1) Exactly right. I have often wondered WHYthese cowardly legislatures weren't all over an OBVIOUS usurpation of their powers. You know,the old "can't stand the competition" type of thing.
2)This is why elections matter. The more liberals in power,the worse our courts will be.I also think a test to see if they understand the Constitution and how it limits THEIR powers. Might dissuade a few from seeking office in the first place,if their motives are anything other than what they SHOULD be. 3) See 2. 4) No question. Now THAT is H&C we can believe in!!!
5) What with all the libvermin stocking a lot of these courts,it is no wonder they do this crap. Court shopping is something that ABSOLUTELY has to be stopped. Well,CK, I'm packing up the motorpalace today,heading back for Michirut, so I'll get caught back up with you when I get home early next week. Take care.

I think the founders counted on the branches pushing against each other, but when they both converge on the people, that is unexpected.

I have heard that Bush did well in putting conservatives in the US District Courts. I haven't researched that myself, but I heard that from a state legislative conservative here in MN.
