Prosecutors ask for Holmes' mental health records

DENVER (AP) — Prosecutors in the Colorado theater shooting case want the state mental hospital and the University of Colorado to turn over their mental health records on defendant James Holmes by Sept. 30.

In a filing Thursday, prosecutors say they're entitled to the records because Holmes pleaded not guilty by reason of insanity.

Holmes is charged with multiple counts of murder and attempted murder. He's accused of killing 12 people and injuring 70 in a suburban Denver movie theater in July 2012.

Prosecutors are seeking the death penalty.

Before the shootings, Holmes saw a psychiatrist at the University of Colorado, Denver, where Holmes was a graduate student in neuroscience.

After he entered the insanity plea, Holmes was ordered to undergo a mandatory sanity evaluation by the state mental hospital in Pueblo.
