SALEM, Mass. (AP) — A Massachusetts officer married to his police chief has resigned after being charged with sexually assaulted an intoxicated man inside a police station closet.
A Salem city attorney confirmed to The Salem News (https://goo.gl/cO9F2D ) that 56-year-old Brian Butler resigned two days after his arrest earlier this month.
The alleged assault occurred Oct. 31 and was reported on Nov. 5. The accuser was in protective custody and told investigators he felt compelled to go along because he was in fear.
Butler told investigators the encounter was consensual, and his lawyer says prosecutors must prove there was no consent.
Butler has pleaded not guilty to rape and indecent assault and battery and is free on bail.
His wife, Mary Butler, has returned to duty as chief after taking personal leave.
