Is there anything fair about the unfairness doctrine?

I guess freedom of choice is unfair. But our constitution gives use freedom of choice. It guarantees equal opportunity. No one can guarantee equal out-come. Your out-come depends on your choices and what you do with them. To quarantee equal out come means that someone who works harder than someone else or makes maybe smarter choices can only achieve what someone else has. Now that's not fair.
