Marine wants new charges in Iraq war crime tossed

CAMP PENDLETON, Calif. (AP) — Defense lawyers for a Marine who is being retried in a major Iraq war crime case asked a military judge to remove himself, calling him biased and unfair.

Marine Capt. Andrew Henderson rejected the claims by the defense Thursday during a hearing for Sgt. Lawrence Hutchins III at Camp Pendleton, California.

The Marine Corps re-charged Hutchins in the killing of an unarmed Iraqi policeman in 2006 in the village of Hamdania after the military's highest court overturned his murder conviction last year.

Hutchins served over half of his 11-year sentence. The court found interrogators had violated his rights in 2006.
