One State Sues the Biden Admin Over Illegal Alien Flights

In April, Republicans on the Committee on Homeland Security revealed documents obtained through a subpoena of the Department of Homeland Security (DHS) that identified over 50 airport locations used by DHS to help process into the country more than 400,000 inadmissible aliens through the administration’s unlawful Cuban, Haitian, Nicaraguan, and Venezuelan (CHNV) mass-parole program (via Homeland.House.gov):

According to these documents, as of mid-October 2023, there were 1.6 million inadmissible aliens awaiting travel authorizations through the CHNV program. In the documents, DHS further admits that none of these individuals have a legal basis to enter the country before being paroled through the program, stating, “All individuals paroled into the United States are, by definition, inadmissible, including those paroled under the CHNV Processes.”

Since then, more Republicans have pressured the Biden administration to release information regarding illegal alien flights into the U.S.

On Tuesday, Missouri Attorney General Andrew Bailey filed a lawsuit against the Biden administration to obtain answers about alleged illegal alien flights into the state. 

In a statement, Bailey said that the administration has refused to turn over documents detailing the illegal immigrant flights. In his lawsuit, Bailey claimed that the Department of Homeland Security intentionally delayed responding to his inquiries about the flights. 

"This game of ‘hide and seek’ violates the spirit and the letter of FOIA, which states that an agency shall withhold information only when the agency ‘reasonably foresees that disclosure would harm an interest protected by an exemption’ or if ‘disclosure is prohibited by law’," the lawsuit, which was shared with Fox News, reads.

"DHS’s withholding of crucial information has frustrated the ability of citizens to exercise the rights Congress outlined in the FOIA statute. This lack of transparency and refusal to comply with lawful FOIA demands has hindered efforts by the Missouri Attorney General's Office to determine the size and scope of illegal immigration within the Show Me state," the lawsuit continued.

On X, Bailey said that Biden has been “secretly flying illegal immigrants into Missouri, bringing drugs that are killing our children,” adding that the current administration does not “seem to care about the safety of our communities.” 

“Their stonewalling and lack of transparency are unacceptable. Missouri demands answers and accountability. We will not stop until we get the truth and protect our state from this reckless disregard for law and order,” he added. “This stops now.”

In a press release, Bailey doubled down on his decision to sue the Biden administration. 

“Once again, the Biden Administration is trying to stonewall and circumvent every aspect of the law in order to hide information from Americans,” Bailey said.  “Their most recent refusal to provide the truth about the flying of illegal immigrants into Missouri is just the tip of the iceberg. It reflects a larger pattern of deploying delay and diversion tactics to avoid producing documents legally requested under FOIA. Here in Missouri, we hold bad actors accountable when they refuse to obey the law, even the federal government. I will not stop until I obtain answers for Missourians.”

After the Biden administration began flying illegal aliens into the United States, Republican leaders like Texas Gov. Greg Abbott and Florida Gov. Ron DeSantis began sending flights of illegals to so-called “sanctuary cities” to share the burden of the border crisis.
