You're spot-on on the Shepard Act. But it's more than unnecessary: it's discriminatory.
The language of the Act makes the punishment for mugging a straight man less than the punishment for mugging a gay man. You are completely right; there is no way to prove that most crimes have any sort of prejudice-based element--with the possible exception of a perp with a swastika tattooed on his shaved head. But this is obviously the exception, rather than the rule.
