I read your well written article and I agree in principle with your view. However, I have been associated with the legal system in civil matters on two occasions and in both cases common sense in the legal system is misplaced. One example was an individual moved a double wide into our unincorporated area that had restrictions to mobile homes. It took two years for the court to determine that a double wide modular home is a mobile home or a house trailer. Putting lipstick on a pig and calling it something different is exactly what happened. Another would be the case where a woman at a drive-thru placed a cup of hot coffee between her legs and got burned and filed a lawsuit. Common sense lacked again. Another example of tort excess is with the tobacco lawsuits. Smoking for 50 years and filing that tobacco caused cancer even when the fault lies with the smoker. Today, cigarettes are still legal yet people continue to file suits to try and milk the tobacco companies. Common sense tells me that tobacco causes cancer and I am going to assume responsibility for my actions and give up smoking. The law apparently does not recognize that people need to be responsible for their actions and those same people have determined, through no fault of their own, that the manufacture is solely responsible. In some cases that is true but then again the media only tells us about the sensational cases.
In a 60 sec commercial on presciption drugs, 30 seconds or more are devoted to disclaimers or the facts that the medicine has a potential for side effects. Is this a result of tort actions? OK, I will get off my soap-box......I am not an attorney but if you need a good accountant then let me know!
