Ohio Issue 6.

Regarding the loophole on taxes Ohio Issue 6, I've read that it could conceivably happen if an Indian casino would open in Ohio. That scenario is kind of complicated, so let's draw that out.

Issue 6 says that the casino, assuming it passes, and if another casino, at a later date, would open in Ohio, the first casino would then pay the lower of whatever the new casino pays, or 25%.

The zero percent tax issue possibility is mentioned in relation to an Indian casino, because, should one open in Ohio, the state would have no taxing authority over it, so the Indian casino pays zero, which, as those who are against Issue 6, would mean that the casino in Wilmington would pay zero as well. However, the supporters of Issue 6 say that an Indian casino would not apply to that clause, because an indian tribe is not a taxable entity, meaning they'd go on paying 30%.

But let's leave aside that question for the moment, and accept that those opposing Issue 6 are correct. Even in that case, there are a number of hoops that would have to be jumped through to get an Indian casino in Ohio. The first, and major one, is the fact that there are no federally recognized Indian tribes in Ohio. So a tribe would have to get recognized here in Ohio by the department of Indian Affairs. Then there are more hoops to go through, which I won't attempt to go through from memory. Suffice it to say that an Indian casino will never happen in Ohio in our lifetimes. So I'm not worried about the tax concern related to Issue 6, and I intend to vote for it.
