Pardon Sgt. Evan Vela, Mr. President

It's that time again, and I don't just mean Christmastime.

We're now entering the final phase of an outgoing administration. And during this phase, George W. Bush, mere mortal but still president, has the practically supernatural ability to grant pardons. This endows him with the power of life over death, of clemency over conviction. For one month more, President Bush will be able to right wrongs, show mercy and restore faith. For one month more, he will have the opportunity to pardon Sgt. Evan Vela, now serving 10 years in a military prison for what a court martial called "murder" but what I, along with many, many Americans, call war.

I first heard about Sgt. Vela last spring in an e-mail from his father, Curtis Carnahan. "I do not know if you have followed my son's case," he wrote, "but some people have drawn similarities between the Luttrell situation and Evan's."

Carnahan was referring to Marcus Luttrell, whose best-seller "Lone Survivor" tells of four Navy SEALS, Luttrell among them, whose secret mission in Afghanistan was compromised when two unarmed goatherds discovered the Americans hiding in Taliban territory. Fearful of precisely the kind of legal action that would later ensnare Evan Vela and his comrades, the SEALs, as Luttrell tells it, decided not to kill the Afghans, even to preserve their own lives, let along the success of their mission. So the SEALs released the Afghans and abandoned their mission.

It was the tragically wrong decision. Soon, the SEALs were under attack from a large force of Taliban. In the ensuing battle not only were three of the four SEALs gruesomely killed -- with only Luttrell living on as the "lone survivor" -- but so were 16 additional U.S. special forces who perished in a rescue attempt.

While the Taliban are the clear agents of death in this terrible case, it is our own acid ideology of political and cultural self-sacrifice that is actually responsible. The stunning fact is, the SEAL team faced not one but two enemies that day in Afghanistan: their jihadist opponents in the mountains and their politically correct fellow-citizens in the courtroom. They chose to fight the one enemy they thought they could defeat.

In very similar battleground circumstances, Staff Sgt. Michael Hensley, Evan Vela's squad leader, made a different decision. Of course, Hensley thought he could whip both enemies at once.

A complex saga, the events of that day come down to several salient facts. Operating in Al Qaeda-infested territory south of Baghdad, Hensley and his men were discovered in their "hide" by an unarmed Iraqi man, whom they captured. As the man failed to stop moving and making noise, Hensley was very properly concerned that the Iraqi would reveal the Americans' position to nearby insurgents. It seems that he was also very properly concerned that even this overtly hostile action that he deemed dangerous to his men and mission would not impress his superiors as sufficient cause to kill the Iraqi. In other words, Hensley seemed to sense, as I believe, that where our PC-uber-alles military brass are concerned, the lives of American troops are not as important as their own extremely twisted sense of morality: that it is morally better to risk their troops' lives than to risk marring what they perversely conceive of as their own inner purity.

And there was something else, although I doubt Hensley could have been aware of it. This incident took place in May 2007, just as "the surge" was kicking in and just as Sunni insurgents were "awakening." The resulting trial over the incident, conducted in Iraq rather than in the United States as in the case of all other such trials, would ultimately resemble a platter seeking a sacrificial lamb to serve up to "former" insurgents and Iraqi officials alike. As things turned out, Vela became that lamb.

In any case, Hensley concocted a politically correct, brass-pleasing cover story over the course of several phone calls to the command post -- something about the approach of an insurgent armed with an AK-47. He then ordered Evan Vela to kill the man. It was Vela's first "kill."

Long story short: The court martial nightmare our deceased SEALs in Afghanistan feared more than death in battle came true for Hensley and two other members of the squad. Hensley ultimately served 135 days of confinement and the other soldier connected to the case, Jorge Sandoval, served five months in prison. Only Evan Vela, the young Ranger-trained sniper who carried out his superior's battlefield order, was convicted of "murder." Vela, a 25-year-old husband and father of two small children, is now spending his first of 10 Christmases in the military prison at Fort Leavenworth.

This is a grotesque miscarriage of military justice. It is not the only such travesty to come out of Iraq, but I don't know of another case more deserving of a presidential pardon. Fortunately, two Republican lawmakers from Idaho agree. U.S. Senator George Crapo and U.S. Representative Mike Simpson have recently written letters to the president urging him to pardon Evan Vela.

Our 43rd President frequently expresses gratitude to our troops for their willingness to fight for America's freedom as well as the freedom of foreign, even hostile peoples. I can think of no better way to enshrine that gratitude with a presidential pardon to restore the freedom of one of those very troops -- Sgt. Evan Vela.

