The federal government in conjunction with the Obama Administration is arguing this law is an over reach of state authority and that the issue of employers hiring illegal immigrants should be dealt with solely by the feds. The problem is, Homeland Security Secretary Janet Napolitano, appointed by President Obama, signed the bill into law when she was the governor of Arizona.
This bill is different than SB 1070, which is still sitting in the 9th Circuit Court of Appeals, but a ruling on this case may signal how the Supreme Court will rule on the case against SB 1070 in the future.
