Welcome back to the "Stream of Kurtiousness!" Let's talk about Fauci's decision not to answer anything this week. Fauci was pardoned by Biden, so he won't be prosecuted for anything he did during COVID. Please don't hold your breath thinking the pardon is invalid because it was done by an autopen. That's just how it works.
If Fauci decided to answer some questions but asserted his Fifth Amendment rights on some, he could have had his Fifth Amendment right waived. That's why he chose not to answer what color his tie was or what day of the week it was. However, since Fauci was pardoned, he cannot be convicted of a federal crime for the time period he was pardoned for. Therefore, he cannot assert the 5th Amendment for crimes he was already pardoned for. But you need 60 senators to refer him to the Department of Justice. That's just not going to happen. What's more likely to happen is that states prosecute him for violating state laws. He wasn't pardoned for state laws! But then he can argue that since he was a federal employee, he should be tried in a federal court. Bottom line is that Fauci won't be forced to testify, and he's going to get away with it.
