WASHINGTON -- A new Capitol Visitor Center recently opened, just in time for the transformation of the Capitol building into a tomb for the antiquated idea that the legislative branch matters. The center is supposed to enhance the experience of visitors to Congress, although why there are visitors is a mystery.

Congress' marginalization was brutally underscored when, after Congress did not authorize $14 billion for General Motors and Chrysler, the executive branch said, in effect: Congress' opinions are mildly interesting, so we will listen very nicely -- then go out and do precisely what we want.

Friday the president gave the two automakers access to money Congress explicitly did not authorize. More money -- up to $17.4 billion -- than had been debated, thereby calling to mind Winston Churchill on naval appropriations: "The Admiralty had demanded six ships: the economists offered four: and we finally compromised on eight."

The president is dispensing money from the $700 billion Congress provided for the Troubled Asset Relief Program. The unfounded assertion of a right to do this is notably brazen, given the indisputable fact that if Congress had known that TARP -- supposedly a measure for scouring "toxic"

assets from financial institutions -- was to become an instrument for unconstrained industrial policy, it would not have been passed.

If TARP funds can be put to any use the executive branch fancies because TARP actually is a blank check for that branch, then the only reason no rules are being broken is that there are no rules. This lawlessness tarted up as law explains the charade of Vice President Dick Cheney warning Republican senators that if they did not authorize the $14 billion, the GOP would again be regarded as the party of Herbert Hoover.

Surely Cheney, a disparager of Congress and advocate of extravagant executive prerogatives, knew that the president considered the Senate's consent irrelevant.

Evidence that casualness about legality is inherent in big government is found in H.W. Brands' new biography "A Traitor to His Class: The Privileged Life and Radical Presidency of Franklin Delano Roosevelt." FDR became president on Saturday, March 4, 1933. Banks were closed that day and the next, temporarily preventing panicked depositors from withdrawing their money. At 1 a.m. Monday, FDR ordered all banks closed for four days, hoping that the fever would break. His act may have been prudent. But was it legal? Brands writes:

"He cited a section of the 1917 Trading with the Enemy Act as justification. The act had never been formally repealed, but a body of legal theory held that the law, along with other wartime legislation, had expired upon the signing of the peace treaty with Germany in 1921."

FDR had asked the opinion of his as-yet-unconfirmed attorney general, Montana Sen. Thomas Walsh, who gave the answer FDR wanted. Walsh never had to defend this: He died March 2 en route to the inauguration.

The expansion of government entails an increasingly swollen executive branch and the steady enlargement of executive discretion. This inevitably means the eclipse of Congress and attenuation of the rule of law.

For decades, imperatives of wars hot and cold, and the sprawl of the regulatory state, have enlarged the executive branch at the expense of the legislative. For eight years, the Bush administration's "presidentialists"

have aggressively wielded the concept of the "unitary executive" -- the theory that where the Constitution vests power in the executive, especially power over foreign affairs and war, the president is immune to legislative abridgements of his autonomy.

The administration has not, however, confined its aggrandizement of executive power to national security matters. According to former Rep.

Mickey Edwards in his book "Reclaiming Conservatism," the president has issued "signing statements" designating 1,100 provisions of new laws -- more designations than have been made by all prior presidents combined -- that he did not consider binding on him or any other executive branch official.

Still, most of the administration's executive truculence has pertained to national security, where the case for broad prerogatives, although not as powerful as the administration supposes, is at least arguable. With the automakers, however, executive branch overreaching now extends to the essence of domestic policy -- spending -- and traduces a core constitutional principle, the separation of powers.

Most members of the House and Senate want the automakers to get the money, so they probably are pleased that the administration has disregarded Congress's institutional dignity. History, however, teaches that it is difficult for Congress to be only intermittently invertebrate.

President Bush is not a traitor
I remember a time when the Democrats were saying the same thing about President Bush and his wartime powers. President Bush didn't want to wait around because the enemy wasn't. He needed funds for the troops and equipment. Then there was the Patriot Act. His wartime powers were in question again. How about Homeland Security. The list goes on and on. Now that President Bush has bailout the two automakers the shoe is on the other foot. Now it's the Republicans and Conservatives whose questioning his executive powers. No wonder President Bush will never be given credit for anything. There's a time for stalling and there's a time for getting the job done. Both parties ought to know by now President Bush has no patience for those who drag their feet when so much is at stake. Namely the economy.

Reality checks and balances
Where are the Republican lawyers to file suit against Bush's breach of the Constitution? The bailout should be challenged in the court system (they all should have been, actually). That is what the concept of the checks and balances entails.

