Technically, it probably was not a violation of the 1st ammendment due to the fact he was probably charged with inciting to riot, failing to disperse, or some other made up chare. In actuality, his rights were violated but you could never prove it in court.

A wiser man would not have been there at all, much less wearing that T-shirt.
