In recent years, a new issue has arisen from the pro-transgender agenda. People who “change their gender” have pushed to have their birth certificates amended to reflect their “gender identity” instead of their biological sex.
This became an issue in Montana, where Gov. Greg Gianforte (R) signed S.B. 280 into law, which required transgender residents to undergo a sex reassignment procedure if they wanted to change their birth certificate to match their “gender identity” instead of their biological sex.
In Tennessee, a federal judge dismissed a lawsuit brought by transgender plaintiffs who wanted to change the sex designations listed on their birth certificates. The law does not allow them to change their birth certificates.
Now, one state appears to be moving in the opposite direction. Transgender residents in Illinois may soon be able to amend their birth certificate to match their “gender identity,” including if that certificate was issued in another state.
According to WTTW, a law passed by state lawmakers would allow this, if signed by Democratic Gov. J.B. Pritzker (via WTTW):
The bill allows Illinois residents to get a judicial order to alter the name and sex on birth certificates and other documentation issued in another state.
Currently in Illinois, the process no longer requires certification from a health professional, making it easier to request this change.
Left-wing organizations like Lambda Legal have targeted states with laws on the books that do not allow birth certificates to be changed.
In the Tennessee case, specifically, the organization said that policies like that are “discriminatory” and present a “roadblock” for transgender people.
“Late yesterday, a federal court judge upheld Tennessee’s discriminatory anti-transgender birth certificate policy that will not allow transgender people to correct the gender marker on their Tennessee birth certificates, leaving them grappling with inconsistent government identity documents. Tennessee is one of only a handful of states left in the country that still categorically prohibit transgender people from correcting their birth certificates to accurately reflect their identity,” Lambda Legal said in a statement.