Do your readers a big favor, go into your archives and read a couple dozen of your columns from 30 years ago. Back when you were a true conservative and not an aging Washington insider who has spent far too much time in the same room with sissy liberals in the Georgie Porgie Stepanopoulous mold.

Who cares about Bush's abuse of power? The point of the matter is that any rescue of Gm and Ford (Chrysler is already a cadavar) is a waste of time and money, these businesses need to go bankrupt to free them of UAW obligations that they will never be able to meet. Mister smarty pants with all your big-shot words, ever here this phrase, "He couldn't see the forest for the trees."

Get out of that sewer for a year. I suggest Seminole County Fl., or Haywood County NC, two places I have lived where people don't forget what it is to be a conservative, and let sissies like Georgie talk them into it.

Congress?
Aside from creating vote buying entitlements to keep their rearends in office, what benifit are they?

They cost the working people billions upon billions for no other reason than to get elected for another term.

With the present leaders(Pelosi & Reid), their underlings and their progaganda media machine(MSM), this, MY AMERICA, is looking like the banana Repulics we have disdained for years.

There is political corruption at a very alarming level.

Yes, there is corruption in all parties, but we should demand, in no certain terms, that it be stopped.

Our Constitution has been abused by every branch of government. The Courts have been notorious for legislating from the bench. Congress has spent us into oblivion with entitlement programs and pork used to buy votes for re-election. And various presidents have overstepped their enumerated powers. The bottom line is, the liberals have succeeded in dumbing down our society to the point that most Americans have no idea what the Constitution says and don't really care. With the latest bailout schemes and the rampant corruption in the Democrat-led Congress, the Constitution is in tatters. And, if Barack Obama is inaugurated as president without producing his legal, original US birth certificate to prove his eligibility, the Constitution is NULL AND VOID. Let the anarchy begin!

Squarely on target, sir.

Presidents blind to the separation of powers or cavalier about the Constitution in general are nothing new. Jefferson himself had doubts about the legality of the Louisiana Purchase, but went right ahead with it. Nixon imposed wage and price controls and even contemplated martial law during a wildcat truckers' strike. And so on _ad nauseam_.

The larger problem is that every branch of government thinks its Constitutional assignments are beneath its dignity.

The executive branch envies legislative powers. Consequently, the number of orders and regulations that it issues, each with the force of law, exceeds the staggering number of actual laws that Congress passes.

From the number of show trials that it holds, one might conclude that Congress envies the judiciary. But it really wants to be president, perhaps because many members of both houses want to be president. Although Congress spends most of its time taking fact-finding trips to Fiji or proclaiming National Pigeon Week, a fair amount of the real work that it does trespasses on executive prerogatives, e.g., the War Powers Act, or rights reserved for the states or the people.

It's all right that Congress has abdicated, however. Not only presidents, but also judges, are eager to step in and make laws in its stead.

All this job changing has unfortunately left a void in the judiciary. But the Republic is resilient. When the courts become preoccupied with writing legislation, the unpleasant business of meting out justice falls back on a well-armed populace.

Over the years, shrewd men have stated your case more succinctly.
"We can't lose, all the fools in town are on our side".
"Never give a sucker an even break".
"There is one born every minute".
"No one ever went broke betting against the intelligence of the public".

And my personal favorite: a quote from my Puerto Rican Platoon Sgt, a DSM winner and my role model as a soldier:
"Most people are stupider than average".

The sad fact is that voters return known thieves and rogues to congress because they hope to get something out of it personally, and the overall good of the country be dammed. The opnly way we will get decent govt resonsive to the good of all the people is to throw the rascals out when they indicate they are willing to trash anybody else. If they will trash anyone, rely on it, they will get around to trashing you. Hitler said he only wanted to punish the Jews. Obama says he only wants the rich to pay their fair share. The difference is one of degree. Like the woman who would not sleep with a stranger for a nickel, but would for 100 million, we are only haggling over price.

George Will Misses It Again
As usual, George, The Elitist, misses the point. Until the UAW is neutered, the automobile industry will continue to be a money sink-hole.

Since when does Congress have the authority to 'bail out' private banks?

No president would have access to a blank check if Congress wouldn't write them. Bail outs are simply illegal acts by an unconstitutional centralized federal government run amock.


Will's overall theme is correct.
Will is correct of course on his point that the Executive has, almost from the inception of our Beloved Republic, violated the will and intent of the Framers of our Constitution, with G.W. Bush being but one of the most egregious examples.

But Congress has been a most willing enabler in this process to subvert the Constitution...not out of design to do so but out of cowardice to assume its rightful responsibilities.

