That is so true and something that is forgotten in all of this. For example, just because I get a group of people together (let's say, shoe sniffers) does NOT mean we can declare ourselves a nonprofit organization under the law. We need to meet the criteria. If the shoe sniffer lobby was strong enough, though, we could convince enough judges that we were being denial "equal treatment" because we were shoe sniffers, even though we were free to form real non-profit organizations.
