CHARLOTTESVILLE, Va. (AP) — Five former members of the University of Virginia men's swim team are asking a judge to dismiss an ex-teammate's federal hazing lawsuit.
Anthony Marcantonio filed the complaint in June, alleging citing a series of events that he says occurred during the team's "Welcome Week" in August 2014. The defendants are Kyle Dudzinski, Luke Papendick, Charles Rommel, David Ingraham and Jacob Pearce.
Marcantonio says he and other first-year swimmers were coerced into consuming alcohol and live goldfish. He also says they were ordered to grasp one another's genitals.
In their motions to dismiss, the defendants argue that Marcantonio was a willing participant.
Marcantonio has since transferred to Northwestern University.
A September 2016 trial date has been scheduled.