George Will does hit a triple with this line: "History, however, teaches it is difficult for Congress to be only intermittently invertebrate".

Altho I share Will's outrage generally over the aggrandizement of power into the Presidency(which the Framers would find extremely disturbing), I think there are better examples of Executive power abuse than the utilization of some of the congressionnally approved TARP funds for the auto industry loans.

But Will's overall theme about Executive power abuse, and its damage to our Constitution, is on point.

Citizens Are Irrelevant
Come on, admit it, you all know the truth. We now have a people that is of the government, by the government and for the government. The population of America exists to support our lords and masters. The amazing thing is we voted for it.

Political price to pay
Let's face it. The economic mess was created by actions for many years of both parties that made it possible to build, and sell housing to the poor with no down payment and no chance of paying off a mortgage. Banks and mortgage lenders were able to package for Wall Street to sell derivatives, hedge funds, and mortgages packaged as mixed bags of certain value without normal expectation of insurable loss protection.

Now the other shoes are dropping. Like letting the UAW get whatever it could demand and get from auto makers who preferred inflation to strikes and business failure. Government made it possible for the UAW and other unions to gain such power and now the global economy has brought on the time of reckoning!

Soon the Congress will be just a rubber stamp to the Obama calls for whatever has been decreed as the solution to any perceived problem. The people mandate CHANGE and they will get it! Only the Supreme Court stands in the way as it did in FDR's time. Obama will not have to expand the court with extra judges, just replace the ones about to retire with ones that accept that laws are to be made by the Executive White House, and be endorsed by Congress and approved by the Court.

Soon we will discover that all jobs and prices will be run by the White House! Will you be surprised? or pleased?

I have become more and more disapointed in Pres. Bush. The fact that he held on to Rumsfeld until after the elections began my slide. Now this "bail out". The final insult to my support would be his pardon of former Illinois Governor George Ryan.

We Are Being Invaded By Socialism
When our government decides what companies should survive and what companies should'nt and using our money to save their choices, we are heading for the total destruction of our Constitution.

The constitution was not written to give government more power over the people, it was written to give less power to the government.

I think our modern politicians are so wrapped up in party politics that they willingly ignore the constituion to progress their own ideology.

In the past , this was called "treason". Today , it is called "progression". Would someone please explain where the politicians want us to progress to? Total destruction of individual freedom?

The Imperial Presidency
Much has been made over the last 60 years of the transfer of power from the legislative branch to the executive, resulting in an all-powerful presidency.

IMO one of the reasons for this is the increasingly ineffective Congress. If Congress can't get things done, then the president must.

This may be due to the fact that it's difficult to defeat an incumbent, so once in office their focus becomes fund raising and reelection. And with the increasing number of "safe seats" (resulting in a more ideologically extreme congress), and the partisan rancor that results from it, the congress becomes even less able to compromise and get things done.

I've been calling for term limits on congress for years. When will we see the light?

Tradiionally Impatient
If traditionalism teaches uniformity, then modernism teaches impatience. Our collective desire to have everything now and not wait until some future date...for anything we want has now reached into the pinnacle of power. FDR had his authoritarian concepts ingratiated by hard times and Bush the younger has had his impatience ingratiated by terrorism and now, again, frigtening times. And we as the public are too willing to go along and let the rule of law prevail...because it's too uncertain and time-consuming.
Instructive article...but what to do?

The Constitution
The Constitution tells us that only Congress can appropriate money. What George W did was unconstitutional. But who cares? Certainly not Congress.

Bush asked Congress for 700 billion. He couldn't get it until after our 535 clowns in Congress tacked on an additional 150 billion in pork. Now George wants the other 350 billion which Congress has to approve. Don't be surprised to see more pork attached to that request, whether it is George or Obama it will happen. Let us not forget that Obama will be asking for anywhere between 600 billion to a trillion for his "STIMULUS PACKAGE". After all, now is not the time to be concerned about deficits.

All of this and we still keep electing them. Yes, we do get the government we deserve.

Give us a break "Unitary Executive"
Oh am I sick of hearing about the dreaded Unitary Executive.. as if everything else is hunky dory in the Fed Gov except for that troublesome White House.

Hate to say this but all three branches are totally of thier mind and out of control. I remember quite clearly calling my worthless Congressman and tell him dont vote for TARP but he did. I can't even imagine what 600-700 Billion Dollars actually is.. so what the heck does 15B of it going to UAW matter in the long run? The Fed Govt is still going to go bust, as is the Big 3 and the Dollar will be worthless by the time the people in Washington are done having their way.

