fling their Gerbers baby formula all over the place.

The airline ought to identify these ingrates, drive them back out into the river and toss them in.


Who Owes Whom, What?
US Airways owes the passengers cab fare or an airline-provided shuttle ride, perhaps overnight hotel stay, a ticket to their destination via the transportation mode of their indivudual choice, lost luggage and personal items if any were lost*. Offset that with the thrill of the ride - many would pay big bucks for that at an amusement park, rescue boat rides - again many pay for boat rides on the Hudson, maybe souvenir flotation devices and blankets taken by the passengers, their 30-seconds of fame in media interviews, remaining lifetime of stories to tell, possibly book or movie royalties, the opportunity to meet the heroic pilot, other aircrew and first responders, the passengers having their mettle tested, and the value of the very lives of the passengers. The balance is zero, or the passengers owe the airline.
A bit more seriously the passengers are owed ground transportation, perhaps overnight hotel stay and transportation to their destination.
*Much if not all of the luggage and personal items were recovered most likely. Sensible passengers pay the small fees for trip, luggage and personal items insurance as part of their travel costs.

Limatations of Liability

I was a ticket agent for 32 years. The agreement that you enter into when you purchase transportation from an airline contains what is known as the "limitations of liability". These used to be printed on the back of the paper ticket. These state what the airline will pay in the event of the loss of life, limb or personal belongings. Thus the airline does owe them that but in my opinion nothing else.

nothing new
More than 15 years ago I was on a commuter train that crashed with another train. In that case there was some negligence involved and 6 people died. But the first thing the train people had to do was get the name of everyone on the train because they knew otherwise they would have to deal with lawsuits from people pretending they were on the trains.

I got a call that afternoon offering me $100, which since it covered my losses I accepted. They had someone at the door with a check within the hour.

Despite this I was made part of a class action law suit for a while until I had to actually say whether I wanted to be in or out and said out. After that I lost track of what happened with it.

In this case there were specific individuals (or their families) who were seriously harmed and deserved a payout. But the class action nature was for people like myself who were more shooken up than hurt and should not have been taking away attention from the truly injured.

In the USAir case, people were seriously inconveniences. And I wouldn't minimize the harm from going through such an experience. But if it was a fluke incident they are not entitled to anything from USAir. But then before the analysis of blame is done, it might not be an imprudent bet to turn down the $5,000 in the hope that some negligence is found. I suspect I would have taken the $5,000.

Unmitigated GREED
Unmigated greed, selfishness and NO personal moral character is rampant among 'Americans'. Most are American in name only, not the people who built this nation. A bunch of whining, sniveling, lilly-livered, little zeros.

Look at the photos and you'll see people standing on the wing, some WITH their carry-on luggage, using their phones while the rescue boats are still on the way. ??????? How many had visions of dollar signs dancing through their heads even at that point? Disgusting.

I read that one woman, wearing a fur coat, even asked a man to go back into the a/c to fetch her purse for her. Don't know if he did or not.

Especially your last paragraph! We have become a nation of give-me, give-me, give-me. And until we become a nation of appreciating all the good things we have been given I don't expect it will end. Excellent ariticle and you are not a lone voice.

US Airline Survivors
It is incredible, the greed of the American public. How anyone one this flight could even consider suing the airline is astonishing. All of these passengers should be thankful that the pilot and crew were competent enough to bring this airplane down successfully without any major injuries. We definitely need tort reform so that these types of frivilous lawsuits would not be available.

What???? No one blames Bush...
Come on, he must of forgot to regulate something...it has to his fault...it just has to be...SUE HIM.

How quick to forget
Only the hand of God and the utter composure of a pilot who quickly responded to all of the emergencies in this flight, from the first engine stopping to the second engine, over a crowded densely packed city placed this plane in the only place possible for the people to have a chance to survive.
It seems in this country, the first thing after being placed in safety is to bite the hand that feeds/saves them.
Much like the nation as a whole. What is so amazing to me, is how God can be so patient with his creation man.

Their Life Was Not Enough!
Wonder if any of them thanked God that they are not DEAD! Instead of wanting money they (the passengers) should give the pilot a a nice check for saving them.

People in America need to learn how to be grateful!

Ungrateful Passengers
I'm surprised that the Lawyers didn't brave the frigid waters of the Hudson to get to the passengers before the Ferrys. With the Liberals in charge of the Country we can expect much more of this, and a lot of action in the area of Employment and pay scales.

