NY court restores Tenn. company's magazine lawsuit

A New York appeals court has restored an antitrust lawsuit brought against publishers by one of the country's one-time largest wholesale magazine distributors.

The 2nd U.S. Circuit Court of Appeals on Tuesday granted Anderson News LLC's request to restore its lawsuit after it was tossed by a judge. The Knoxville, Tenn., company claims publishers that control 80 percent of the nation's magazines conspired to drive it out of business.

Anderson suspended operations after February 2009, laying off thousands of employees and selling assets at fire sale prices. It had operated since 1917 and had served 30,000 retail customers in 37 states.

Anderson lawyer Marc Kasowitz calls the ruling "well-reasoned." He says Anderson looks confidently toward trial.

A lawyer for defendants has declined to comment.
