Man in Englishman's cyanide death found competent for trial

BANGOR, Maine (AP) — A federal judge says a Maine man charged with mailing cyanide to a suicidal Englishman is competent to stand trial.

Sidney Kilmartin of Windham has pleaded not guilty and filed a notice in March of his intent to use an insanity defense. Prosecutors say Judge John Woodcock on Friday found Kilmartin competent and Kilmartin withdrew the notice.

Kilmartin is charged with mailing cyanide to 49-year-old Andrew Denton of Hull, England, who then used the poison to kill himself in 2012.

Prosecutors say the case is set for trial in November. But the parties expect to postpone the start date.

The charges against Kilmartin include mailing injurious articles resulting in death. If convicted, he could face a maximum sentence of life in prison.
