EASTON, Pa. (AP) — A Pennsylvania man who police say killed his girlfriend's 17-month-old daughter was sentenced to up to 40 years in prison, and the judge told him he wished could give him more time.
Gary Foley Jr. was sentenced Friday at county court in Easton to serve 20 to 40 years in prison, the maximum allowed.
The Morning Call reports (http://bit.ly/2ux5o1D ) Foley pleaded guilty in June to third-degree murder in a plea agreement.
If convicted at trial, Foley could have faced life in prison without parole.
The baby, Kannah Dew, died after being rushed to the hospital Feb. 24, 2015.
Foley told police Kannah choked on a piece of hot dog. But an autopsy revealed a significant fracture to the back of the girl's head.
Prosecutors said the only explanation for the injuries was that Foley caused them.
