9-0 decision on Ricci?

I don't understand why you're saying the Supreme Court decided Ricci 9-0.

The opening of the decision shows it was 5(Kennedy, Roberts, Scalia, Thomas, Alito) to 4(Ginsburg, Stevens, Souter, Breyer):

"KENNEDY, J., delivered the opinion of the Court, in which ROBERTS, C.J., and SCALIA, THOMAS, and ALITO, JJ., joined. SCALIA, J., filed a concurring opinion. ALITO, J., filed a concurring opinion, in which SCALIA and THOMAS, JJ., joined. GINSBURG, J., filed a dissenting opin-ion, in which STEVENS, SOUTER, and BREYER, JJ., joined."

It should have been 9-0 but was 5-4

Who can figure. The fireman was obviously discriminated against and denied his rightful promotion based on the requirements. That should take priority over a desirable but impractical, unfair quoto standing. Why did the four deny the fairness that was called for? More power to the 'five' wise judges who got it right!
