Patient in 2007 TB scare can go ahead with lawsuit

A man who was thrust into the center of a 2007 tuberculosis scare will be allowed to move forward with his lawsuit against the federal Centers for Disease Control and Prevention.

The 11th U.S. Circuit Court of Appeals in Atlanta on Friday reversed a federal judge's ruling that dismissed Andrew Speaker's lawsuit against the CDC.

Speaker sued the agency in April 2009, claiming that federal officials publicized his condition to make an example out of him. The lower judge found that he didn't show enough evidence to prove the CDC was to blame.

The three-judge appeals panel disagreed and will allow the suit to continue.

Speaker said he's pleased by the ruling. CDC spokesman Tom Skinner said agency doesn't comment on pending lawsuits.