It has nothing at all to do with "purity" it has to do with discipline and providing aid and comfort to the enemy. The troops deliberately lied to thier superiors and Vela executed a man in cold blood in what he knew was against orders. He is a killer and a disgrace to the military. That said; sadly, what what seems like a "good idea" at the time was not. I would not be offended by a pardon. Why? There was apparently no action taken against any officer

Wrongful Deaths

Wrongful deaths are a bi-product of war. Soldiers should not be going to prison for errors in judgement. No life experience stateside can prepare anyone for life in a war zone. Mistakes and errors will happen. That does not make it criminal.

Iraq
There isn't an Iraqi worth saving... they cannot govern themselves. Free Sgt. Vela. Dave you are a real turd, move to Canada.

For starters, the fact the trial was in
Iraq makes the verdict obviously suspect. Diana's assessment that Vela was a sacrificial lamb seems totally accurate given the US efforts to placate Iraqis to show we're friends. So a retrial in the US would seem the only fair thing for Vela.

For his unit, the situation seems to have been even clearer than it was for the Navy Seal team. They already had their prisoner in their custody.

An enemy prisoner, belonging to a force known to almost always kill their own prisoners, who is trying to alert fellow armed enemy fighters of the position of his captors would immediately forfeit his status as prisoner and resume status of an armed enemy in battle, even if he was tied up and gagged, if he was still capable of attracting their attention.

Also, for a military unit of ours fighting inside of a hostile territory such as Iraq or Afghanistan, there clearly can be a blurry line between what constitutes a enemy combatant and what constitutes a protected civilian, when the person in question appears likely to give away the position of the US unit.

So if the US military did not train Vela exactly how to discern between the two classes of people during a combat situation, then this is a fair basis to lighten any sentence against Vela and the other men for having to work out this discernment on their own.

Also, if Sgt Hensley gave Vela the order, then Hensley is the more
responsible party. Not Vela.
Especially when considering the fact that Hensley gave a partially bogus account of the facts later on.

Seems some other facts are still not known yet, and maybe a fair trial here in the US could determine whether some other options were open to the men, such as making an effort to see if they were unable to avoid killing the prisoner by threatening gestures first, or then a hard hit to the head second.

A fair treatment of these soldiers could also establish some precidents for future reference to in military training.

Part of the Long grey line
of of political decisions meant to steer a foreign policy of dubious intent, the Sgt is one of many lives destroyed or wasted. There are those of us who saw this coming a long time ago but were put down with those anti patriot tags such as commie, socialist, cut and run Americans. Now you see here the consequences of such confusion. The right - the wrong - and the grey in between. Im angry as hell about it. Within the White House for 7 years lived a man fearful of his life and who shoved out into battle young men ill equipped to deal with a poorly planned and executed plan for victory, if victory was the goal at all. Why this nation made the same mistakes in war planning that were made in Viet Nam is beyond belief. How could it be that the sons of Viet Nam veterans were sent to a war like this without protest is beyond me.
My son goes to Afghanistan next month for his 4th tour. Since the C in C has failed to provide a winning plan to either win the war or with draw, my son has direct orders from me. As the Greek mothers once said as they handed the shield to their sons "Your shield - come home with it or on it." There is no in- between. There is no dishonor in killing the enemy who is devoted to killing you. God gave us the common sense to know this; ask any mother of a soldier.
It is my singular hope even knowing of all of the disfunction in the country-my one desire, that lawyers and politicians leave war to soldiers and sailors. There is now more grey than black and white. And the long grey line of legal interference has blurred the boundaries of reason in the unreasonable calculations of war.

The real reasonthey are so anti-military is the fear they may be asked to go to battle for the USA. Now let's start by pardoning all those abused prisoners in Abu-Ghraib. Well, wait a minute most of the them are all out free anyways, and the ones who were punished were a slap on this wrist.

Again, people who sound, look different don't deserve any sort of justice. These people are ofcourse inferior to American high-class morality, and the those non-peoples like the indigenious Americans and African-Americans who deserved to die or be slaves to the purer race.

There is one part of the US, which will never learn anything, because you guys feel that you are morally superior than most in the world. Ofcourse, which means you have to deliver justice to the world that is filled with sinful people not withstanding all the hateful things that have happened in the US. You have set this world on a collision course, and there is no turning back now, and you won't be satisfied along with your cohorts in the rest of world(yes there are hate-filled people in all races, country, ethnicity etc) until we destroy each other.