US Airways Litigation
I am amazed at the mindset of people who think they must be compensated for any bad thing that happens in their lives! Or maybe it's just plain greed -- I don't know. Anyway, these folks have been well compensated for their losses and should be on their knees thanking God for the wonderful crew that saved their lives! If they could, they would probably sue God himself for creating the birds!!

4. I need water to take a pill, just after boarding from a terminal where water is available in abundance.
5. What exactly does free alcohol mean?

8. Will you help me put my bag in the overhead bin? Or can you store this somewhere for me?
9. On my last flight ....
10.Want a back rub, foot, hand, arms massage, or will you give me one?
11.When will we arrive (immediately after boarding)?
12.Can you break a $100?
13.Where are we?
14.Hysterical, screaming, crying babies.
15.Is this really a no tobacco flight?
16.May I have a mixer for the alcohol I brought with me? [FAA rules prohibit bringing alcohol on board a commercial flight, unless you are a pilot or other crewmember :).]
17.Is it illegal to use illegal drugs on this flight?
18.I am allegic to animal hair (from a passenger seated next to another passenger with a pet in a carrier).

The lady experienced third-degree burns over 6% of her body and lesser burns over 16%. McDonald's required franchises to serve coffee at 180 to 190 degrees which would cause a third degree burn in 2 seconds.

Look at the example
That was set when the government paid millions to families of those killed in the WTC bombing. That was a tragedy, but the taxpayers in the US were not at fault in any way and people die tragically every day in a multitude of ways.
Despite the millions paid out, to some of those folks it wasn't enough, and they are still complaining.

Geraldo Rivera was on Fox this morning saying the US Air is not doing enough to compensate the passengers. He has a report that there were problems with the engine stahling on take off on this particular plane. Although US Air has stated that the engines were repaired the Tuesday before, Geraldo is demanding a full investigation. He may doing his job looking into this, but is it his place as a reporter to say they should be getting more compensation before investigation is finished?

Not All of them Feel That Way
A friend of mine had a partner who was on that plane. He was at the rear of the plane and while he waited his turn to exit, the water rose from his knees to his neck, and he thought it was all over. After he got out, he stayed as long as he could to help others off the plane. I understand he does not feel the same way the litigious passengers do.

Hope I'm never in that position, but if I were I hope I would react the way that gentleman did, and I believe I would write a letter of thanks to the pilot and to the flight crew (who also apparently performed with grace and courage).

I think they set a bad precedent by sending out the $5000. I think the airlines liability would be limited to a refund of the ticket, actual loss of property, and transporting the passengers to their destination and maybe a days wages for the delay. Tort Reform
Don't expect any type of Tort Reform for at least the next four years, since the party in power is totally owned by the trial lawyers.

Until we introduce the idea that lawsuits are not lottery tickets, we're going to see ton's of these frivolous cases. I would be very surprised if we didn't see any lawsuits by the ingrates on that flight.

This story saddens me,as well as reminding me of the fellow who had a bone suck in his throat. He was in great pain and went to a top surgeon to have it removed. After wards he ask the surgeon how much he owed. To which the doctor replied "let's settle for one half of what you would have been willing to pay me when the bone was stuck in your throat." McDonald's coffee lawsuit
I agree we are too quick to sue, thinking we'll discover the pot of gold at end of the legal rainbow. All of these passengers ought to be thankful they are alive. Remember that the circumstances largely dictated the outcome of this incident...had there been a double bird strike 300 feet above the runway at takeoff, the outcome could have been very different. Captain and crew did what they were trained to do and did it well.

However, corporate malfeasance is real, and there has to be a method to force companies to protect their customers when they ignore a problem. Such seems to be the case with the McDonald's coffee lawsuit, since over 700 incidences of coffee scalds were reported to the court and some of those resulted in third degree burns.

There's more to the McDonald's story than you think...my first thought was "greed is at it again", years later I discovered the facts and modified my view. It was not as simple as I had thought.

Google it, get the facts, and then make up your mind.

That's the problem - it's the lottery mentality developed by the likes of lawyers and Geraldo.

I am a pilot and every pilot knows that flying is always a risk. Passengers getting on a plane know there is always a risk. If something happens even mechanically (if Geraldo is right - so what? The liability isn't any greater because one can never guarantee there will be no mechanical malfunction) there isn't any place to "pull over." How many drivers are allowed to sue the automaker when they have a mechanical problem that forces them to pull over to the side of the road?

