Acquittal of US woman hunter won't be appealed

The prosecution won't appeal the acquittal of an American woman who fatally shot her husband while hunting in central Newfound four years ago.

Earlier this month, Newfoundland Supreme Court Justice Richard LeBlanc acquitted Mary Beth Harshbarger of charges of criminal negligence causing death in the fatal shooting of her husband, Mark.

The victim's family said Friday that prosecutor Mark Linehan has told them there is not sufficient cause for an appeal, which must be based on a judge's error in the law.

LeBlanc blamed numerous unfortunate circumstances that led the 45-year-old woman from Meshoppen, Pennsylvania, to believe she was shooting at a bear when she shot her husband.
