Was the Copenhagen Global Warming Summit Walk-Out a Win for the U.S.?


Remember the cacophonous wailing of the left over the Bush administration's alleged politicization of the Justice Department? We always knew they were just projecting, but now we have even more proof.

I first learned from my friend Andy McCarthy's blog post on National Review Online that Attorney General Eric Holder had rejected the legal opinion of his own Justice Department lawyers that the D.C. voting rights bill, which would give the District of Columbia a voting member in the House of Representatives, is unconstitutional.

Why would Holder reject the legal opinion of his own deputies? Dumb question. Because he doesn't like the answer and neither does his boss, President Obama. They both strongly support passage of the bill and do not believe a little trifle, such as an express constitutional provision forbidding it, should be permitted to get in their way. How many times do leftists have to demonstrate that they are an ends-justify-the-means bunch before it sinks in?

The Washington Post confirms that the Justice Department's Office of Legal Counsel, "an elite unit that gives legal and constitutional advice to the executive branch," did issue an unpublished opinion earlier this year that the voting rights bill is unconstitutional. Holder couldn't let that stand, so he went back to the well, hoping for a different opinion.

Lo and behold, the solicitor general's office dutifully served up that opinion and said it could defend the legislation in court should the bill be challenged on constitutional grounds. Hmm.

Now, those of you who don't like it when lawyers muddle up the plain meaning of language should follow me into the next paragraph, where I'll recite to you the pertinent constitutional provision. Please excuse me while I reach up to the shelf to retrieve my pocket Constitution.

Article 1, Section 2 provides: "The House of Representatives shall be composed of Members chosen every second Year by the People of the several States." Would it be too much to ask that we all agree that the District of Columbia is not a state?

On that point, I'll note that Article 1, Section 8 provides for the establishment of a federal district that is distinct from the states. James Madison, the Father of the Constitution, wrote in Federalist No. 43 of the necessity of a separate federal district that serves as the seat of the federal government and is separate from the authority and the territory of any state. Otherwise, "Public authority (of the federal government) might be insulted and its proceedings interrupted with impunity," and the district would have to rely on the state in which it was included, for protection, which could diminish its honor.

The plain meaning of the language of Article 1, Section 2 is clear, is it not? Yet Holder insists his decision to override the opinion of the Office of Legal Counsel is grounded in law, not politics. Right.

If that's true, why do you suppose Holder won't release the OLC opinion in question despite a letter from Sen. John Cornyn demanding its release? Justice said it wouldn't release these "internal deliberations," "because they're not the final, formal opinion."

Tellingly, the Post reports that legal experts don't back Holder's "unusual" decision to seek another opinion. Former OLC deputy Ed Whelan, who served during the Bush administration, calls Holder's decision to ignore the OLC's opinion a "blatant abuse" of the office's purpose.

Liberals are conspicuously silent about this abuse. They want the district to get a congressman because it would guarantee Democrats another seat. But notice their flagrant double standard. When they have their sights set on a desired political result, the law, including the supreme law of the land, is not allowed to interfere, even when there is barely, if at all, a legitimate question about what the law is.

But when government attorneys serving a Republican administration merely render an opinion that liberals don't like (e.g., warrantless surveillance of enemy communications in wartime and waterboarding not being torture), never mind that the opinion, unlike Holder's artificially procured second opinion, is firmly grounded in law; liberals sometimes want to impeach them or put them in jail for war crimes.

But more important than the left's hypocrisy is their ongoing disrespect for the Constitution when it suits their political ends. We are living in a time when the very integrity of the Constitution is being threatened daily, from federal bailouts to federal assumption of control over private business. That's why I urge you again to read Mark Levin's "Liberty and Tyranny," which brilliantly explains how preserving our liberties depends on preserving the integrity of the Constitution.

If freedom lovers and respecters of the rule of law don't come to the aid of the Constitution soon, we may be looking back in a few years wondering where our liberty went.

do ANY politicians--Democrat or Republican--pay any attention to the Constitution? The purpose of that document is to limit their power, thereby protecting freedom, because the more power politicians have, the less free we are. Does anybody really believe that McCain has any more respect for the Constitution than Obama, and wouldn't ignore it when convenient, just like Obama has? Do we need to be reminded that McCain, along with the traitor Russ Feingold, authored the single most blatantly unconstitutional piece of legislation in the history of the country? I'm sorry folks, but I just don't think we're going to get another president who honors his oath. We had one man, Ron Paul, who takes the Constitution seriously, but the Republican party and the MSM made sure he didn't have a chance. Four years ought to be enough for the people to catch on and fire Obama, but whoever replaces him will just be more of the same. Besides, if his first few months are any indication, the damage he'll do in 48 months will be irreversible.

Living in DC
Again I ask the question, why does ANYONE (besides the president) live in DC? Just the traffic alone is enough to make me ill. Think about it. Everytime the president goes out, traffic comes to a stop. I've seen that happen here in Houston when the G7 or some other self-important dweebs show up. The school in DC suck, the traffic sucks, and residents have no representation. The question remains- why live in DC?