No one is even bothering to sue this bill's constitionality in the Supreme Court.I guess why bother.. if the Court couldn't be bothered to give some guidence on if a candidate for President actually has to meet the requirements , then surely they're not going to take on the case of this bill's legitmacy.

But at least our Supreme Court is always there to hear the case for an Islamic warrior engaged in our genocide who is being held without Cable Sat. and denied some of the virgins of his next life given to him now while he's waiting.

Remember Bush is doing all this to protect Free Market System... something Obama has stated quite clearly he has no intention to protect.

I do believe God had a purpose for America.. so I can only hope there is burning hot Justice waiting to be served when all you people in Washington finally meet your maker.

A corrupt populace addicted to materialism and sexuality gives up its right of oversight, sends up worthless trash to govern it, and a powerful leader emerges, builds a military operation inside the state and takes over completely while the old regime fights among themselves. Bush re Auto Maker Bailout
Despite all the cries from Bush haters wanting impeachment for his handling of 9/11, Iraq, or just for his very existence I have supported most of his actions because I think his motivation has been to keep America safe. The President is off base this time. I don't believe that he has the authority to overide the will of the Congress and give money where no provision has been made to give it. This is an impeachable offense. The President has time on his side though and probably counts on the public not wanting another impeachment proceeding following on the heels of a new president coming from the cesspool of Chicago ward politics. How much dirt can the country handle at once?

The First Contract
The 700 billion dollar bailout was foolishly written, rightly derided by people who can see through an audit. The bailout oughta be called: "Bailouts for Fleeing Executives."
(Oughta make a satirical movie called "Executives in Flight.")

The second bailout? Like trying to revive a placenta.

President Bush should stop allowing himself to be used as a human p.unching bag, particularly for people - like congress (little "c") - who offer him no respect. His acts of heroism on congress' behalf - and on behalf of unions and auto execs - are like diving on a han.d gre.nade to save a flock of parakeets.



Only Ourselves to Blame
We send those fossils up there to sit in what amounts to a museum. "We have seen the enemy,and he is us" ---Pogo. Maybe if we get sick enough of the corruption, starting in Illinois, we can turn it around. Or we can go to the trash heap of History.


Bush gets NO credit for his "goodness"
For at least the past year, President Bush has been obsessed with making the next president’s transition easier, whoever that president might end up being. I would include this “temporary” automakers’ bailout in that endeavor: now the new President Obama won't be immediately greeted by desperate, failing, begging automakers.

Perhaps this is the fault of Clinton and the Democrats in Congress, all of whom made President Bush’s first few months in office a time of trials and tribulation (how AWFUL of the UNELECTED Bush to avoid that all-important arsenic-in-the-water issue that Clinton noticed on his last day in office; how COULD he refuse to carry out that unpopular and disastrous Kyoto Accord! and so on and so forth). In fact, with the exception of a few months after 9/11, the Democrats have expended incredible time and energy in their efforts to destroy Bush’s presidency, even including working to turn World Opinion against Bush and the U.S.

Washington, D.C., is no place for a gentleman with gentleman’s manners. In that respect, perhaps neither President Bush nor most of the Republicans should even be there.

Okay, trolls, shout it to the rooftops. "There is no good in Bush, only total EVIL!!" Continue to carry out the mandate of the Democrats in Congress.

For All The Bush Bashing That Went On...
do you think any measures will be taken? Do American citizens let their Government roll over the Consitution this blatantly?

Wish the media was on America's side on this one.

TARP was written, specifically...
...to deal with the liquidity crisis in the financial markets. Brokerage firms, and even insurers, have, on occasion, redefined themselves as banks to get in on the pork fest.

But since when are the big three auto makers, by any stretch, considered financial and credit institutions?

Bush leaves in a month and his departure, for this voter who supported him in both elections, it can't happen too soon. In supporting the excesses of the UAW with the auto bailout, he is doing exactly what the crats want and should get credit for while damaging the GOP even further than he already has by directly opposing its members of congress.

And, in the end, the auto makers, particularly GM, will, most likely, go into bankruptcy anyway.

And Bush will have set the pattern for the executive to do anything necessary, regardless of authority, if there is a 'purpose' in dealing with the 'crisis'.

The only real crisis we are experiencing and dealing with at this time is the increasing usurpation of constitutional power and authority, reserved to the electorate and its representatives, by the imperial and bureaucratic executive.

With regard to this unlawful and renegade executive act, the GOP should file a lawsuit to be heard by the SCOTUS, even if the president is of its own party. This would be a first positive step in rebuilding the republican party.