The passengers took the risk knowingly. The engines failed as is possible. The crew did an outstanding job saving everyone. The airline is doing their best to compensate. Where's the legitimate complaint?

What about the Muslim passengers who are suing our airlines because security is doing their job and they feel that they shouldn't be subjected to the same security laws for the safety of the people based on their behaviors or comments during flight? The American people are now searched and interrogated and inconvenienced and thrown off planes just the same as Muslims who are questioned by security and that should not result in lawsuits and public apologies since prior to 911, we never had to undergo any of these inconvenience security laws that apply to everyone and doesn't target them because they are Muslims, but because its the jobs of security to ensure that any complaint or behavior is investigated for the safety of all our citizens, yet they sue our airlines even though the American people are subjected to the same laws. Just paying for the Luggage
My understanding was that the $5000 was to pay for luggage and carry on baggage lost or destroyed by water damage. While not required, it's a nice customer service gesture on the part of the airline.

If passengers actually have the gaul to sue US Air over this incident, or bloodthirsty lawyers start making claims for "mental anguish" or "unnecessary pain and suffering" from the incident, then I think the airlines should just make a list and ban these folks from ever flying on a commercial airline again.

It is simply wrong to take the airline to Civil court and try to sue them over something like this! I mean, come on it is just plain wrong! Ok, I agree that the airlines insurance company should cover the losses of personal property and such – that is what insurance is for after all. They can even cover documented cases where people had to seek therapy for the trauma. I can buy all that.

What I CANNOT buy is for people to go beyond that and try to SUE the airline for something that was beyond their control! Coffee and Airline Crashes,
Coffee is hot enough to burn. Period. All mentally competent adults (and most 4-year-olds for that matter), know this.

If the cup is not defective and the employee did not throw it at the customer the coffee supplier's responsibility for what happens to customer ends when the customer first takes possession of said cup. (Though good customer service usually means that a cup spilled before the customer leaves the restaurant will be replaced).

All forms of transportation sometimes suffer from accidents. All mentally competent adults know this.

The usual result of airline accidents is mass death. All mentally competent adults (and most 10yos), know this.

The only legitimate reaction to a mentally competent adult who complains of burning herself on coffee is, "Well, what did you expect? You should have known better."

The only legitimate reaction to mentally competent adults whining about emotional distress and complaining that the airline's generous customer service offer of $5000 or the full value of the lost goods (whichever is larger), is, "You ungrateful jerk! You should be thankful to be alive to complain!"

has nothing to do with what needs to be done to assure this does not happen again. That is what litigation is designed in part to do--to determine what went wrong and how to fix it. Litigation is also designed to pay people damages. If someone lost a computer, clothes, etc, that might exceed $5000.

But US Air needs, as do all airlines, to be pushed for optimum safety procedures, as should the feds. Were the birds observed by others? Should the flight have been canceled or delayed? I was on a flight one time. They de-iced the plane in the middle of a snowstorm. Then we sat, and sat, and sat. Pilot announced that we were then going to take off, way after the de-icing. Turns out he was violating policy. A number of us made such a stink as the plane taxied, almost a rebellion. The attendants told us that the 'pilot knows best', what nonsense. Finally, the co-pilot came back, looked at the wings, and guess what? They turned the plane around and de-iced before an immediate takeoff. We might have crashed but for the passengers getting upset. Had we crashed, I'm sure Gallagher would have chastised our survivors for suing.

You have a good counter-example, but what you are describing there was clearly negligence on the part of the pilot and crew. I see nothing in this case that even remotely hints at any sort of negligence. I am a liberal democrat but even I think these law suits are ridiculous.

In order for a law suit like this to be allowed, there should be evidence of some sort of negligence or trouble that they should have been reasonably able to foresee. In the absence of that this is a frivolous law suit which is based on greed.

Now I am all for improvements. If this case shows a need for some kind of protection against this in the future, great they should do it. But that is NOT the same thing as negligence and it does NOT justify a law suit. A case like this should be used for something positive – like researching a way to avoid it in the future.

ca; jet engines are essentially very large fans that push air to ignite the fuel and provide thrust to get and keep the plane airborne. As has been previously posted, any cage, screen etc; if birds or other debris were tapped against it, would still block the air flow directly. If birds are ingested into the intake, either the air flow is blocked or enough blades are broken off of the fan to reduce or stop air flow. Engineers have been experimenting with intake guards for years and unfortunately, there is no effective solution.

