Appeals court: No war crimes trial for Rwandan

Appeals judges have ruled that there is not enough evidence to support a trial for a Rwandan man prosecutors had accused of responsibility for war crimes in Congo.

Prosecutors at the International Criminal Court had argued that Callixte Mbarushimana orchestrated attacks by exiled Rwandan Hutu rebels on civilians in Congo while the rebels built up strength in hopes of a violent return to Rwanda.

But appeals judges upheld a pretrial panel's ruling. Presiding judge Erkki Kourula said evidence _ including propaganda that Mbarushimana produced from his Paris apartment_ was not strong enough to lead to a conviction.

Mbarushimana faced 11 charges of war crimes and crimes against humanity but always maintained his innocence. He was arrested in October 2010 and released in December.
