Sotomayer Ruled in Favor of Kelo on Steroids

Remember the outrageous Kelo vs. City of New London case -- where the Supreme Court's liberals, joined by Anthony Kennedy, ruled that it was constitutionally permissible for the governmental power of eminent domain to be used to take property from one private owner to give to another?

If you liked Kelo, you'll loooove Judge Sotomayor.  Law professor Richard Epstein -- an erstwhile colleague of the President's at the University of Chicago -- writes in Forbes about the Didden case, which came before a judicial panel that included Judge Sotomayor.  The case is a travesty, in which the panel essentially okayed extortion under the guise of eminent domain.

Judge Sotomayor should be ready for some tough questions about the Didden case.
