Yeah, this Electoral College nonsense has been kicking around for a while. Out here in Leftifornia, the plan keeps being proposed that the state's Electoral votes be determined by the national popular vote results.

Frankly, I don't think it will pass constitutional muster, and SCOTUS will shoot it down. Here's why.

The Constitution gives the states the power to determine their own method of allocating Electoral Delegates; but it also says, essentially, that it must be based on an election. Obviously, an internal state matter.

However, by allocating delegates based on the national popular outcome, residents of every OTHER state in the Union are determining that particular state's appointments. That's clearly unconstitutional.

Hell, the residents of State A could all abstain from voting -- not cast one single vote for anyone -- and still have a delegation sent to the Electoral College.

That would, in essence, allow states to outlaw elections, which is also, in and of itself, unconstitutional.

It'll never go anywhere.

The Dem/Libs keep floating this silly idea around. They STILL can't get over 2000.

Now, proportional allocation of delegates is perfectly constitutional, and some states do it that way.

Frankly, I wish it were the norm. Here in Leftifornia, our 55 delegates are awarded en bloc (winner-take-all), and even though this state is still about 45% Republican, ALL 55 are awarded to the Dems, at least since Reagan. That's why the GOP doesn't even bother campaigning here.

It also disenfranchises the 45% of the state that's non-Dem. Why even bother voting at all after the primaries?