I applaud you Diana!! Couldn't agree more with what you have said in your column here. Vela is the scapegoat for obeying orders and taking action in a very dangerous and confusing war zone. Who among us knows what that is really like? Those at the bottom of the military hierarchy are held to be responsible for the inadequacies and contradictions of war and the hell it contains.

It's so much easier to blame people like Vela. We should be on our knees thanking God that men and women are willing to serve and protect our country! The islamic terrorist threats are very real in their zeal to destroy us. What a travesty of justice and hypocrisy! Who covered their behinds so that Sgt. Vela was left holding the bag? Where in the world has integrity and honor gone?

Yes, president Bush would do well to PARDON Sgt. Vela from this hellish experience he has been forced to endure.

I think that a large number of magistrates should be conscripted into military service every time one of our soldiers faces a judgement like this!!!!. I also know that it wouldn't work out because there isn't enough time for them to weigh the pros and cons, take statements, accept plea bargains, and read the depositions that they would require before taking action. By that time they would all be dead--horribly tortured and killed by the very people they are trying to treat so justly. Not a pleasant picture for anyone, I'd say. I'll bet that Sgt. Vela knew what happened to those tragic "give the guy a break" Seals.

Vela was damned if he did and damned if he didn't, it sounds like to me. What would have happened to him and his fellow soldiers if he had disobeyed orders? The crazies are running this country and it looks as if some are running the military, too.

Ive always looked up to people in uniform and will continue too. But this was a huge injustice to to EVAN and his family. age..How does that Grab YA?? In my 25 years of Voluntary Military Service I actually saw it improve Many young people..And I didn't see ANY SLAVES, altho there were times I DID wonder what my "Masters" had in mind..BUCK UP!! U'll be OK...

Armchair warriors

It is both amusing and disgusting to listen to the rants of armchair warriors . . . most of whom have manifestly never faced the horrors of military combat . . . yet who are still so quick to climb on to their high "moral" pedestal and pass judgement on troops who often have to make life and death decisions -- about their own lives and others -- in a matter of seconds. The armchair warriors think troops should be able to make "morally pure" decisions, in all circumstances, regardless of the degree of pressure they are under . . . all while paying meticulous attention to the fine points of "international law", the Geneva Conventions, and the seemingly ever-changing "rules of engagement", as they simultaneously try to avoid meeting an enemy bullet or IED.
Why is it that the "politically-correct" seem to think that ONLY American troops and their allies should be required to meet the lofty standards of moral purity demanded by the worshippers of "international" law and the corrupt U.N.? Why do Leftists and the PC crowd never seem to be just as outraged by the violations of international law and human decency committed by the Medieval minds of religious totalitarians who DELIBERATELY target women and children in marketplaces, and who slice off the heads of THEIR prisoners with a dull knife while those prisoners are still breathing? The PC crowd, on the contrary, wants to give THOSE violators of international law and the Geneva Conventions all the rights that an American citizen would be entitled to within the U.S.A. during a time of peace and no martial law. It is a virtual certainty that the vast majority of these PC fools, who apparently have never known a greater danger to their physical safety than cutting their own finger accidentally in the kitchen, would mess their pants in fright if they were ever confronted by someone with a gun.

Innocent civilian?

If a civilian prisoner . . . even an unarmed one . . . continues to resist and make noise which could alert the enemies of our troops . . . can that "civilian" then really be viewed as a neutral non-combatant . . . if such behavior is obviously meant to endanger our own troops? If a civilian willingly tries to give information or reveal secrets to our troops' enemies, that civilian, by definition, is an ACTIVE participant in the conflict.

I was fortunate enough to have crossed paths with SGT. Vela. Not many days go by that I don't tink of him and hope that things work out for him. A lot of your posts are off base, off the subject, and based in opinion and speculation and vivid imaginations. Sitting over your keeboards consuming cheetoes and red bull, you all could never imagine the climate and conditions that Even was working in. I was a guard in the military prison that detained Even while he was on trial. Of all the soldiers that came through the wire, Evan was the one that I believe had no buisness being there. Men in his line of work usually succumb to an early demise in combat at the end of a rifle, doing thier job. Even was a casuallty caused by the very country he loved and devoted his life to defending. I was there when Even came back a convicted man. I watched as he took off the special forces badges he had worked so hard for and wore so proudly on his uniform, and threw them in the trash. What happend to him was wrong. I wish there were more soldiers like SGT Vela. I would certainly sleep better at night knowing they were out there defending our freedom and our right to sit at a computer in a safe home and judge condem them for devoting thier lives to insure ours. Thank you Even and I wish you the best of luck.
