Harry Reid announced today that it's unlikely the Senate will have a healthcare bill available this year. Obviously, he realizes that he doesn't have the votes to prevent a filibuster, now that he's lost Snowe and Lieberman.

This is very good news, as it'll lose momentum, particularly over Christmas break, and then it rolls into 2010... an election year!

A quick thought on judges

I couldn't help but think of Madison v. Marbury on that one. Just before leaving office, Adams passed the Judiciary Act of 1801, which increased the number of judges, which he promptly filled by putting in Federalist judges. Jefferson didn't like, and there were a few judges who were picked and nominated by Adams who were never given their "marching orders. Jefferson did not give these men them, because he was worried about a federalist court...

This dispute led to arguable the most important case in American history.

But my point is that the question of fairness on judges is not new. Another time when it came up was under FDR, who tried to stack the court in his favor...

Is it Fair?

Are the Democrats of Montgomery County, PA that are saying it is not fair to have all Republicans on the PA Supreme Court saying the election was not fair or it was not fair that the people voted and put all Republicans there? I bet they would have no problem if it was all Democrats. If it is becasue the people voted their will, then that is disturbing. What do they suggest, overrule the will of the people and put some Democratic judges on the bench? Now we are talking real socialism. Not just economic socialism.

My basic philosophy is that the actual words of the Constitution overrule anything a court may say in a ruling.

That was part of what made that case so significant-- it allowed the Supreme Court to be the final arbiter of what it says.

I tend to lean toward agreeing with you that it says what it says, and it doesn't say anything else.

I know Marbury v Madison basically gave the SCOTUS the authority to determine what the Constitution says, but it is the duty of the PEOPLE to oppose the rulings of any court when that ruling runs counter to the actual words of the Constitution.

The best examples are the rulings regarding church and state, when the courts have ruled that a city council putting a manger scene in city hall is a violation of the "establishment clause", when that clause begins with "Congress shall make no law..." If it isn't Congress making a law, then that part of the 2nd Amendment doesn't apply. PERIOD!

I agree that is the proper way to analyze a constitutional issue. However, you brought out a question in your response: how do you overturn the Supreme Court? You can pass a law, but that's not as open as it seems, because the new law has to pass the muster of that same court. So, who really has checks on the court?

Take the fairness of having all Republican judges in a district. How do you even that out, especially if they are choses for life? Short of changing the judicial set up in that district, its tough. You could maybe impeach and convict a judge, but you need cause, and even then that's a tough standard.

And if you decide you can overrule a court on your own, what effect does the court have to begin with? Marshall and Jackson had that exact dispute, where Marshall ruled against Jackson and he basically said-- OK, now enforce it, enticing him along...

Again, I agree that the Constitution can speak for itself, and we need not put much else into it. The establishment cause is a great example.

What I am trying to bring out is the problem of having a court with meaning in place.

The only way is to point out in the press and through the politicians what the actual language says and how the rulings have absolutely no basis in the Constitution. From then on, it's civil disobedience.

This is why we really need a strong conservative and Constitutionalist party nationally. It surely ain't the GOP.

There is truth there, but it is still a tough task.

First, the court can be subject to reflecting the popular will. A study of free speech cases shows this.

Second, the president in power selects the judges.

But... there is no guarantee they will follow popular movements, and there is no guarantee they will follow the will of the president who nominated them. O'Connor, for instance.

So, again, I agree it is important to put pressure on them and to have this pressure come from solidly conservative groups, elected or not, its not always so easy.

Should the court make laws? No, they shouldn't, and they do. Sometimes, they make them up as they go along, ie abortion line of cases. It has turned out a mess...

Good run up to the elections.

Your commentary on judges was point on. The elections saw Pa. elect many Pub jurists and they also picked up some state legl. seats. Only Rove mentioned this following the elections. But, that was an important bellweather idea for 2010. Va., saw up and down elections for Pubs adding to the state houses. This too points to 2010. BTW, the white female won the seat in Atlanta but not by a majority so there will be a run-off. Drop by my newest claw and rant. Thanks.
