Filibuster-Proof Majority To Block Supreme Court Nomination Depends On...Supreme Court

Ken Klukowski of the American Civil Rights Union and Ken Blackwell of the Family Research Council hit the spot with their political analysis on the Fox Forum blog about the intersection of Soulter and Specter. Since the Minnesota election is still contested, and could reach the Supreme Court, the Supreme Court might decide whether or not and R or a D wins that race. That, in turn, would either give the Democrats the crucial 60th seat or leave them one short, which would determine whether or not R's can filibuster Obama's next Supreme Court pick.

The good news for us is that it's likely the Supreme Court would rule in favor of an R if it reached them.