I'm sure that in the situation you encountered, that time window was probably closing and that's why the crew member came back to look at the wings. I am so tired of people who act like the world owes them. They should be thankful enough to be alive and on top of that the airlines are giving them $5,000 per person. Now we have a new bill that says that all women should be paid the same amount as their male counterparts. Well, I had plenty of jobs where I wasn't paid as much as men. They just need to get over it. Life IS NOT FAIR. These people need to grow up. There is no way to make everything fair. Anybody that has had more than one child should know this. The personal experience you offered would have been one of pilot neglegance, not a random natural occurance, like the birds in this case. If your pilot had taken off and there were a crash, that would have been grounds for reimbursement. These people are just trying to get something for nothing.

Something I noticed
In the news reports it was commented several times that many of the passengers had hit their heads on the ceiling when the plane hit. Alaskans fly a lot -- I'm approaching a million air-miles on commercial flights, in addition to small aircraft. My brother has closer to 2 million. There is absolutely NO way to hit your head on a passenger liner ceiling even during a crash landing unless you weren't buckled in. I think US Airlines should be suing some of the passengers for violating inflight rules. They weren't even done with the ascent and these people weren't buckled. How stupid can they be?!!!

Anyone who flies a lot, like I and just about everyone I know does, have had experiences like yours. Some pilots just shouldn't fly in icy conditions and maybe that should be posted on their pilot's licenses so that airlines don't use them in such conditions. However, bird strikes are totally different. That's not about pilot error and even if someone had observed the birds before, there's a great deal of difficulty going out of a major airport in suspending takeoffs because a flock of birds happens to be in the area. Kennedy and Newark already have enough flight delays; this would bring air traffic to a halt.

Besides, litigation won't accomplish anything that the NSTB can't accomplish much more efficiently. The NSTB can go over the evidence and issue a ruling and, if needed, direct the airlines in a rehabilitation of procedures or machinery. And, US Air will still be able to afford that rehabilitation. What litigation does is argue over subjective issues like pain and suffering and then make the airlines give money to the passengers so that they are less able to afford rehabilitation of machinery or procedures. In most cases, litigation causes a reduction in safety, not an increase. If someone had died or been seriously injured, US Airlines might be liable, but as it is, nobody controls birds and the safety issues will be addressed by cooler heads than those belonging to trial lawyers.

Slap the Lawyers

US Air Passengers
What part of "you got your life back with only minor injuries" don't these people understand? It was an ACT OF GOD. And these people should be thanking God that "Sully", a great crew, ferry drivers and other civilians were all in the right place at the right time to save them. If any of these passengers sues the airline, they are morally bankrupt.

Thoughts from a trial lawyer
For what it's worth, I am a civil trial lawyer and here are a few of my thoughts:

In general, I agree with Mike's sentiments about what should and should not happen, assuming the full investigation bears out the facts as they appear to be at this point. That is, if the accident was simply the result of an unlucky encounter with geese, the airline is not at fault and owes no one anything.

Further, whether the airline is at fault or not, the offer, prior to a fimal determination of fault, of 5000 dollars, apparently with no strings attached, to assist people with immediate needs is a stand-up thing to do. I have not yet been able to verify it for certain, but it does not appear the airline is requesting releases in exchange for these payments.

Finally, if a thorough investigation reveals that some negligence by the airline, in engine maintenance, for example, probably caused or significantly contributed to the incident, people who sustained more than 5000 dollars in damages should be compensated by the airline for their full damages. (Remember the story about the engine stall on the same plane flying the same route a few days earlier, which of course is probably just a coincidence, but may not have been.) If the airline, at that point, refused to honor its legal and moral obligations, litigation would then be justified.

Matlock in Tx, I am not a lawyer like PVZ in La but I believe that I am correct when I say that the ACLU is supported solely by fees from practicing attorneys, not the government. In addition, the ACLU does not enter into a case unless it is determined that a violation of the constitution has occurred. That is why you will see them defending a black man when a cross is burned on his lawn or a cross is placed in the courthouuse. At the same time, they will defend a white man for burning a cross if it is a violation of his freedom of speech rights or if someone is prevented from praying on a street corner. It´s easy to blame the ACLU for everything, but they really exist to protect your rights.

