When I heard this I cussed up a blue streak. The IDIOTS who voted for this clown NEED to be biotch-slapped into reality. I don't know just WHAT Constitution these fools are reading,but it sure as hell ain't the one that has guided the land for lo these many years. What next,FULL citizenship for the damn detainees and new captures? BrianR is exactly right.The 12c solution will be the preferred method in the future. Good post,Flag.

Do they meet these requirements?

Adopted on 12 August 1949 by the Diplomatic Conference for the Establishment of
International Conventions for the Protection of Victims of War, held in Geneva
from 21 April to 12 August, 1949. Entry into force 21 October 1950

PART I

GENERAL PROVISIONS

Article 4

A. Prisoners of war, in the sense of the present Convention, are persons belonging to one of the following categories, who have fallen into the power of the enemy:

1. Members of the armed forces of a Party to the conflict as well as members of militias or volunteer corps forming part of such armed forces.

2. Members of other militias and members of other volunteer corps, including those of organized resistance movements, belonging to a Party to the conflict and operating in or outside their own territory, even if this territory is occupied, provided that such militias or volunteer corps, including such organized resistance movements, fulfill the following conditions:

(a) That of being commanded by a person responsible for his subordinates;

(b) That of having a fixed distinctive sign recognizable at a distance;

(c) That of carrying arms openly;

(d) That of conducting their operations in accordance with the laws and customs of war.

According to that international agreement on the rules of engagement nonuniformed combatants captured on the battlefield can be shot on the spot.
If a combatant is captured then he is a POW and should not be tried but held in a POW camp until the end of the war.

If a combatant is captured and the administration wants to treat him under criminal law...GREAT. He should be tried and sentenced in the country where he allegedly committed his crime.

Craw: The Obama administration is lawless, so they don't care about the GC. According to the left GC conventions apply to anyone WE face, in the vain expectation that freaking terrorists will capture one of ours and put him in a POW camp! The terrorists take no prisoners unless they can be used for propoganda purposes; maybe we should adopt that standard as well.

buck: Stop thinking that the Obama administration cares about laws and treaties, or ever thinks through a decision. Since they do neither it is relatively easy to understand why terrorists deserve Miranda...because Obama says so!

We know more about the Constitution than Obama does, because WE read it and understand it, and because we appreciate it for what it is. We don't have some belief that we get to change an individual right to bear arms into a 'collective right'...whatever THAT means; nor do we butcher a simple statement that the government shall not establish a state religion into meaning that putting up a Christmas tree on the town square means the federal government is establishing a Church of the United States. For Obama and his ilk the Constitution is not a document to be studied, revered, or understood but one to be twisted and manipulated for their own political ends. 'Constitutional Scholar' my black arse...more like 'Constitutional Assassin'!
