WASHINGTON (Reuters) - The Supreme Court on Wednesday threw out an appeals court ruling that said an anti-nuclear weapons protester could not be prosecuted for demonstrating at a U.S. military installation in California.

On a unanimous vote, the court found fault with a federal appeals court decision that said the protester, John Apel, was immune from prosecution because he had been demonstrating on a public road that crosses the Vandenberg Air Force Base. The court did not rule on another of Apel's objections, which could yet prevent him being prosecuted.