If I were one of the passengers, all trauma aside, I would be relishing ever breath of air, every bite of food, etc.. as I would certainly have beaten a certain death. I applaud the pilot and the airline for their quick response to first the birds being sucked into the engines and second a cash settlement that should take care of most cases. I am sure that if there is anyone who has large bills becaus of the accident that the airlines will make good. People are too quick to sue for damages these days. I agree the people on board should be grateful to be alive and be thankful they had a quick-thinking, seasoned pilot.

An Admission of Guilt
This could be construed as an admission of guilt in a lawsuit by someone who is greedy and doesn't realize how lucky they are that their fight crew was so well trained. This was what they call an act of god and the only thing that is owed is that the passengers owe these people their lives.

You want REAL tort reform? Let's change the law in this country so that the loser in ANY court case pays the attorneys on both sides. Why should the innocent have to pay dearly just to prove it? And this means on the civil side AND the criminal side. The cops need to have their ducks in a row before taking someone to court as well. Turning Misfortune Into Windfall Profit
I agree that $5000 is more than generous and should cover the cost of any real damages suffered by passengers on flight 1549.

I'm not a lawyer and don't really know what the airline is legally responsible for in event of an accident. Since there was no serious injury or loss of life it seems reasonable to me that the airline would be responsible for all real damages suffered by it's passengers. In this case, that is pretty much restricted to costs incurred rebooking flights not provided by US Air, hotels, lost luggage & personal items, plus paying for doctor/hospital bills for those requiring medical attention.

Paying each passenger $5000 is probably much easier than requiring them to produce documentation of actual expenses incurred. That approach places the burden of proof on passengers and is a logistic headache for all parties.

US Air has performed nothing less than admirably through this entire episode and does not deserve to be sued by greedy lawyers and passengers out to make a quick buck!

As stated elsewhere repeatedly--yes, we have insurance for "acts of God" like floods and tornados--but ya know what? You have to actually BUY it for it to pay off!
The Insurance Co. is betting that they can collect their premium and not have to pay off; thereby making a profit.

These people are just greedy and they know that it will be cheaper for the airline to settle than it is to fight them in court. This practice that is used to save money also ensures that shakedown artist always get a nuisance value settlement. The airline should do two things: 1. US Air should fight every suit that is filed and 2. The should file a countersuit for abuse of process and harrassment and damages to their reputation. I have made it a practice to countersue every single time a suit is filed against me. Like much in life, there is the "good" and the "bad". Unfortunately when it comes to lawyers, the majority are blood-sucking leeches. A little known tactic of some of these blood-suckers is the "client sell out". Having a daughter who almost died due to a doctor's incompetence, she consulted a law firm that after a review of her medical records by a panel of experts, told her she had experienced a clear case of malpractice. They would pursue the case as a result. Ten days later they notified her that they would not pursue the case because it wasn't a winner afterall. My daughter happens to be a nurse, and in talkng to a surgeon where she worked, he told her in all probabilty the insurance company paid off the law firm to drop the case. He said this is not uncommon. Yes, she could have gone from law firm to law firm, but at what expense and time given she had to pay for the so called expert panel's time? The most important thing though is that she survived, because there isn't enough money in the world to compensate for a loved one's loss.

First of all there are things for which an airline is responsible and for which they should compensate their passengers. But as in other pursuits of life, there are inherent risks that we assume when we fly. They are things that are outside the control of the pilot and the airline. If in this case it turns out that engine failure was the direct result of birds being sucked into the engines that is one of the risks we assume by boarding an airplane. Airports are doing everything they can to prevent such things, but no program thus far has been sucessful in eliminating the danger. So don't sue the airline or the airport. Sue the geese.

This crash landing was about as smooth as it could be, thanks to such an experienced pilot and crew. These people need to thank God, thank US Airways, the captain of their plane, and change their attitudes to one of immense gratitude!!! Airlines Sued For Saving Lives
Americans file more lawsuits than any other country in the world with the encouragement of lawyers who receive the bulk of the judgment rendered after trial. In some cases, these lawsuits cause American corporations to go out of business. There are corporations who end up filing bankruptcy after they're sued and ordered to pay out outrageous amounts of legal awards, some times rendered by juries. Foreigners from the Middle East who have been removed from airplanes after allegedly making uncomfortable comments on American airplanes or foreigners whoare searched (just like every American boarding a plane after 911) are suing American airlines and America's many corporations for "discrimination" even though Americans are subjected to the same treatment by security. Investigators say they have to weight "all items in their current state, dry them for eight weeks and then weigh them again," which could take up to 8 months.