Sarah Palin opposed and fought this kind of corruption in Alaska, within her own party. Where is our Sarah Palin among the republican eunuchs in Congress?

The Final Blow?
Government: George Washington called it a “dangerous servant and a fearful master.”

The executive branch has been garnering and centralizing power for some time but Bush 2 probably increased it dangerously all in the name of “security”; fear mongering is the favorite tool of fascism. Of course, the legislative branch is pathetically ineffective and is easily cowed by the new imperial executive branch.

Re. security: Fear distorts the thinking process (all strong emotions do). Freedom is the Holy Grail; let's not throw ourselves in jail. Still, prudent measures are needed if there are checks and balances and a "just right" approach is used to counter the threat. For instance, the inelegant mess that is airport security does not make us substantially safer; too many weaknesses to be exploited by the bad guys but it is unmitigated hell for all law abiding citizens. Overall, I'm rather skeptical that government will "save us". Haven't they screwed up everything they've touched? The more effective "layer" we can create is individual vigilance and appropriate response. Citizens need to train for awareness and exercise it. If we don't let government subjugate us like sheep then we are less likely to be led to slaughter. Desperate times require desperate measures but they should be measures we control not inept government even though they have a role too.

The Democrats are rolling over for Bush
...just like the Republicans did for 6 years.

Soon it'll be Obama that they're rolling over for.

Most Republicans--after selling their souls to GWB/Neocons--can't even criticize either. Their utter lack of morals and principles these last 8 years makes anything they say a joke.

The ingredient missing in all of this is the Supreme Court. Recognizing the obvious intent of the legislative and executive bodies to ignore and neuter the Constitution, the Justices are laying low, hiding behind procedural process. "No one has brought the matter before us", they say. Cowards.

Nor is Will right that "historically" power always flows to the executive. Both ancient Sparta and Venice had legislative dictatorships. (Well, Spartan kings held power, but the ephors held much more, as evidence the appointment of "advisors" to various kings during the Peloponnesian war, with the power to veto royal decisions.).

The only consistent pattern is that when a government has too much power, the various branches will fight over it. There is no rule that the executive always wins.

Good article. By not holding the line on using TARP funding, Bush has tacitly given permission to Congress and Obama to use tax money to bailout the UAW and underwrite whatever special interest group they want.

It's easy to see a scenario where our tax dollars are used to support UAW excesses and force auto makers to build "green" cars that aren't worth buying. Then to add insult to injury, it's entirely possible the same Congress would then enact tax penalties to sting anyone who desires buying something other than the GM junk offered.

The worst precedent though is the bail outs to come. By not holding the line on bailing financial institutions, Bush gave a green light for Pelosi and company to spend money on unaccountable state/city governments, colleges, and any other industry/special interest the left feels is worthy of being placed above the confines of the messy capitalist system; all, unfortunately, at the expense of the tax payer.

Unless Congress suddenly learns economics, we're in for a very rough ride over the next few years. The real kicker is that the left and their cronies in the press will blame it all on Bush anyway (see NYT on cause of the mortgage mess).

I heard Pelosi said the bailout for the auto industry was constitutional because it passed the House and had the support of a majority in the Senate even though it didn't pass by an actual vote in the Senate. This should really be brought up to the Supreme Court.

Several Republican Senators tried to mandate concessions from the union bosses. Force them to give a day when they would restructure their finances.

The Unions would not go along with it,so the senators kept their word and voted against the bailout. The left will make them pay for bucking the unions.But what else is new?

Then the president doublecrosses his own senators and agrees with the bailout. As much as I hate to admit it...the president has not helped his own party when he could have.

Especially when drawing attention to alternative candidates to BHO, in light of BHO's Constitutionally ineligibility to assume office, would only yield persons who would be more likely to act in greater accordance to the Constitution and will of the American people.

George Bush acted as he did probably
because he prefers that history not record that the Big 3 all went out of business during the ending days of his second term. He'd be reviled for the rest of his days, and his free market sponsors would be exposed more clearly for America to clearly understand their damage caused.

If 1 out of 10 citizens bothered to demand Congress and the President act within Constitutional limits, and followed their demands by voting out those who deliberately refused to do so, we wouldn't be reading this article by the esteemed Mr. Will. Our government is only as constrained and moral as we are. I don't think you can separate the behavior in government from our own behavior as individuals. Did you object when Bush called the Constitution a @#$d@mn piece of paper? Did you object when Habeas Corpus was suspended? Conservative Democrats would have switched parties to vote for Dr. Paul - and our Republican Party would have won this recent election with a FREAKING LANDSLIDE!