I have to ask
I know there are conservative lawyers out there! Why isn't any of them putting together a Supreme Court case to take the ENTIRE GOVERNMENT before them on the grounds of so many blatant unconstitutional over reaches? I see conservative lawyers (including David)commenting on line everyday about how unconstitutional this or that is! Why isn't anybody stepping up to the plate? WTF?

but what good is it to just get us riled up about it? I'm a conservative, but I'm not a genius, a lawyer, a scientist, or an economist. I'm smart enough to know what they are talking about. All this talking about it gets us nowhere near to fixing it. These smart people that tell us about it need to get hot on it and get something going. Action now! Changing the Supreme Court is on Obama's list of things to do! WTF?

The Constitution
is what created America and the American Dream. It is short and simple and restricts the powers of the federal government. The restrictions were necessary, because the several states were independent functioning entities and the men running them had no intention of relinquishing any more of their power than was obviously efficient and logical. The ongoing transfer of powers to the federal branch of government has at the least resulted in a huge tax burden, and more seriously, reduced freedom as intrusive decisions are made further and further from the people affected. The powers of the federal government will not be monitored and restricted by the power-hungry pols in DC. The power and freedom of the people can only be defended by the people themselves. Pols who erode the restrictive protections of the Constitution must be removed from office by the voters. The pols will not enstall term limits, will not resign due to guilt feelings when they peddle their power for self-gain, will not even implement their oaths to serve the country and protect the constitution. The voters must do these things, that is what the vote is for. I could not vote for McCain because he was the architect of McCain/Feingold. The whole corrupt slimy mass should be voted out in 2010. If the voting public continues to vote for snake oil salesmen in hopes of gaining an advantage over another group of voters, the result is that we end up voting against one another. No one wins, except the DC fat cats who trash the country as they get rich selling influence. We have met the enemy and he is us.

Good -- maybe this will be quick
You know, all the "stuff" the Obama Administration is cramming through that is unconstitutional will, hopefully, end up before the Supreme Court and get slapped down, as it deserves. However, that takes a LONG time, usually.

One bright spot in this DC voting charade is, it might get there sooner rather than later. If Congress passes the DC voting law and tries to seat a congressman from DC, then lawsuits will surely fly quickly (I hope and pray). Maybe this will be the first salvo in a long and illustrious series of "U.S. Constitution, the Framers, the Founders, et al. versus Barack Hussein Obama."

Hope our Justices are up for some late night work.

If you want people in DC to get House representation, get it for them. But, do it legitimately. Amend the Constitution.

What Constitution??
It is given lipservice, but that is about all it is good for. The SCOTUS regularly stomps all over it and have for decades.

I'm with Matthew, when are the conservative lawyers going to actually do something to force the hypocracy into the open?? And I don't mean writting about it to the choir and the paid libtrolls that are only here to deflect the discussion.

If we follow the examples of many of the present cabinet members who did not pay income taxes including the man in charge if the IRS now, and if we follow the example of the Obama administration of disregarding the law and the Constitution, then we can all pick and choose which laws we are going to follow and which we are not. I like it.

Anarchy probably isn't for everyone. It won't work for most people. But for those of us who are military veterans trained in the tactics and use of weapons and able to do that, it's great. Anarchy is for the strong and those who can impose a superior force on others. Anarchy simply means I can take anything I want if I have seperior force.

Because the courts themselves are biased.

Whenever a citizen tries to file a suite that the courts believe may result in the loss of some hallowed liberal doctrine, all they do is refuse to hear the case by saying the plaintiff does not have legal standing.

Most of the court cases which have challenged the legal citizenship of Barack Obama have been dismissed on these grounds. Imagine, an American citizen who is suppose to cast a ballot for a presidential contender, does not have legal standing to demand proof that such contender is a natural born citizen as required by the Constitution.

Also cases where the legitimacy and Constitutionality of the income tax has been challenged by tax payers have been dismissed using this logic. Supposedly, a tax paying American does not have standing to challenge whether the income tax they are being forced to pay is Constitutional.

If this is not a blatant corruption of the courts, I would like to know what is.

A "living Constitution"

At what point do we take a good long look at the Constitution and declare that the document simply no longer applies? Sure, its cosmetic forms are still there -- we elect a president, the states elect senators and representatives, justices are appointed, a standing army is maintained, etc. -- but none of its restrictions on the power of the Federal government merit even a moment's consideration.

Fine. Let's just get on with formally abolishing it and granting all power to the committees.

Of course, once it is abolished, a curious thing happens: the compact binding the several states together dissolves, and each goes its separate way -- in our case, as a free and independent republic.

When you or any of your leftist Kool-Aid-drinking buddies see similar rallies by conservatives in support of that Vietnamese immigrant in the Binghamton massacre, the North Carolina nursing-home killer, and this guy in Pittsburgh - or even any rallies memorializing Timothy McVeigh - feel free to report it on this board.

It was people on YOUR side of the aisle who were egging on the 1992 L.A. riot participants with "no justice, no peace" chants. And I doubt that the protestors at the G-7 meeting that was held in Seattle a few years in which those protestors were committing acts of vandalism, just like the ones in Europe have been at the G-20 meeting, numbered predominantly Republican voters among their number.

For that matter, I haven't heard any liberals come onto this site and relate an incident of their cars being "keyed", or other property vandalized, for sporting placards/stickers espousing liberal candidates/causes. More than a few of us conservatives, on the other hand, have experience this when OUR cars/property sported declarations for conservative candidates/causes.