MEANING, the AIRLINES, due to the TIME FACTOR, OWED ALL PASSENGERS at LEAST $3,300.

So $5000, Is just one HECK OF A POOR PR STUNT.

Just watching the survivors interviewed on TV, I knew which of the whiney ones were going to sue. What happened to feeling gratitude for
living another day? Its all about greed. The
trial lawyers are a sorry lot. Its also all about a generation of losers who think that what's yours is mine and whats mine is mine.

The Short Version
In 1990, I ended up as a relacement ring announcer for a World Wrestling Federation show in Salt Lake.

The feature match was between the champion Ultimate Warrior and "Macho Man" Randy Savage.

Through no fault of my own, I inadvertently claimed Savage the new world champion after the ref told me he was winner by count out. The words were barely out of my mouth when the Ultimate Warrior sent me flying through the air with a forearm shiver. Turns out title doresn't change hands on a disqualification.

Who knew?

Lawyers were lining up at my door the next day like coyotes. WWF president Vince McMahon called me personally. Even though I could have easily sued and won for a million or two. I wasn't badly hurt(thankfully they're trained to pull their punches), so I settled for a quick $25,000.

My lawyer was disappointed I didn't go for the big prize.

Fatal Flight?
I have heard that this same plane had engine trouble two weeks before. Coincidence? I have also wondered why the captain was kept away from his family for several days.

The plane is now in isolation and under guard. Just seems like a lot of unanswered questions to me. If the cause was geese flying into the engines,why the secrecy?

Ungrateful passengers
The passengers ought to be grateful that Captain Sullenberger saved their lives by thinking fast and landing the plane on the Hudson River with NO fatalities. Suing the airline for a minor inconveince in the words of Vice President Biden "is unpatriotic".

Liability should be mute...
in this case. The pilot saved lives by doing something that no one else has done beore. He ditched a plane and saved all the lives. He did all that he was supposed to do and beyond. I hope no one sues him personally.

Miracle on the Hudson
You are not alone on this. You echoed my sentiments, thank you very much. On the day of the accident I told my friends and relatives that these people were very lucky and if they ever thought of suing the airline, I would be very angry. So when I heard that some are contemplating of suing, I was so mad my blood pressure shot up. I hope no judge will take their case or dismiss it in a second.

No liability involved
As a long time claims adjuster I can safely say there was no negligence by US Airways. There was nothing the airline could have or should have done about the geese or birds that wrecked the engines. Therefore there is no liability against them.
Any passenger who was on that plane should be grateful to God and the pilot and crew for the proper actions they took in preserving their lives and limbs. If any of them are demanding more money, they need to have their heads examined.

US Airways is not to blame
Bravo Mike, I couldn't have said it better. Evidently some people feel they need to be compensated for "mental anguish" resulting from the traumatic experience. How many people survive extremely frightening situations due to acts of God like tornados, earthquakes, firestorms, and floods every day, and are just thankful for still being alive? This also was an act of God, but the difference here is that there is somebody to sue - the big corporation with bags of money. Sure they have insurance, but just like the rest of us, their rates will greatly increase after a claim like this. TWA never recovered from their flight 800 which blew up over the Atlantic just after leaving NY. The airlines are all on very shaky financial ground right now, so a lawsuit could put US Airways' future in jeopardy and ironically harm the career of Capt. Sullenburger, the very person to whom they should be eternally grateful. In my opinion, the passengers should take up a collection and give the money to that crew for saving their lives.

I could not have said it better myself. I am logging on to their web site today to write a letter to the airlines and encourage them to stand up to this crap!

Who would have ever dreamed that a jet could be landed on water like a seaplane?!? If someone had suggested a possibility like that only a few weeks ago I would have thought they were crazy! But somehow this pilot and his crew has the absolute skill and courage to pull off the impossible and not only land a jet on water but do it with no engines!! The pilot and crew are absolute heroes!!

I’m sure most of the passengers are not in on this, just the greedy few but unfortunately sometimes all it takes is a few to totally screw it up for everyone.

