Virginia man fatally shot by officer had BB gun, police say

SUFFOLK, Va. (AP) — A man fatally shot by an officer in Virginia was armed with a BB gun that looked like a handgun, police said Tuesday.

A Suffolk police officer encountered Corey Jason Achstein, 28, on Monday evening after responding to reports of a white man chasing three juveniles and threatening them with a gun, police said.

After another officer arrived at the scene, one of the officers shot Achstein based on safety concerns and the man's actions, police said.

Achstein, of Suffolk, later died at a hospital.

Police said a gun recovered at the scene was a "realistic style pneumatic" BB gun.

The officers, James Babor and Cheryl Abrigo, were placed on administrative leave.

Police are conducting criminal and internal investigations.

Babor, an eight-year veteran, fired the shot that killed Achstein, city spokesman Tim Kelley told the Virginian-Pilot (http://bit.ly/1Vos1g0) on Tuesday.

Babor was involved in another fatal shooting in 2010, Kelley said. A prosecutor determined Babor and another officer acted reasonably and neither was charged, he said.

Kelley said the results of the police investigations will be turned over to the commonwealth's attorney's office once they are completed.
