It seems to me that the court severely overreached. It it was concerned about privacy, since domestic partnership members are treated the same as spouses, it could have requested that the legislature craft a privacy requirement so that anything that asked for "status" included "domestic partner/spouse" instead of making a distinction.

Licensing is the domain of the people of a state. The court could have made a better cases for striking down marriage licensing in the existing form, thereby giving the legislature a chance to come up with a fix, instead of dictating what exact changes should be made.

Regardless, there are just some cases where men and women are not interchangeable, and this is one of them. Being attracted to men does not make you a bride, and being attracted to women does not make you a groom.