I heard about the NTSB report as well. The airbus engines were flagged and the same plane had a stall in a climb only two days before. Are you also aware that the NTSB cleared the plane to fly? A friend who is an Alaska Airlines mechanic tells me that, if true and it turns out the stalling was what caused the crash, that the NTSB has some culpability, but that US Airways possibly may not be held responsible since the NTSB inspectors cleared the aircraft. Yes, we'll learn more as we go forward, but perhaps you might want to consider that the engines really did stall because of a bird strike. Canada goose feathers were found in the engine that remained attached to the fusilage. I was on a jet once that landed in Anchorage after bird strike. The affected engine was in full stall, but a good pilot was able to keep it in the air for landing. However, if these engines are prone to stalling due to abrupt changes in air speed, then GE, the manufacturer, would be the more culpable party here.

The assumption that the airline is always at fault is as wrong as the assumption that they never are. Neither extreme is true. Might have been birds, might have been the manufacturer, might have been a mechanical maintenance issue, but the NTSB still allowed the plane to fly. Why? That's the question I'd want answered. And, no, a jury is not the best body to decide such things. What the average American knows about aircraft maintenance could fit in a half-teaspoon with room to spare. People who actually know the difference between a jack-screw and a piston should make the determination.

Re: Ungrateful Flyers
Mike, Just want you to know that you are not alone. I fly a couple of times a year on pleasure trips and I know that each time I board that plane I am taking a risk. There are no guarantees, for that matter, not even when you get in your car. This was not a case of negligence, so I believe as you - their life and $5000.00 is ample reward for the risk they willing decided to take. Thanks for speaking out!

Kiss the captain
I'm not a great flyer, so every time I arrive safely, I have to restrain myself from planting a big juicy one on the captain and crew! Had I been on that flight, I would be lobbying for a fat bonus for the pilot and crew.

You can bet that if SULLY would have made even one error in his judgment, he would be out of a job. I would be thanking US Airways for hiring and keeping good, trustworthy people in thier employ. Which airline would I book my next trip with (?) and airline with a PROVEN RECORD of taking EXCELLANT care of me while flying their airline. Sully did the job and did a great job. He needs a raise.

Dear Lucky to be Alive
So, you have bruises and a bloody nose? Did you manage to kiss your wife or hug your children before you ran out the door to see an attorney?
You and a few of the other 'luckiest people in the world' can go down in history as the greedy, thoughtless and thankless individuals who robbed the people of the United States of America of the 'Miracle on the Hudson'. Since this country has had no good news to celebrate in a VERY long time, watching your plane land and everyone virtually unharmed was truly wonderful story...of a couragious and professional crew, and the heroic actions of the passengers.
Perhaps you don't realize that the entire world was watching you and the other passengers and considered you all heroes.
Of course, rather than allowing America to sit on your every word by doing interviews (which would have made you very wealthy...and the RIGHT thing to do, you decided to reduce your standing in the eyes of America and ruin a truly miraculous event.
To those passengers who are thankful...and humble and without attorneys...you'll always be heroes to us and people all over the world.

U.S. Airways Payout
Hi Mike,
I called in the other day to comment on the money paid out by U.S. Airways. Unfortunately I got in too late to get on your show. I am a professional airline pilot with 22 years of experience. Prior to that I flew jets in the USAF for 7 years. As much as I would like to laud Capt. Sullenberger and his crew for saving everyone onboard, I must remind you that this incident is still under investigation by the NTSB. The results of the incident have not been made public. Both the digital flight data recorder and cockpit voice recorder would have been turned over to the Flight Operations Dept. of U.S. Airways for their own internal investigation. It is probable but highly unusual for bird strikes to render both engines inoperable in a case such as this. Normal cockpit procedure is for one pilot to remain at the controls and fly the aircraft while the other pilot fights the fire or shuts down the malfunctioning engine. Under high stress loads it is possible to shut down the wrong engine. Testimony from the surviving passengers stated that they saw the left engine on fire and shortly thereafter the right engine shut down. Capt. Sullenberger would have been too busy flying the aircraft and talking to ATC to have caught the mistake. At that altitude and airspeed an engine restart is nearly impossible. If U.S. Airways management had been made aware of such a mistake they would have been very anxious to settle immediately with all of the passengers onboard. What on the surface sounds to be quite generous may indeed turn out to be a multi-million dollar law suit save. I hope that I am wrong. Unfortunately in aviation, most of the worst disasters are attributable to pilot error. The jury is still out. I hope the verdict is not guilty, and God Speed to Capt. Sullenberger and his crew.
