Upcoming Case: High Court to Hear Parents’ Rights, Decisions Expected

On Tuesday, January 12, the U.S. Supreme Court will hear arguments in Abbott v. Abbott. At issue is a divorced couple, one of whom is an American parent who wants to keep their child in this country. But the United States is party to a treaty called the Hague Convention on International Child Abduction. This case will turn on how the Court interprets the term “wrongfully removed” [from a nation] in that treaty to determine which parent has custody over the child.

Additionally, the Court will hear arguments in United States v. Comstock, considering how much power the Constitution gives Congress to keep “sexually dangerous” criminals locked up in a civil confinement facility when their prison sentences are complete.

The Court is also expected to hand down decisions in cases that were heard over the past few months. A report will be filed after the Court adjourns for the day.
