SAN DIEGO (AP) — An 11-year-old boy accused of stabbing his playmate to death won't be tried on murder charges because he has been found mentally incompetent to stand trial.
U-T San Diego reports (http://bit.ly/QnLQjy ) Tuesday that a juvenile court judge concluded the boy suffered from mental health problems and developmental issues brought on by fetal alcohol syndrome.
The boy was 10 when he was charged with murder and felony assault in the death of the 12-year-old in January.
A hearing Sept. 18 will determine what residential treatment facility the boy will be sent to. If his competency is restored, he can face future charges.
The Los Angeles Times reports the boy's defense attorney told the court that the boy is remorseful, and he knows his best friend is gone and in heaven.
