NEW YORK (AP) — A federal appeals court in New York has granted a new trial for a lawyer from an affluent Chicago suburb convicted in a multibillion-dollar tax shelter scheme.

The 2nd U.S. Circuit Court of Appeals noted Monday a juror lied about her background at the trial of David Parse.

The court refused to throw out Parse's 2011 conviction for mail fraud and obstructing the administration of tax laws.

The trial judge had earlier ordered new trials for his co-defendants. But the judge says the Elmhurst, Illinois, resident isn't entitled to one because his lawyers knew during the trial about the corrupt juror.

Defense lawyers argued during the trial their clients didn't think what they were doing was wrong.
