Ruling against "Don't Ask Don't Tell" is vacated

SAN FRANCISCO (Reuters) - A U.S. appeals court vacated a lower court ruling that had struck down the now-defunct ban on gays openly serving in the U.S. military, saying that the issue is moot since the ban was repealed.

The 9th U.S. Circuit Court of Appeals issued its opinion on Thursday, after the "Don't Ask Don't Tell" policy officially expired last week.
